COMMISSIONERS OF MONROE COUNTY,
FLORIDA, IN SUPPORT OF NAMING THE
FLORIDA DEPARTMENT OF TRANSPORTATION
NORTH BUSINESS ACCESS ROAD LOCATED OFF
OF JEWFISH CREEK BRIDGE AS "GILBERT'S
RESORT DRIVE"
WHEREAS, due to the recent construction and improvements to the Jewfish Creek
Bridge in Key Largo, access to several businesses including Gilbert's Resort has been effected;
and
WHEREAS, the north business access road that now leads to Gilbert's Resort (Parcel
ID: 00083770-000000/Alt. Key 1092410) is a Florida Department of Transportation access road;
and

WHEREAS, the owners of Gilbert's Resort have requested the Florida Department of
Transportation to rename the north business access road as "Gilbert's Resort Drive" to allow for
easier accessibility by customers; and
WHEREAS, the naming is contingent upon the approval of a resolution by the Monroe
County Board of County Commissioners in support of pursuant to 334.071, Florida Statutes; and
WHEREAS, the naming will be given consideration and final approval by the Florida
Department of Transportation;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, THAT:
1. The Board of County Commissioners of Monroe County, Florida supports the
naming of the Florida Department of Transportation business access road as
"Gilbert's Resort Drive" as requested or named as deemed appropriate by the
Florida Department of Transportation.
2. The Clerk is authorized to send letters and copies of the executed resolution to
Rep. Ron Saunders, District 120 and the Florida Department of Transportation
in order to proceed with the naming process by the Florida Department of
Transportation.

COMMISSIONERS OF MONROE COUNTY, FLORIDA, IN
SUPPORT OF THE POSITION OF THE BONEFISH & TARPON
TRUST REQUESTING THE FLORIDA FISH & WILDLIFE
COMMISSION INSITITUTE A CATCH AND RELEASE SEASON
FOR PERMIT; EXTEND THE CATCH AND RELEASE
REGULATIONS FOR BONEFISH TO THE END OF THE 2010
CALENDAR YEAR (INSTEAD OF MARCH I, 2010); AND
CONVENE A PANEL OF SCIENTISTS TO PROVIDE A STRONG
DEFINITION OF CATCH AND RELEASE APPROPRIATE FOR
BONEFISH, TARPON, PERMIT AND OTHER GAMEFISH.
WHEREAS, the Momoe County Board of County Commissioners (HOCC) joins the
Bonefish & Tarpon Trust (BIT) in commending the Florida Fish and Wildlife Commission's
(FWC) response to the cold-induced mortality of some of Florida's most important sahwater
gam.efish; and
WHEREAS, the designation of catch and release for snook, tarpon and bonefish will
aUow FWC biologists to assess the true impacts of the mortality event and. if necessary, devise
appropriate management strategies; and
WHEREAS, the BIT proposes that FWC also institute a catch and release season for
Permit (Trachinotusfalca/us) during spawning season (April through June) due to the additional
fishing pressure redirected toward permit as a consequence of cold-induced mortality to other
species; and
WHEREAS, the BIT advises the timing of the permit spawning season is documented in
the FWC study published in 2002, and similar studies from Cuba and Belize, and by fish census
data :from the Dry Tortugas; and
WHEREAS, FWC already has spawning season closures for numerous fish species,
including snook, so a spawning season closure for permit is not unprecedented; and
WHEREAS, harvesting ftsh from spawning aggregations may cause significant
population declines, with the most notable regional examples being Nassau grouper and mutton
snapper; and
WHEREAS, BTT suggests that FWC convene a panel of outside scientists with
expertise in catch and release to provide a strong definition of catch and release appropriate for
bonefISh. tarpon, permit and other gamefish; now therefore,

WHEREAS, BTT further requests that FWC consider extending the catch and release
regulations for bonefish to the end of the 2010 calendar year (presently end on March 1, 20 I 0) to
provide relief to the stocks and additional time to detennine the extent to which the cold-induced
mortality impacted bone fish stocks in the Florida Keys; and.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, hereby express its support of:
Section 1. The position of the Bonefish & Tarpon Trust proposing that the
Florida Fish and Wildlife Commission:
a, Institute a catch and release season for Permit (Trachinotusfalcatus)
during spawning season (April through June).
b. Extend the catch and release regulations for bonefish to the end of
the 20 I 0 Calendar Year (instead of ending March I, 2010).
c. Convene a-panel of outside scientists with the expertise to provide a
strong definition of catch and release appropriate for bone fish,
tarpon, permit and other gamefish.
Section 2. The Clerk is hereby directed to send a certified copy of this
Resolution to Tom Davidson, Chairman, The Bonefish & Tarpon Trust, 24
Dockside Lane, PM:B 83, Key Largo, FL 33037 and Mr. Rodney Barreto,
Chainnan, Florida Fish and Wildlife Commission, 620 South Meridian Street,
Tallahassee, FL 32399-1600.

Bonefish & Tarpon Trust commends the Florida Fish and Wildlife Conservation Commission's
response to the cOld-induced mortality of some of Florida's most important saltwater gamefish.
The designation of catch and release for snook, tarpon, and boneflsh will allow FWC biologists
to assess the true impacts of the mortality event and, if necessary, to devise appropriate
management strategies.
We applaud FWC's response to the cold-induced mortality, which reflects your commitment to
fisheries conservation and management. In this light, Bonefish & Tarpon Trust proposes that
FWC consider instituting a catch and release season for Pennit (Trachinottls falcatus) during
spavming season (April through June) as it is likely that as a consequence of cold -induced
mortality to other species additional fishing pressure will be redirected toward pennit during
their period of greatest vulnerability. The timing of this spawning season is documented by an
FWC study published in 2002, similar studies from Cuba and Belize, and by fish census data
from the Dry Tortugas. FWC already has spawning season closures for numerous fish species,
including snook, so a spavming season closure is not unprecedented.
BTT suggests this precautionary approach because harvesting fish from spawning aggregations
may cause significant population declines. The FWC study from 2002 stated that the pennit
population could decline quickly in response to moderate levels of fishing pressure, The most
notable regional examples of population declines resulting from harvesting from spawning
aggregations are Nassau grouper and mutton snapper. In locations where these species' spawning
aggregations were targeted for harvest, populations declined to such an extent that they are now
considered 'fisheries extinct' - Given the difficulty in restoring fish populations that have
declined, and the potential hann of harvesting from spawning aggregations, BTT requests that
FWC considers catch and release regulations during spawning season.
To underscore the commitment to fisheries conservation and management, BTT further requests
that FWC consider extending the catch and release regulations for bonefish to the end of the
2010 calendar year. Presently, the catch and release regulations for bonefish end on March 1.
2010. It is BTT's belief that more time is needed to detennine the extent to which the cold.

Finally, given the confusion over the definition and interpretation of 'catch and release', BIT
suggests that during 20 10, FWC convenes a panel of outside scientists with expertise in catch
and release. This would provide a strong definition of catch and release that would be
appropriate for bonefish, tarpon, permit and other gamefish.

standing, or stopping, of vehicles along County right-of-way on both the north and south side of
Sunrise Drive, North Sunrise Drive, and Ocean View Drive in Tavernier, from Tarpon Street to

ITEM BACKGROUND: An affected property owner has come forward who did not know
about this action prior to seeing the No Parking signs go up. He now cannot park in front of his
house that fronts North Sunrise Drive.

The Board discussed closing a portion of Mariposa Road, Ramrod Key, from Shamlahan
Road to Old State Road 4A. After discussion, motion was made by Commissioner DiGennaro
and seconded by Commissioner Neugent granting approval of the item. Motion carried
unanimously.

The Board discussed a Resolution prohibiting the parking, standing or stopping of
vehicles along the County light of way on both the north and the south side of Suruise Drive,
North Sunrise Drive and Ocean View Drive in Tavernier, from Tarpon Street to the Atlantic
Ocean, After discussion, motion was made by DiGennaro and seconded by Commissioner
Neugent granting approval of the item. Motion carried unanimously.

The Board discussed advertising a Request for Proposals for the Pigeon Key Ferry
Service to provide service from July 20 10 through June 2013, The Florida Department of
Transportation (FDOT) has provided additional funding of$750,000 for service for three
additional years. Judith S. Clarke, Director of Engineeling Services discussed the matter. After
discussion, motion was made by Commissioner DiGennaro and seconded by Commissioner
Wigington granting approval to advertise a Request for Proposals for the Pigeon Key Ferry
Service with DOT providing additional funding for one (1) year in the amount of$250,000.00
for from July, 2010 through July, 2011. Motion carried unanimously.
TOURIST DEVELOPMENT COUNCIL
The Clerk armounced a vacant position on the Tourist Development Council District I
Advisory Committee for an "At Large" appointment.
The Board discussed the appointment of one "At Large" member to the Tourist
Development Council District V Advisory Committee. Motion was made by Mayor Murphy and
seconded by Commissioner DiGennaro appointing Ms. Deborah J. McAfee. Motion carried
unanimously.
ST AFF REPORTS
Growth Management - Christine Hurley, Growth Management Director reported to the
Board on the following matters: The first meeting of the Tier Designation Review Committee is
scheduled to be held on Tuesday, February 23,2010 at the Marathon Government Center starting
at 2:00 P.M.; The public meeting dates for public input on the Evaluation and Appraisal repol1
regarding the Comprehensive Plan are scheduled to begin at 6:00 P.M. on April 6, 2010 at the
Harvey Govermnent Center, April 7, 2010 at the Marathon Government Center, and ApIil 8,
2010 at the Murray Nelson Center - the county's consulting film Keith & Schnars will be
coordinating the meetings; Ms. Hurley also discussed the status of the Florida Fish and Wildlife
Conservation Commission Pilot Program for anchoring and mooring.
RESOLUTION NO. 060 -2010
A RESOLUTION BY THE MONROE COUNTY BOARD OF
COUNTY COMMISSIONERS PROHIBITING THE PARKING,
STANDING OR STOPPING OF VEHICLES ALONG THE
COUNTY RIGHT OF WAY ON BOTH THE NORTH AND
THE SOUTH SIDE OF SUNRISE DRIVE, NORTH SUNRISE
DRIVE AND OCEAN VIEW DRIVE FROM TARPON STREET TO
THE ATLANTIC OCEAN
WHEREAS, pursuant to Monroe County Code Sec. 25-27, the Board of
County Commissioners may restrict or prohibit the parking, standing or stopping of
vehicles along county roads; and
WHEREAS, Sunrise Drive, North Sunrise Drive and Ocean View Drive
are all county roads located in Tavernier; and
WHEREAS, Sunrise Drive, North Sunrise Drive and Ocean View Drive
from Tarpon Street to the Atlantic Ocean are narrow and become congested; and
WHEREAS, prohibiting vehicles from parking in the right of way would
increase accessibility of emergency vehicles on Sunrise Drive, North Sunrise Drive and
Ocean View Drive form Tarpon Street to the Atlantic ocean; and
WHEREAS, the designated no parking area would be posted with "No
Parking" signs as required by Sec. 25-27, Monroe County Code; and
WHEREAS, the designated area would include Sunrise Drive, North
Sunrise Drive and Ocean View Drive from Tarpon Street to the Atlantic Ocean,
NOW THEREFORE BE IT RESOLVED BY THE BOARD OF
COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA THAT:
1. The County right of way along both the north side and the south side
of Sunrise Drive, North Sunrise Drive and Ocean View Drive from
Tarpon Street to the Atlantic Ocean shall be designated as a no
parking, standing or stopping area.
2. The designated area shall be posted with the appropriate "No Parking"
signage as required by Monroe County Code Sec. 25-27

ITEM BACKGROUND:
The Census Bureau will be conducting their survey of Monroe County door-to-door rather than by
mail as it provides a more accurate accounting of Monroe County's seasonal residents and non-
traditional living styles (live-aboards). The 1990 mail-in response rate was 51%; the door-to-door
survey method is considered more accurate.
Data collected from the census directly affects future federal funding opportunities.
There will be 1000 census-takers working throughout Monroe County. The census will begin on
March 22,2010 and conclude within 6 weeks. Law enforcement should be fully aware of what is
going on to assuage any fears that residents may have and to distinguish the real census-takers from
imposters.

A RESOLUTION BY THE MONROE COUNTY BOARD OF
COUNTY COMMISSIONERS RESPECTFULLY OPPOSING
ANY DECISION BY THE FLORIDA LEGISLATURE TO CUT
STATE AID TO PUBLIC LIBRARIES; AND DIRECTING THE
CLERK TO FORWARD SAID RESOLUTION TO THE SENATE
PRESIDENT, HOUSE SP~AKER, AND THE MONROE COUNTY
LEGISLATIVE DELEGATION.
WHEREAS, Monroe County Public Library System's five community libraries and its
staff of thirty full time equivalent positions (FTE's) serve 40,000 registered users annually,
including 74,000 residents and more than 3.0 million visitors, and house a collection of 207,000
titles; and
WHEREAS, the May Hill Russell Public Library in Key West, founded in 1892, is
South Florida's oldest public library; and
WHEREAS, the five Monroe County libraries are more needed than ever in these tough
economic times to provide, among other things:
. over 8,000 PC and internet sessions per month to the public;
. PC training classes which supply basic and intermediate software training
for improved job skills; and
. a place to meet e-govemment needs, as the public uses the computers to
access financial aid, veteran's benefits, tax forms, health resources, and
many other social services; and
WHEREAS, the Library's service to visitors supports the local economy and increases
the community's appeal to new business and investments; and
WHEREAS, Monroe County's libraries are funded by a combination of local taxes,
Florida State Aid to Libraries grants, and federal Institute of Museum and Library Services
(lMLS) grants, including a "Train the Trainer" IMLS grant; and
WHEREAS, Monroe County libraries have already experienced severe funding cuts in
the past several fiscal years, forcing libraries to cut many services and positions and reduce hours
of operation; and
WHEREAS, in 2009, Monroe County libraries received approximately $61,000 in grants
from the Florida State Aid to Libraries program, down from over $200,000 in previous years;
and

WHEREAS, it has been brought to the County's attention that on Wednesday, March 10,

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY

Sedion 1. Monroe County respectfully requests that the Florida State legislature oppose
either a reduction in funding fur the State Aid to Public Libraries program or
discontinuation of funding for the program for the upcoming fiscal year; and
Section 2. The Clerk is hereby directed to forward copies of this resolution to Senate
President Jeff Atwater, House Speaker Larry Cretul, Representative Ron Saunders, and
Senator Larcenia Bullard.
