04/25/2000 Agreement AGREEMENT MCSD/FKCC OPERATION OF EDUCATIONAL TELEVISION CHANNEL 98 THIS AGREEMENT entered into this 25th day of April, 2000, by the Monroe County School District (MCSD) and Florida Keys Community College (FKCC), (heretofore referred to as the Consortium), is to jointly operate Channel 98 as an educational television channel, as enabled by the settlement agreement between AT&T and the Monroe County Board of Commissioners, per the following terms: (1) The channel will provide educational programming and programming to provide exposure for educational programs. (2) Programming will be on a 24 hour 17 day per week basis; however, programming may be as minimal as the airing of a logo. Air time will be allocated as follows: MCSD: Tuesday, Thursday, Saturday; Sunday midnight to noon FKCC: Monday, Wednesday, Friday; Sunday noon to midnight. Modifications may be made as agreed to by the Consortium members. A joint bulletin board may be run at times agreed upon, on any day of the week. (3) The Consortium will operate the channel using two head ends, one located at FKCC and one located at the MCSD. Consortium members will be responsible for the broadcasting equipment at their respective sites. Each site will provide back-up for the other in the event of technical difficulties. (4) A board of 4 individuals from each Consortium institution will make major policy decisions. The County Administrator (or designee) will serve as the Monroe County government liaison. Ongoing decisions will be made jointly by one party from each Consortium member. Decisions regarding day to day operation will be made by the staff member assigned at each site. (5) The Consortium agrees to comply with all copyright laws. No external commercials will be aired; however, program sponsors may be acknowledged. (6) The Consortium agrees to give AT&T at least 30 days notice before beginning operation. Operation will begin following approval of the Monroe County Board of Commissioners, the Monroe County School Board, and the Florida Keys Community College Board of Trustees. An August 1,2000 start date is expected. FKCC telecourses will be moved from Channel 16 to Channel 98 at that time. (7) The Consortium agrees to present an annual report of its activities and its plans for the coming year to the Monroe County Board of County Commissioners for approval each June. TERM OF AGREEMENT: The term of this Agreement shall be from the date of the Agreement, and shall remain in full force and effect until June 30, 2000, and from July 1 through June 30 each year thereafter, except that either party thereto may terminate this agreement by giving at least thirty (30) days written notice to the other party.
