An act relating to the Areas of Critical State Concern Wastewater & Stormwater
Assistance Program; amending Section 212.055, F.S. adding subsection (8) allowing a
county in an Area of Critical State Concern with requirements for advanced wastewater
treatment to levy a voter-approved surtax of one-cent for wastewater and stormwater,
requiring a voter referendum, providing requirements for the ordinance imposing the
surtax, providing purposes for which the proceeds of the surtax way be used; providing
for the investment of proceeds collected from the surtax,p~(jviding for the automatic
expiration of such a surtax unless it is approved by a s4~~eqn~l~referendum; amending
Section 215.619illCh}, F,S'.1...amendiflg sl:lbseetioll n~<pJproviding,Junding obligation

Be It Enacted by the Legislature of the State of Florida:
Section 1.
Subli~tion.~8) of section 212.054, Florida Statutes, is added to
read:
(a) A county designated as an area of critical state concern and which has had
ll!l12osed by law the __JL~ilill~!IL~W!l19s!!::.~t?,,__,Jisted .J29Jow may levy a
discretionary sales surtax of 1 percent pursuant to an ordinance that is enacted by a
majority of the members of the county governing authority and is conditioned to take
effect onlv upon approval bv a majority vote of the electors of the county voting in a
referendum.

(b) The referendum to be placed on the ballot must include a statement that
provides a brief and general description of the purposes for which the proceeds of the
surtax may be used. The statement must conform to the requirements of s. 101.161 and
shall be placed on the ballot by the governing body of the county. The following
question shall be placed on the ballot:

reconstruct (j)l;.renovate wastewater and storm water collection and treatment
infrastructure: ana/to finance. olan. construct. upgrade. reconstruct or renovate.
wastewater and storfi'water collection and treatment infrastructure: fixed capital costs
associated with the construction. ul'grade. reconstruction. renovation. expansion or
improvement of wastewater and storm water facilities which has a useful life expectancy
of a least 5 years: land acquisition. land improvement. design. and engineering costs
related thereto. The proceeds of the surtax must be set aside and invested as permitted by
law. with the principal and income to be used for the purposes provided in this
subsection. Counties and municipalities receiving proceeds under the provisions of this

subsection may pledge such proceeds for the purpose of servicing new bond or state
revolving loan indebtedness incurred -pursuant to law. Counties and municipalities may
use the services of the Division of Bond Finance of the State Board of Administration
pursuant to the State Bond Act to issue any bonds through the provisions of this
subsection. Counties and municipalities may loin together for the issuance of bonds
authorized by this subsection.
(e) A surtax imposed under this subsection expires 20~ears after the effective
date of the surtax unless reenacted by an ordinance that!~:subiect to approval by a
dum.
(t) This subsection shall be liberally construed to achievi:its purpose.
Section 2.
Subsection (1) (b) of Settt~,/215.6f~,Florida Statut~sis amended
to read:
(b) The Legislature author~~s an additionali~9unt of bonds totaling $200
million to be appropriated in an amountnottg~:((ceed $50m;~lli{)h per fiscal year fef-fle
more than ~ fiseal years..~~t.:.l the total d~~~~~milli~~~(ls/been bonded. appropriated.
and distributed for watermallagement proiects. specifically for the purpose of funding the
Florida Keys Area~~~ritical S.~~ Concern ptgtection program.
Sectionl.
Section}.~(4) of Ch:<99-395, Laws of Florida, shall be amended to
read:
(4~ Unless theiaeadlineis extended by administrative rule as set forth in
paragraph (a~~~l~~' B ~1~ting sewage facilities that discharge to other than surface
waters and existing~J;lsi!~sewage treatment and disposal systems shall cease discharge or
comply with the applicable treatment requirements of subsection (6) by July 1, ~2.QJJ,
and with the rules of the Department of Environmental Protection or the Department of
Health, as applicable
(a) Any local governmental entity in the Florida Keys Area of Critical State
Concern having authority to own and/or construct wastewater collection and treatment
facilities and which is set forth in paragraph (c) below. may petition the Administration

Commission for an extension of the July 1. ~2J2JJ. deadline set forth above. or any
extension granted pursuant to this paragraph.
(D The Administration Commission shall consider factors such as. but not
limited to. progress achieved on the same or other wastewater projects. funding provided
for the same or other projects (including projects of other entities and transfer of property
to be used for wastewater facilities to other entities at no cost or at less than the cost of
acquisition by the donor entity). funding provided by the entity. and grants from other
sources. hurricane related delays. household incomes in the s~p"ice area which render any
ro osed s ecial assessment resultin from the lack of sU9si tion monies as financial
hardships under federal standards. and other circum~ta.nces not witinitl the control of the
local governmental entity. to reach a determination to extend by adrriilistrative rule the
deadline for compliance with the applicable trealllent reqUIrements of subsectiOn (6).
