At the May 12, 2009, Board of County Commissioner's meeting the Board granted
approval to ratify the signing of a Memorandum of Understanding Conflict Resolution
Facilitation, by the County Attorney, with the Florida Conflict Resolution Consortium for a
facilitator between the BOCC and the U.S. Navy concerning noise complaints related to aircraft
flying in and out of the Naval Air Station, Boca Chica.

LETTER OF AGREEMENT
This letter of agreement confrrms that the Florida Institute of Government at the University of Central Florida will
provide the services of the Florida Conflict Resolution Consortium (FCRC) as described below.

1. The memorandum dated April 21, 2009, and its attached Scope of Work set the framework for
the services to be provided by the Consortium.
2. The conflict resolution facilitation services described in the Scope of Work shall be primarily, if
not solely, provided by Rafael Montalvo (Facilitator), unless another principal provider is
approved by the County Attorney in writing.
3. The County will coordinate meetings between the Facilitator and County officials and staff: and
will work with the Facilitator and local interest groups to arrange meetings from May 6 through
9, 2009.
4. The County will provide arrangements for a facilitated meeting between the Navy and BOCC on
May 12,2009, from 1PM to 5PM, at the Harvey Government Center at Historic Truman
School, Key West, Florida.
5. The County will pay the Consortium one-half of the fees for the services set forth in the Scope
of Work, with the understanding that the Navy shall have a separate contract with the
Consortium for the remaining half of the fees, in accordance with the fees set forth in the Scope
of Work, but not to exceed a total of$5,000, upon receipt from the Consortium ofa proper
invoice, as provided by the Florida Local Government Prompt Payment Act, F.S. 218.70, et.
seq., with documentation to support expenses and service fees. The invoice shall be sent to the
Monroe County Administrator, 1100 Simonton Street, Key West, Fl. 33040.
6. Due to the timing of the execution of this Memorandum, it shall be signed by the County
Attorney and ratified at the BOCC May 12th meeting by the Board of County Commissioners,
which ratification shall not be unreasonably withheld.
7. The Letter of Agreement and the scope of work shall be effective as of May 5,2009.

Attached is a proposal that I think tracks our discussions of last week. I apologize for the
delay in getting this to you. There is flexibility in the approach, although as we
discussed, I think a degree of preparation is essential to having a productive meeting.

Scope of Work
For
Assessment and Facilitation Related to Issues between Monroe County
and Key West Naval Air Station (KWNAS)
Assessment Interviews
The Consortium will conduct preliminary interviews with County Commissioners and
staff, Naval Air Station civilian and military leadership, and community leaders
involved in the issue under consideration.
Assessment Report
The Consortium will prepare a summary report outlining conclusions from the
assessment interviews. The report will:
· Summarize (without attribution, unless attribution is requested by the person
interviewed) the views of those interviewed regarding issues that should be
addressed, prospects for resolution, and interest in participating in a process to
explore resolution.
· Process options that may be used to explore resolution, for the County and Key
West Naval Air Station to consider. These process options would be reviewed for
technical feasibility by Monroe County and KWNAS staff before the facilitated
meeting described below.
· Provide a basis for discussion at a joint meeting of the County Commission and
Naval Air Station leadership.
Meeting Facilitation
The Consortium will facilitate a joint meeting of the County Commission and Naval
Air Station leadership. The meeting will be designed to:
· Identify and exchange information that promotes a joint understanding of the
issues and their history.
· Explore process options for further efforts to move towards resolution.
· Allow interested members of the public to offer input for consideration by
Commission members and Naval Air Station leadership.
· Conclude whether to proceed with any of the process options or to take other next
steps.
Meeting Conclusions
The Consortium will provide a memo summarizing conclusions reached at the facilitated
meeting"
Costs
The contracting entity for Consortium services will by the Florida Institute of
Government at the University of Central Florida.
Costs are calculated at a rate of $1,500 per day for professional time, plus travel expenses
and university overhead of 10%.
Travel expenses will conform to State of Florida guidelines.

1 Cost of airfare assumes flights directly to Key West. Time permitting, costs may be
reduced by flying to Miami and traveling the remaining distance by car.
FCRC Project Staff
Rafael A. Montalvo is Associate Director at the Central Florida Office of the Florida
Conflict Resolution Consortium. In that capacity he has facilitated or mediated numerous
large and small scale processes to build consensus around controversial public policy
issues, as well as trained individuals who participate in public policy discussions or
consensus-building.
Current cases include a collaborative process to develop measures to address water
quality in coastal waters of southwest Florida, a county-wide collaboration involving
seventeen local governments in developing and adopting ordinances and programs to
implement smart growth, and a statewide effort to develop a Florida Seaports Plan.
Before joining the Consortium in 1991, he was an urban planner working with local
governments and non-profits in Florida. He has a Masters in Urban and Regional
Planning from Florida State University, and a Bachelor of Arts from Rollins College.

Conflict Resolution Consortium helps to build consensus and resolve disputes about
policy issues (F.S. 1004.59). The FCRC staff have extensive facilitation experience on a
broad range of public policy issues.
