RESOLUTION NO. 134 -2000
A RESOLUTION RELEASING A RESTRICTIVE COVENANT RUNNING IN FAVOR OF MONROE
COUNTY ON LOT 88, BLOCK 19, BREEZESWEPT BEACH ESTATES, MONROE COUNTY, FLORIDA
WHEREAS, a Quit Claim Deed executed for Lots 88 and 89, Block 19, Breezeswept Beach
Estates by theMonroe County Board of County Commissioners to Delbert W. Livermore
and Thelma M. Livermore, husband and wife, dated February 7, 1978, and recorded at
OR 753, Page 1541, contains the following Deed Restriction running in favor of Monroe
County:
SUBJECT to the following Deed Restriction which shall be a covenant
running with the land, to wit: That so long as the only structure
situated on Lot 88 is an accessory structure, said Lot 88 shall never
be sold, assigned, leased or conveyed separate and apart from Lot 89.
The grantor herein aqrees to release said Deed Restriction at such time
as a primary habitable structure be build upon Lot 88.
WHEREAS, the original purpose giving rise to the Deed Restriction is no longer a concern;
now, therefore,
BE IT RESOLVED by the Board of County Commissioners of Monroe County, Florida:
Section 1. Subject to the condition that the property owner obtain a demolition permit
to remove the accessory building and subject to final inspection as to its removal by
Growth Management Division Staff, the Board of County Commissioners of Monroe
County, Florida, (the Board) hereby forever releases and cancels the Deed Restriction
running with land for Lot 88, Block 19, Breezeswept Beach Estates, Plat Book 4, Page 143;
Lot 88 being made subject to the Deed Restriction in a Quit Claim Deed from the Board
to Delbert W. Livermore and Thelma M. Livermore, husband and wife, dated February 7,
1978 and recorded at OR 752, Page 1541. A copy of the February 7, 1978 Quit Claim
Deed is attached to this Resolution and made a part of it.
PASSED AND ADOPTED by the Board of County Commis,sipners of Monroe County,
Florida, at a regular meeting of said Board held on the ~ day of March, 2000.
