Connolly, Deputy Clerk Date: October 1, 1991 On September 18, 1991, the Board of County Commissioners adopted Resolution No. 333-1991 authorizing execution of an Agreement with the District School Board of Monroe County for the use of schools as hurricane shelters in exchange for ~he provision of hurricane shutters and emergency equipment. I am attaching hereto for your handling with the District School Board two certif~ed copies of the subject Resolution and three duplicate originals of the Interlocal Agreement, now executed and sealed on behalf of the County. It is my understanding that your office will follow through on this matter and obtain the remaining signatures. Please be sure one fully-executed copy is returned to the undersigned as quickly as possible. Attachments cc: County Attorney County Administrator Finance Director File INTERLOCAL AGREEMENT (Hurricane Protection at school buildings) THIS INTERLOCAL AGREEMENT made this 18th day of September, ~.. ... 1991, by and between the Board of County Commissioners of Monroe County ("County") and the District School Board of Monroe County ("School District/Board") to provide for hurricane protection. WHEREAS, the Monroe County Board of County Commissioners and the School Board have determined that it is in the best interest of the citizens and the students of the County to enter into this inter10cal agreement; and WHEREAS, both the County and the School Board have recognized that certain school buildings, if appropriately shuttered and equipped, could be used as shelters in the event of hurricane emergencies; and WHEREAS, the School Board is willing to provide these facilities for use as hurricane shelters if the County installs hurricane shutters and emergency equipment; and WHEREAS, the County wishes to provide for additional hurricane shelter facilities; NOW, THEREFORE, pursuant to the authority provided in Florida Statutes Section 163.01 (the Florida Interlocal Cooperation Act of 1969), Monroe County, a political subdivision of the State of Florida, and the District School Board of Monroe County, a political subdivision of the State of Florida, hereby covenant and agree as follows: 1. The County shall install at any school buildings, to be designated in writing by the Superintendent of Schools for Monroe County, or his designee, and the Director of the Monroe County Emergency Management Department, or his designee, permanent hurricane shutters and/or tracks and other hardware necessary for securing in place panelled or detachable hurricane shutters, and such other emergency equipment, including communication equipment and generators, necessary to comply with laws and regulations governing emergency shelters. tn the event of installation of hardware for the use of panelled or detachable shutters, the County shall also provide said panelled or detachable shutters. 2. The School District shall make available to the public for the use as shelters in the event of a hurricane emergency the same school buildings designated and equipped pursuant to this agreement, and shall provide maintenance personnel to secure shutters in place should a hurricane emergency occur. tn coordination with the County Emergency Management Director, an annual exercise will be conducted to install shutters and inspect all operational components of the shelter to ensure readiness. 3. This agreement is in addition to any other agreements between the School Board and the County for purposes of coordinating emergency management plans and shall not govern any other agreements. 4. No person or entity shall be entitled to rely upon the terms or any of them of this agreement to enforce or attempt to enforce any third party claim or entitlement to or benefit of any item contemplated hereunder. 5. Only the parties to this agreement, upon written mutual consent, shall be entitled to modify this agreement in order to carry out the intent and purpose of this agreement. 6. Termination shall be by written mutual consent upon a finding by the parties to this agreement that termination is in the best interest of both parties. 7. This agreement shall take effect when approved by the Chairman of the District School and attested to by the School District I s Superintendent, and when approved by the Board of County Commissioners and executed by the Mayor/Chairman and attested to by the County Clerk or his designee. A RESOLUTION OF THE BOARD OF COUNTY COMMIS- SIONERS OF MONROE COUNTY, FLORIDA, AUTHORIZING THE MAYOR TO SIGN ON BEHALF OF MONROE COUNTY AN INTERLOCAL AGREEMENT WITH THE DISTRICT SCHOOL BOARD OF MONROE COUNTY FOR THE USE OF SCHOOLS AS HURRICANE SHELTERS IN EXCHANGE FOR THE PROVISION OF HURRIqANE SHUTTERS AND EMERGENCY EQUIPMENT. ~ BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that the Mayor is hereby authorized to sign and execute on behalf of Monroe County an Interlocal Agreement, a copy of which is attached hereto and incorporated by reference, to allow the County to use school buildings for use as shelters in the event of a hurricane emergency, and for the County to provide same schools with hurricane shutters and , emergency equipment.
