Resolution 587-2002 County Attorney RESOLUTION NO. 587 - 2002 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, REVISING RESOLUTION NO. 025-2002, IN ORDER TO CORRECT A SCRIVENER'S ERROR IN THE LEGAL DESCRIPTION OF ABANDONED PORTIONS OF LOTS 7 AND 8, MORRIS AVENUE, CROSS KEY, KEY LARGO, MONROE COUNTY, FLORIDA WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires to renounce and disclaim any right of the County and the public in and to the hereinafter described streets, alley-ways, roads or highways, and WHEREAS, due notice has been published and a public hearing has been held in accordance with Chapter 336, Florida Statutes, and WHEREAS, at said public hearing the Board considered the argument of all parties present wishing to speak on the matter, and all premises considered concerning the renouncing and disclaiming of any right of the County and the public in and to the hereinafter described streets, alley-ways, roads or highways as delineated on the hereinafter described map or plat, and WHEREAS, the Board has determined that vacation of the said road is for the general public welfare, and conforms to the requirement of Florida Statutes Secs. 336.09 and 336.10, and WHEREAS, Resolution No. 114-2001 was executed before the engineers corrected the metes and bounds legal description to conform to the survey drawing before the BOCC at said hearing, requiring a new resolution; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that the Board hereby renounces and disclaims any right of the County and the publiC in and to the following described streets, alley-ways, roads or highways as delineated on the hereinafter described map or plat, to-wit: That portion of Morris Avenue as shown on the plat of "Monroe Park", as recorded in plat book 3 at page 140 of the publiC records of Monroe County, Florida, and being more particularly described as follows: Commence at the most Northeasterly comer of Tract B, being the Northwesterly corner of Lot 25 as shown on said plat of "Monroe Park", and being the POINT OF BEGINNING of the following described parcel; thence N22034'22"E for 17.78 feet to a point on a non-tangent circular curve concave Southwesterly and having as its elements a radius of 250.00 feet and a central angle of 27040'38", a radial line at said point bears S22034'22"W; thence along the arc of said curve for 120.76 feet to the point of tangency; thence S39045'00"E parallel with the Northerly line of said Lot 25 for 158.18 feet to the point of curvature of a circular curve concave Southwesterly and having as its elements a radius of 25.00 feet and a central angle of 39045 '00"; thence Southeasterly along the arc of said curve for an arc length of 17.34 feet to the point of tangency, being the extended Westerly right of way line of Hazel Street; thence SOooOO'OO"W for 30.17 feet to the intersection of said Westerly right-of-way line with the Northeasterly line of Lot 25; thence N39045'OO"W along the Northeasterly line of said Lot 25 for 264.62 feet to the point of curvature of a circular curve concave Southwesterly and having as its elements a radius of 50.00 feet and a central angle of 42000'00"; thence Westerly along the arc of said curve for an arc length of 36.65 feet to the point of tangency; thence N81 045'OO"W for 9.62 feet to the POINT OF BEGINNING.
