On June 10, 1998, the Board of County Commissioners granted approval and authorized execution of a contract between Monroe County and the Monroe County Sheriff's Office, to provide the services of uniformed deputy sheriffs to provide law enforcement services at Key West International Airport. Enclosure cc: County Attorney Finance County Administrator, w/o document File ";':; ~l\ ~!;"i;..;:,. ~ CONTRACT FOR LAW ENFORCEMENT AND SECURITY SERVICES AT KEY WEST INTERNATIONAL AIRPORT THIS CONTRACT is entered into by and between the Monroe County Sheriff's Office (hereinafter referred to as "MCSO" "Sheriff") and the Board of County Commissioners of (hereinafter referred to as the "County") on the of ..... h2.bl~ , 1998. or the Monrl/l County /lJ day 1- PURPOSE: The purpose of this Contract is to state the terms by which the Sheriff will provide the services of uniformed deputy sheriffs to provide law enforcement services at Key West International Airport (KWIA) . 2- SCOPE OF SERVICES: A. The Sheriff shall assign fully sworn and certified law enforcement officers to KWIA to enforce the criminal law of the State of Florida and County of Monroe. The deputies shall further enforce airport rules and regulations to the extent permitted by law. B. The County desires to obtain the services of five (5) deputies, who shall take their place at KWIA as existing non- certified personnel retire or otherwise terminate their employment with the County. The Sheriff agrees to supply these deputies as they become available, but only after they have participated in the Sheriff's Field Training Program and are otherwise eligible, according to MCSO policy, for full-time assignment to law enforcement duties. 3 - APPOINTMENT AND SELECTION 5 (:) z )> ::0% A. CD i! ~ 1'10 :tilt ::c \0 .. "", G\ 4fy ;= ,." o ." <:) ::0 ::0 ", ("') o ::0 o 4- MANAGEMENT AND SUPERVISION A. Deputies assigned to work at KWIA shall remain the Sheriff's personnel. They shall be subject to all policies, rules, regulations and discipline of the MCSO. B. KWIA Deputies shall report to and be subject to the direction of a deputy assigned as their supervisor (currently Deputy Jerome Fain) . Supervisor Fain shall report to and be subject to the direction of his supervisor (currently Lt George Simpson) . C. The Director of Airports shall meet with Lt Simpson or his successor to discuss the operational and security needs of KWIA. Lt Simpson shall, in cooperation with the Director, develop, plan and manage the delivery of law enforcement and security services by the Sheriff's deputies at KWIA. On a day to day basis, the Director may give direction to Sheriff's personnel at KWIA, through their Supervisor. 5- COST REIMBURSEMENT A. PERSONNEL: The County shall,while this Contract is in effect reimburse the Sheriff the actual cost of each assigned deputy's salary, equipment (to include a fully equipped leased patrol vehicle), retirement contribution, FICA, Medicare, salary incentive payments and professional liability insurance coverage. The County shall remain responsible for the costs of health insurance, life insurance and worker's compensation coverage as it currently does for MCSO personnel. B. COVERAGE FOR ABSENCE DUE TO TRAINING, SICK, VACATION OR OTHER LEAVE TIMES. The County recognizes that certified law enforcement officers require continued training throughout their careers. Every deputy assigned to KWIA must receive training identical to that which is required by law and MCSO policy for all Sheriff's deputies. When a deputy is absent from KWIA due to training requirements, vacation, illness or injury, or other reason, as authorized by the Sheriff, the Airport Director shall be informed and given the opportunity to incur the expense of overtime or special detail pay for replacement. The County shall not be liable for overtime or special detail pay without the prior authorization of the Airport Director or his superiors. Every reasonable effort shall be made by MCSO to schedule training and vacations so that no more than one deputy is absent at one time. MCSO shall coordinate the scheduling of deputies with the Airport Director. 6- APPLICABLE LAW: A. This memorandum of understanding shall be governed by and construed under the laws of the State of Florida. Venue for all actions hereunder shall be in Monroe County, Florida. B. County and MCSO agree that they will comply with all relevant federal, state and county laws and regulations and specifically agree not to discriminate against any person on the basis of race, religion, gender, ethnicity, national origin, or disability, and specifically agree that they shall comply in all respects with the provisions of the federal Fair Labor Standards Act with regard to overtime pay and conditions of work. 7- TERM: This memorandum of understanding shall commence October I, 1997 and shall expire September 30, 2000.
