ITEM BAC](GROUND: On 3/18/09 the HOCC approved a resolution calling for the U.S. Navy to cease and desist the flying of certain aircraft over developed commercial and residential prbp~rties and directed staff to coordinate a meeting betw'een the BOCC and the U. S. Navy to discuss the public outcry from citizens regarding the level of noise.. A meeting was scheduled and publicly noticed for March 31, 2009 but later cancelled when the U.S. Navy declined to meet without a conflict resolution facilitator present. This MOU provides not only for the facilitator to be present at the 5/12/09 BOCC Special Meeting with the U.S. Navy but also allowed the filcilitator to meet with County officials and staff and local interest groups prior to the Special Meeting. Revised 2/05 University of Central Florida LETTER OF AGREEMtNT This letter of agreement confirms that the Florida Institute of Government at the University of Central Florida will provide the services of the Florida ConOict Resolution Consortium (FCRC) as described below. Payment will be remitted to: University of Central Florida Florida Institute of Governnlent 36 W. The m.emorandum dated April 21, 2009, and its attached Scope of Work set the framework for the services to be provided by the Consortium. 2. The conflict resolution fucilitation services described in the Scope of Work shall be primarily, if not solely, provided by Rafael Montalvo (Facilitator), unless another principal provider is approved by the County Attorney in writing. 3. The County will coordinate meetings between the Facilitator and County officials and stafl: and will work with the Facilitator and local interest groups to arrange meetings from May 6 through 9,2009. 4. The County will provide arrangements for a fitcilitated meeting between the Navy and BOCC on May 12, 2009, from IPM to 5P~ at the Harvey Government Center at Historic Truman School, Key West, Florida. 5. The County will pay the Consortium one-half of the fees for the services set forth in the Scope ofWol'k, with the understanding that the Navy shall have a separate contract with the ConsoJtium for the remaining half of the fees, in accord$ce with the fees set forth in the Scope of Work, but not to exceed a total of$5tOOOt upon receipt from the Consortium ofa proper invoice, as provided by the Florida Local Government Pztompt Payment Act, F.S. 218.70, et. seq., with documentation to support expenses and service fees. The invoice shall be sent to the Monro4~ COWlty Administrator, 1100 Simonton Street, Key West, Fi. 33040. I ~.... 6. Due to the timing of the execution of this Memorandum, lit shall be signed by the County Attorm:y and ratified at the BOCC May 12th meeting by the Board of County Commissioners, which ratification shall not be unreasonably withheld. 7.
