AGENDA ITEM WORDING: Approval to submit a grant application to the Florida Department of
Transportation for the Florida Keys Overseas Heritage Trail Project.
ITEM BACKGROUND: FDOT has advised us of a County Incentive Grant Program that is designed to
relieve congestion on the State Highway System. The Overseas Heritage Trail Project will likely meet the
intent of the grant and will qualify for 50% funding. $1 million is being requested and the County will
match $1 million using the transportation impact fees previously approved by the BOCC in Resolution
205-2000. The deadline for this application was September 30, 2000 but has been extended to obtain
authorization from the BOCC.
PREVIOUS RELEVANT BOCC ACTION: On May 18,2000 the BOCC authorized the Department of
Environmental Protection to design, build, and maintain the proposed Florida Keys Overseas Heritage
Trail and pledged $1 million in transportation impact fees during FY2000/200 1 to upgrade, widen and
close gaps in the existing trail. (Note: DEP would have applied for the funding if they could but this grant
is for Counties)

The Florida Keys Overseas Heritage Trail (OHT) is intended to provide safe non-
motorized transportation to schools and businesses, enhance community recreation
opportunities, stimulate sustainable economic development and enable residents and
visitors to enjoy the magnificent natural and cultural resources along US Highway ~ in
Monroe County. The trail will incorporate cultural features such as Flagler's HiStoric
Bridges and significant environmental elements unique to the Florida Keys. The trail will
act as an economic stimulus for adjacent b?Sinesses and provide safe, convenient
recreation and alternative transportation for children and families.
The GIlT will establish an interconnected linear trail for shared recreational uses and
alternative 1IansportatiO(\ uses. It will incorporate new construction and reconstructed
local pathways within the state road right of way, and over both the state road and
historic bridges, in a continuous trail from MM 0 (Key West) to MM 106.5 (Key Largo).
The design. of the trail will establish a safe, two-way, non-motorized pathway with secure
lIailheads, bathrooms, rest stops, shelters, drinking water, periodic call boxes or
telephones. and safe travel clearances for all types of trail users.
The trail will reduce traffic congestion on the state highway by reduc~ the numbers of
local vehicle trips and by eliminating many of the traffic-slowing effects of vehicle,
bicycle and pedestrian interactions. The trail will maximize separation from U.S. 1, local
streets and congested parking areas by the use of traffic barriers, landscaping,
underpasses, overpasses, and the historic bridges, to the greatest extent possible. These
improvements along the length of US 1 will greatly increase safety for both pedestrians,
cyclists and drivers.
The ORT is part of the Florida Department ofTJ:ansportation (FOOl) Five Year Work
ProgJ:affi. The following table provides further descriptions of the project, and the
applicable Work Project item numbers and annual phases from 2001 to 2004. These
initial development pw~s for the OHT are being funded as Monroe County's local
enhancement projects under the TEA-21 Enhancement Grants program. A considerable
amOlmt of additional funding is needed to bring these projects into compliance with the
County's approved mastc;r plan for the ORT.

The requested matching funds will be applied to the project phases scheduled for
development in 2001, 2002 and 2003. These projects have not been designed in
compliance with the County's approvw master plan for the trail. The matching funds
may be applied toward widening upland trail sections to comply with minimum width
recommendations of the master plan, and to rehabilitate historic bridges to provide
separation of the trail from the US 1 highway bridges.

2001 projects. Construction is expected to begin during the f1!St half of 200 1. A
schedule for future development of the trail is indicated on Table 1, extending from 2001
to 2004. Additional development projects may be scheduled. conourrently 'With these
phases and beyond 2004, to upgrade existing paved pathways aloni US 1 to comply with
the,standards established by the County's master plan. to rehabilitate and adapt historic
bridges for trail use, to close gaps between the current projects and existing segments and
to provide various amenities along the trail.
Current cost estimates for the scheduled project phases are shown on Table 2, below.
Revised costs to include changes to bring these projects into compliance with the master
plan are now being developed. The build-out cost of the OHT will be much larger than
the total cost of these initial development projects. (For example, preliminary estimates
for the rehabilitation of five historic bridges between Big Coppitt Key and Saddlebunch
Key, necessary to separate the ORT from the US I highway bridges between MM 11 and
MMlS, amount to between $3.5 and $4 million.) Consequently, Monroe County and the
FDEP Division of Recreation and Parks, working in parmership with the FOOT, have
made a long-term. commitment to pursue additional funding to implement the OHT
master plan.

ill Relevant Information
a) Greenways and trails are well docrumented for creating and enhancing economic
benefits where they are placed. The OHT, when developed in Monroe County, will
provide over 100 miles of connections between cities, towns, residential areas, parks.
shopping areas, lodgings and tourist destinations. Because of its unique
characteristics: the year-round sunny, warm climate and the tropical scenic beauty, it
is expected that the OHT will become a world renowned trail. This will serve to
attract trail enthusiasts from a far greater area than is typical and will encourAge a
significant volume of use by both resident and tourist populations. Local hotels,
restaurants and other businesses will benefit from this sustainable form of tourist
activity through increased spending on both durable and consumable. Property
owners also will benefit, since trails generally increase the value of properties
adjacent to their corridor, particularly where they pass through residential
neighborhoods.
b) The FDEP Division of Recreation and Parks now manages six state trails as part of
the Florida state park system. None of these trails has the urban setting, destination
characteristics or economic impact potential that the OHT will have. The Division
estimates that, in the last year, the combined 145.5 miles ofsta.te trails in the park
system contributed approximately $13.3 million to the local economies in which they
are located. It is expected that the annual economic benefits of the OHf will be
significantly higher than this amount
c) The OHT is a long-term project. Matching funds from the County Incentive GTant
Program will accelerate the completion of the project and will bring the first phases of
construction into compliance with the County's master plan at a much early date than
will be possible if funding is to be secured through other funding processes.
d) It is anticipated that private developers whose projects include frontage on the OHT
will be encouraged tel include construction of portions of the trail as part of their
development or redevelopment projects. A variety of public/private partnerships are
contemplated by the County's master plan for provision of goods and services to
users along the trail. Matching funds for the early phases of trail development will
allow that construction to be in compliance "'lith the standards of the master plan.

processes to protect adjacent sensitive natural resources such as mangroves,
seagrasses and intact tropical hammocks. Cultural resource protection and
e~ent is one of the greatest benefits of the proposed trail The bridges
constructed for Henry Flagler's railroad in the early 1900's will be stabilized and
adapted to use for the trail to the extent feasible, lUld maintained as parts of the
Florida state park system for futute generations. Three of the bridges are on the
National Register of Historic Structures, and listing of additional bridges may be
accomplished in the future.
g) US 1 in Monroe County is arguably on of the most congested highways in the state
highway system.. Seasonal influxes of travelers combined with a large resident
population with no viable alternatives to automobiles for day-to-day errands result in
periods of time when movement along the corridor becomes higWy frustrating and
unsafe. The om is proposed to be a minimum 10-foot wide, average 12-foot wide
and occasionally 14-foot paved bikeway from Key Largo to K.ey west. This provision
of a safe, non-motorized alternative for resident and visitor travel along the corridor
will significantly benefit the FDOT goals to encourage intermodal transportation
systems, and ",ill result in greatly improved public safety 011 the state highway.

Dear Mayor Freeman,
Recent legislation signed by the Governor has created the County Incentive Grant Program,
Chapter 339.2817, Florida Statutes. The County Incentive Grant Program (ClOP) allows the
Department of Transportation to make grants to counties for the improvement of transportation
facilities on the State Highway System. Grants may also be used for local transportation
facilities that relieve congestion on the State Highway System. Local municipalities may apply
for grants through their respective counties.
The statue establishes the following percentages for matching funds:
. 60% of costs on projects on the Florida Intrastate Highvvay System,
. 50% of costs on other State Highway System Projects, and
. 35% of costs for local projects that relieve congestion on the State Highway System.
The current funding of the program is $ 100 million per year for the next three fiscal years
distributed by statutory fonnula for each district. District Six's allocation is $ 13.36 million for
fiscal year 20001200 1. Each district will solicit, review and rank their eligible projects. A
summary of the ranking criteria is enclosed for your information.
To implement the program this.fiscal year, the Department is requesting all candidate projects be
subnutted by September 30, 2000. From this list, District staff will select projects for inclusion
into the Fiscal Year 2000/2001 and 2001/2002 work programs. In March 2001, you will receive
an invitation to submit candidate projects for the second year of the new tentative work program.
Once a project has been selected for inclusion into the work program., the county will need to
enter into a Joint Participation Agreement with the Department.

Summary
Ch. 339.2817, F.S. (Senate Bill 862) provides for grants to counties t.~ improve transportation facilities
that are located on, or relieve congestion on the State Highway SystElm. Municipalities may apply
through their county who will evaluate .the proposed project.
Program Management .
The program will be administered through Work Program Instructions. There wiD not be an .
administrative rule. Districts will solicit, review, and rank eligible projects. At the District Secretary's
discretion, Districts may participate in cost overruns. A Joint Participation Agreement (JPA) must be
executed to grant any funds. The FOOT Comptroller is developing standard "boiler plate- JPA
language.
Eligible Projects
Eliglible projects. may include transit and other modes, and must improve a facHity on the State
Highway System, or relieve congestion on the State Highway System. Each project must be consistent
to the maximum extent feasible with the Florida Transportation Plan, any existing MPO plan, and any
local govemment comprehensive plan. .

County Incentive Grant Program
The 2000 Legislature has created a County Incentive Grant Program for the purpose of providing
grants to counties, to improve a transportation facility which is located on the State Highway
System or which relieves traffic congestion on the State Highway System.
Each eligible project must be consistent to the maximum extent feasible with the Florida
Transportation Plan, Metropolitan Planning organization Plan where. applicable,.and any
appropriate local government comprehensive plan.
The department must consider, but is nQt limited to, the following cr tena for evaluation of projects
for County Incentive Grant Program assistance: ..
The extent to which the project will encourage, enhance, or create economic benefits;
The likelihood that assistance would enable the project to proceed at an earlier date than
the project could othelWlse proceed;
The extent to which assistance would foster innovative pUbllc-private partnerships and
attract private debt or equity investment;
The extent to which the project uses new technologies, including intelligent transportation
systems, which enhance th~ efficiency of the project; .
The extent to which the project helps to maintain or protect the environment; and
The extent to which the project includes transportation benEtfits for improving
intermodalism and safety.
The percentage of matching funds provided from the County Incentive Grant Program to the
eligible county will be based on the following:

(a) For projects on the Florida Intrastate Highway System the department shan provide 60%
of project costs.
(b) For projects on the State Highway System the department shall provide 50% of project
costs.
(c) For local projects which are demonstrated to relieve traffic c:>ngestion on the State
Highway System the department shall provide 35% of proje<,'t costs.
At the discretion of the District Secretary of the district Involved. the department may agree to
participate in cost overruns on a project subject to availability of funds. However, the county is
ultimately responSible for all cOst overruns.

A municipality may apply lothe county in which the municipality is klCated for consideration by
the county for funding under this section of any project or project phase of a transportation facility
Which Is located on the state highway system or which is demonshted to relieve congestion on
the state highway system. The county must evaluate all municipal ckpplications. If a
municipality's proposed project is rejected by the county for funding or If the county's proposed
project adversely affects a munlclpallty within the county, the municipality may request mediation
to resolve any concerns of the municipa6ty and the county.

Name and address of applicant
A complete description of the project, with project location map, and detaRed description
of the purpose of the project for improving traffic flow and reducing traffic congestion on
the state highway system.
Identification of whether the-project is in the Department's Five Year Work Program and If
so, provide the work program Item number.
Certification from the chief fiscal officer of the county that sufficient matching funds are
available.

Details of which project phases are included in the request for matching funds, an
accounting of the current stage of project development and a schedule of future project
development. .

Ar1 accounting of expenditures to date for each project phase and a current cost estimate
for each project phase.
Certification that the project is consistent with the Ronda Transportation Plan, the
Comprehensive Plan of the Metropolitan Planning Organization where applicable and any
local government comprehensive plan.
If the project is not located on the state highway system, a justification report detailing
how the project wDI aDeviate the need for construction or improvements to the state
highway system by reducing traffic congestion, and Quantitatively estimate the improved
through traffic capacity and/or increased level of service afforded the affected state
highway.

Any other relevant information necessary to assure compliance with the eligibility
requirements and to meet the ranking criteria.
The letter of application shall be signed by the chief fiscal officer of each county making such
application.

Within 20 days of receipt of the application, the district shall review the application and notify the
applicant in writing of any apparent errors or omissions and request any additional information
which is needed to properly assess the applications. The applicant shall submit In writing the

applicant to timely submit the requested additional infonnation may affect the ranking of the
project.

Pro/ect Selection & Ranking
Projects to be included in this program are selected in order of rank from the. most recent District
rank-order listing to the extent that adequate funds are made available by appropriation. Projects
selected shan be made part of the Adopted Work Program end shall be adopted in accordance
with Section 339.135 (5) and (7), Florida Statutes.
It is the Intent that candidate projects be evaluated and ranked in a consistent manner through
the use of set criteria or analytical studies developed by the District' Each District may detennine
individual emphasis areas and assIgn a~ded weight to candidate projects which fit these areas.
Proiect Aareements
Subsequent to the district's selection of a project for inclusion in the County Incentiv,e Grant .
Program, a joint participation project agreement (JPA) must be executed. Districts shaR use the
standard boiler plate JPA developed by the Office of Comptroller for the County Incentive Grant
Program. Any deviations from this agreement must be approved by the Office of CoI:nPtroner.
(b)
Prior to executing the agreement the project must be authorized by resolution of the local
governing body and availability of project funding must be Cl~rtified by signature of the
chief fiscal officer of the county.
The agreement shall be executed by the District Seaetary for the district involved and the
executive head or chief administrative officer of the participating cOunty.
The agreement shaU specify the terms and conditions of state participation in the project

Fund Distribution
Funds provided for this program shall be distributed by the Department via statutory fonnula.
If the county has not execated the joint participation agreement within six months after selection
of the project. the district shall make the funds available for the next highest ranking project for
whiCh there are.adequate funds.
sChedule for County Incentive Grant ProQram
Note: FY 00101 and FY 01/02 projects will not follow this process as the program was just
implemented by the 2000 Legislative Session. The FYOO/01 and FY 01102 program will come
from the list of candidate projects requested for the. Counties by .September 30.

March March 1, District Secretaries send letter to counties asking for list of candidate
projects for 2nd year of the new Tentative Work Program (first request will be for
FY02J03).
March - April Counties have approximat~ly two months to pick candidate projects.
May By May 1, counties will send the list of candidate projects to the District contacts.

Each district shall review the applications, determine which projects meet the
efigibility requirements, and rank the eligible projects.
By July 15, each district shall provide copies of the rank order list and note the
