AGENDA ITEM WORDING:
A closed executive session of the Board of County Commissioners in the matter of the consolidated
case of The Tower Group v. Monroe County, et at, Case Number 2007-CA-1428-K, and Monroe
County v. Gonzalez Architects, et ai, Case Number 2008-CA-458-K.
ITEM BACKGROUND:
The initial law suit was filed by The Tower Group (TTG) against Monroe County; and subsequently
the County filed suit against Gonzales Architects, et aI. The cases have been consolidated in the Circuit
Court. Legal staff desires direction from the Board on the case regarding settlement of the claim by
TTG against the County and related issues. Per F.S. 286.011(8), the subject matter ofthe meeting shall
be confined to settlement negotiations or strategy sessions related to litigation expenditures.
Present at the meeting will be the Connnissioners, County Administrator Roman Gastesi, County
Attorney Suzanne Hutton, Chief Assistant County Attorney Bob Shillinger, Assistant County Attorney
Natileene Cassel, and the County's special litigation counsel Mark Miller, Esq., and Ed Scales, Esq.,
and a certified court reporter.
