AGENDA ITEM WORDING: Approval of resolution limiting the amount of time staff can expend
on projects initiated by special interest (individual or group) without seeking approval from BOCC to
further expend resources of the County.
ITEM BACKGROUND: On March 17, 2010, during discussion on Key Largo Special District
matter, the BOCC directed that a policy be drawn up to limit the amount of time staff can expend on
items of special interest that haye not been considered by the BOCC. This resolution would require
that staff, after collectively spending 40 hours on an issue which has not already been indicated as a
matter of concern to the Board as a whole, seek approval from the BOCC before expending additional
efforts. There is a limited amount of staff with numerous tasks to perform, and when time is expended
on matters that are not one's regular duties or assignments on matters of interest to the BOee, other
items get delayed, overtime compensation may be incurred, or work has to shift to other staff members'
whose work, in turn, gets delayed. The BOeC should be the one to decide if an issue is of great
enough importance to the County to warrant the diversion of work in order to address the particular .
issue.

A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA,
PROVIDING DIRECTIONS TO STAFF REQUIRING
THAT CONTINUATION OF RESEARCH AND OTHER
ACTIONS FOR SPECIAL INTERESTS BE SUBJECT TO
BOCC APPROVAL AFTER 40 HOURS.
WHEREAS, from time to time, individuals and special interest groups will approach
individual commissioners with requests to institute new projects, programs, or regulations, or
to otherwise address issues of particular interest to those constituents; and
WHEREAS, the Board of County Commissioners (BOCC) often requires background
information and some indicia from staff as to the economic or legal feasibility of the proposed
project or program in order to give direction to staff; and
WHEREAS, indiyidual county commissioners occasionally request that staff do
research or preliminary work on the issues before bringing the matters before the BOCC; and
WHEREAS, staff may spend a very brief time or many hours in the research necessary
to bring sufficient information to the BOCC to either get direction for further work or to
consider approyal of the program, project, or regulation; and
WHEREAS, there has been considerable reduction of the County work-force over the
past several years, so that staff cannot readily shift work to others in order to free up some
employees' time for special projects; and
WHEREAS, expenditure of staff time on any particular matter diverts them from their
other duties and may, if the hours are excessive, considerably delay the finalization of other
work, or, if the staff is not exempt from the provision of overtime, require considerable
additional compensation to be paid; and
WHEREAS, it is deemed to be in the best interests of all taxpayers in Monroe County
that staffing resources not be unduly diverted to exploring special interests unless the BOCC
determines that the issues are important enough to warrant such resources to be expended;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Monroe County, Florida, that:
1. When any Commissioner requests information or research from a County employee or
contracted agent concerning a matter which has been requested by one or more persons or

entities other than another governmental agency and which has not been approved by the
BOCC, staff may, collectively, expend 40 hours of work time before requiring that the
BOCC consider whether the issue is important enough to warrant further staff efforts
before bringing the proposed matter to the BOCC for consideration of the substantive
Issues.
2. The BOCC may direct staff:
(a) to continue to work on the matter and bring it back for consideration on the
substantive issues, or approval of the project, program or regulation;
(b) to continue to work on the matter for no more than a set amount of time before
bringing it back for further consideration of additional work to complete;
(c) to terminate work on the matter; and/or
(d) to take such other action as the BOCC may require.
3. This Resolution shall become effective upon the date of its adoption.

Members.
ITEM BACKGROUND: On February 17, 2010, discussion was held by the BOCC on the issue of
revising the oaths of office for advisory board members in order to put them on notice that there are
restrictions to which they are subject re public meetings (sunshine), public records and ethical conduct.
The attached was revised to incorporate notice but not actually require that the oaths be expanded
beyond that which is required by statute. The form puts them on notice that they will be presumed to
have read the 2 pages of summarized restrictions. The summary is brief and basic, but at least places
them on notice that they may need additional legal counsel about particular sets of facts & the
applicability of the statutes.

The Florida Constitution, Article II, Section 5{b) requires that all county officers take an oath of
office, to fulfill their official duties, and to support the State and US constitutions.
The oath may be taken before a notary public. Monroe County has recently instituted a similar
practice for its employees, as required by statute. Please swear to the following oath, have

SUMMARY OF FLORIDA LAWS
APPLICABLE TO MEMBERS OF ADVISORY BOARDS
1. Public meetings
Florida Statutes, Section 286.011 requires that all meetings at which official acts
are taken shall be public meetings. A public meeting must be open and accessible to the
public and noticed so that the public is reasonably informed of the meeting. Formal
action further requires that there be a quorum of the members present. A quorum can
only be established by the members present at the meeting, although other members may
participate by phone or audio-visual communication (the latter being preferred) in the
event there are unusual circrunstances precluding the member's presence. In the eyent
that a quorum does not appear for a meeting, those present may continue only in
workshop mode for the sharing of information, and no formal action can be taken.
All yotes are on the record. In the event a paper ballot vote is executed, each
board member must sign the ballot and turn it into the secretary or keeper of the minutes
for retention of the public records.
The statute is often referred to as the Sunshine law, and has been interpreted by
the courts to prohibit board members from speaking to each other about a matter that may
reasonably come before them for a vote, except in the forum of the public meeting.
Minutes must be kept of the meetings. It is not required that the meetings be
recorded, although that is a preferred practice.
II. Public Records
Florida Statutes, Section 119.07 requires that anyone having custody of a public
record shall permit the record to be inspected and copied upon request, unless a
specific exemption from the public records law exists. Exemptions can be found in
F.S. 119.071, but for most advisory boards' purposes, it is highly unlikely that any
documents coming before you as a board or transmitted by or to you in the
performance of your duties will be exempt from the disclosure requirement. Please
contact your staff liaison or the County Attorney's Office if in doubt as to the
applicability of the law to a specific document.
III. Ethics
Florida Statutes, C. 112, Part III, sets forth a Code of Ethics for Public Officers
and Employees. Section 112.313, F.S. is the primary statute of concern. As public
officers, advisory board members are prohibited from:

A. Soliciting or accepting gifts based on any understanding that a vote or
official action would be influenced thereby;
B. Doing business with one's agency (may not sell or purchase goods,
services leased premises to/from an entity that is owned or primarily
owned by one's self or family members);
C. Accepting any kind of compensation that one knows or should reasonably
know) is given to influence a vote or official action;
D. Using or attempting to use one's official position or any property or
resource within one's trust to secure a special privilege or benefit for one's
self or others;
E. Having or holding any employment or contractual relationship with an
entity that is under the regulation of or doing business with one's agency;
F. Disclosing or using information not available to members of the general
public and gained by virtue of one's official position, for personal gain or
the personal gain of others.
Under Florida Statutes, Section 112.3143(3) county officers, which an
advisory board member is deemed to be, are prohibited from voting on
matters which would inure to his/her private gain/loss, the officer knows or
reasonably should know would inure to private gain/loss of any principal by
whom he/she is retained or to a relative or business associate.

In late 2006~ in confonnity with state statute, a directive was sent out for all public officers receiving
compensatio~ including advisory board members receiving travel reimbursements, and all County
employees to sign an oath or affirmation to uphold the State and federal constitutions. It has been
suggested that oaths for advisory board members should be expanded to mc1ude that they will comply
with ethics provisions in state statute or county ordinance. The advantage is that it would put advisory
board members on notice of requirements that they might not be ~e aware of. A1ternatively~ a policy
could be instituted that every advisory board member has to go to (an) ethics/sunshine c1ass( es), which
could be deyeloped by the County Attorney's Office.

ITEM BACKGROUND: On 4/21/10, the Board approved the Microsoft Enterprise Enrollment -
State and Local Amendment #CTX-OOO-cgodfrey-S-026, along with a corrected Enterprise Enrollment
(indirect), to provide a cost savings to Monroe County by way of a 2 month extension of the term at no
cost to the County, (Technical Services agenda item CI5). Pursuant to the Amendment, both
documents had to be executed by Monroe County and received by Microsoft prior to Apri130, 2010 or
become null and void. Following approval by the Board, it was discovered the 2-page Amendment had
been erroneously omitted from both the revised agenda back-up distributed electronically 4/19/10 and
the hard copy of the revised agenda backup distributed at the meeting on 4/21/10. The attached 2-page
Amendment is being presented for ratification by the Board to properly document the Clerk's official
records concerning the Board's approval and the Mayor's execution of this item.

This amendment is entered into between the customer and Microsoft affiliate signing, as of the effective
date identified below. All terms used but not defined will have the same meanings as in the Microsoft
Enterprise Enrollment identified above "the enrollment." The following terms and conditions amend the
terms and conditions of the enrollment identified above, but only with respect to the customer identified
below and only for purposes of this enrollment.
Amendment
Customer and Microsoft both wish to renew Customer's prior Microsoft Enterprise Enrollment by
submitting the enrollment amended hereby, and the renewal may be executed earlier than the timeline
required by the Microsoft Enterprise Agreement. Notwithstanding the date it is executed by the parties,
the effective date of this enrollment will be one day following the expiration of the prior enrollment. All
orders referenced below in this amendment shall become effective as of the renewal date.
Because Customer has agreed to execute and submit its renewal on or before the last day of
April 2010, a full 2 months prior to the renewal's effective date, then notwithstanding anything to the
contrary in the Microsoft Enterprise Enrollment, the term of the enrollment shall be 38 full calendar
months. It could be terminated earlier or renewed as provided in the Microsoft Enterprise Agreement.
Microsoft will advise Customer of the renewal options before it expires. A 36-month reference price of
the renewal order has been used for the renewal, notwithstanding the actual number of months the
term is extended hereby.
As a condition of the extended term and special reference price provided hereby, we must receive your
fully-executed copy of this amendment and the enrollment, along with the reseller's purchase order, no
later than April 30, 2010 or this amendment shall expire and become null and void.
Except for changes made by this amendment, all terms of this enrollment remain unchanged. By
signing below, the parties agree to be bound by the terms of this amendment.

I am forwarding the original of both documents (originally stamped by Nat Cassel on 4/19110), along with three (3)
distribution copies of each document, to you for execution by the Mayor and processing on to Bob Ward for his handling.
I have also copied Bob Ward on this email so he is aware of the County Attorney's determination and the status on this
item and can prepare to make the necessary arrangements, upon receipt of the originally executed documents from the
Clerk or coordinating directly with the Clerk for pickup, etc., to ensure receipt of the executed documents by Microsoft
before the April 30th deadline.
Bob - please note - the 4th paragraph of the Amendment states: "..we must receive your fully executed copy of this
amendment and the enrollment, along with the rase/ler's purchase order, no later than April 30, 2010 or this
amendment shall expire and become null and void." I do not see a resefler's purchase order in the agenda backup.

Term. This enrollment will expire 36 full calendar months from the effective date. It could be terminated
earlier or renewed as provided in the Microsoft Enterprise Agreement. We will advise you of your renewal
options before it expires.
Representations and warranties. By Signing this enrollment, the parties agree to be bound by the
terms of this enrollment, and you represent and warrant that: (i) you have read and understand the
Microsoft Business Agreement identified above (if any) and the Microsoft Enterprise Agreement, including
all documents it incorporates by reference and any amendments to those documents, and agree to be
bound by those terms; and (ii) you are either the entity that signed the Microsoft Enterprise Agreement or
its affiliate.
Non-exclusivity. This enrollment is non-exclusive. Nothing contained in it requires you to license, use or
promote Microsoft software or services exclusively. You may, if you choose, enter into agreements with
other parties to license, use or promote non-Microsoft software or services.

ITEM BACKGROUND: Monroe County BaCC is currently enrolled in the Microsoft Volume
Licensing Program with an ill of 7327] 88 under the State of Florida Contract # 255-001-01-1
with master agreement # 01E61767 and has a contract for a three year renewal with SRI
International Corp which was approved at the previous board meeting last month. By filing our
paperwork early with Microsoft, the County will receive 2 months additional time on our
contract at no charge. Missing from the previous month's package was a copy of this addendum
and a corrected Enterprise Enrollment (indirect), which is attached for substitution of a form
erroneous I y given to staff. Both are presented for approval.

Item Background
The County renewed its Microsoft Volume Licensing Enrollment with Microsoft at the
March 17, 2010 BOCC meeting. As part of that renewal, the BOCC agreed to present its
paperwork for renewal earlier than the June 30, 2010 deadline. In doing so, Microsoft
agreed to provide up to 3 additional months extension to the 36 month term of the
licensing agreement depending on when our agreement was submitted.
This amendment did not go up to the Board with the previous renewal contract as it was not
prepared in time for inclusion. As a result we must include this amendment with our papelwork
to receive the additional extension of time. We are in the process of negotiations with SHI and
Microsoft to grant us the full 3 months of extended time on the renewal. If they provide us with
a new amendment that includes a three month extension versus this two month extension, we
will substitute it for this agreement.
ill addition, Microsoft has advised that one of the documents previously approved was sent to
staff incorrectly. The corrected document known as Enterprise Enrollment (indirect) a 12 page
form dated June 2007 is also before the BOCC in order to complete the appropriate documents.

7. Enterprise product orders.
. Your reseller will provide you with your product 'pricing and order. Your prices and payment
terms for all products ordered will be determined by agreement between you and your reseller.
Your reseller will provide us with your order separately from this enrollment.
We will invoice your reseller in three equal annual installments for the enterprise products covered by

8. Additional Products
We will invoice your reseJler for each additional product covered by your initial order in three equal annual
installments. The first installment will be invoiced to your reseller upon our acceptance of this enrollment;
the remaining installments will be invoiced at the next two anniversaries of the enrollment effective date.
We will invoice your reseller for any new additional product not initially included in your enrollment in total
upon our acceptance of your order. We will invoice your reseller for additional products initially included in
your enrollment and covered by any true up order submitted during the initial term in total upon our
acceptance of your true up order.
9. Qualifying systems licenses,
All desktop operating system licenses provided under this program are upgrade Licenses. No full
operating system licenses are available under this program. Therefore, if you select the Windows
Desktop Operating System Upgrade & Software Assurance, all qualified desktops on which you will run
the Windows Desktop Operating System Upgrade must be licensed to run one of the qualifying operating
systems identified in the Product List at http://www.microsoft.comllicensinQ. Note that the list of operating
systems that qualify for the Windows Desktop Operating System Upgrade varies with the circumstances
of your order. That list is more extensive at the time of your initial order than it is for some subsequent
true ups and system refreshes during the term of your enrollment.
10, Renewal orders.
For any 36-month renewal, your renewal order will be invoiced to your reseller in three annual
installments. The first installment will be invoiced upon our acceptance of the renewal order; the
remaining installments will be invoiced at the next two anniversaries of the effective date of that renewal
term. For any 12-month renewal and for any true up orders, we will invoice your reseller in total upon our
acceptance of your order.

Your resellar wlllprovfde you with your product pricJng and order. Your prices and paymef1t
terms for all products ordered will be determined by aareement between you and your reseller.
Your roseller will provide us with your order separately from thJs enroUment.
We will Invoice your reseller in three equal annual Installments for the enterprise products covered by

Assurance, all qualified desktops on which you wlll run the Windows DeskI:op Operallng System Upgrade

AGENDA ITEM WORDING: Request Approval to advertise a public hearing for an ordinance
amending Monroe County Code Section, 2-148, definitions of lobbyist and principal.
ITEM BACKGROUND: At the April 21st, 2010 public hearing on an ordinance requiring
lobbyists to register with the County, discussion included that the ordinance would be very similar to
the statutory provision, and that there was an intent to make the representation by lobbyists transparent
to the public. Since passage of Ordinance No. 11-2010, numerous questions regarding applicability of
the ordinance have been raised by the public, predominantly from attorneys who regularly appear in
Code Enforcement proceedings and non-paid members of boards of directors for not-for-profit
agencies. Inasmuch as formal administrative and quasi-judicial proceedings require notices of agency
or appearance, rendering a paper trail which the public may access and making the representation
transparent, and since representation during such proceedings is not generally deemed to be lobbying, it
is intended to exclude those representations from the registry requirement. Further, the inclusion of
language about non-compensation in describing a person who represents no other person or entity, but
wishes to yoice a personal opinion at public meetings, seemed to muddy the initial sentence of the
definition of lobbyists such that non-paid members of boards of directors of not-for-profit
organizations indicated uncertainty as to the need for them to register. The amendment is intended to
clarify that such people should register if they are going to lobby for their respectiye organizations.
PREVIOUS RELEVANT BOCC ACTION: Enactment of Ordinances No. 10-1990, No. 20-1990,
and No. 22-2004, prohibiting current and former employees and officials from lobbying activities; and
Ordinance No. 11-2010, requiring registry by anyone lobbying Monroe County BOCC, commissioners,
staff, boards and councils thereof & their members.

WHEREAS, the Board of County Commissioners of Monroe County did pass on April 21,
2010, Ordinance No. 11-2010, requiring lobbyists to register with the County; and
WHEREAS, one of the reasons stated by the sponsoring commissioner during the public
hearing for the provisions was to be the same or very similar to the statutory provision; and
WHEREAS, also discussed at the public hearing was an intent to make the representation by
lobbyists transparent to the public; and
WHEREAS, Section 112.3215(1)(h), Florida Statutes, provides exclusions for judicial and
formal administrative proceedings in which there is a paper trail showing agency representation;
and
WHEREAS, numerous questions regarding applicability of the ordinance have been raised
by the public; and
WHEREAS, it is desired to clarify issues related to who is deemed to be a lobbyist subject
to the requirement to register;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA:
SECTION 1. Section 2-148, Monroe County Code, definition of Lobbying shall be amended to
read as follows:
Lobbyist means any person, partnership, corporation or other business entity that lobbies on
behalf of a principal. Lobbyist does not mean a county or other government official, employee,
or any other person affiliated with any government while acting in his or her official
capacity. Any person who only appears in his or her individual capacity for the purpose of se1f-
representation ':;ithout compensation or reimbusemcnt, or other personal benefit, to express
support of or opposition to any item, shall not be required to register as a lobbyist. "Lobbyist"
does not include someone representing a client in a quasi-judicial or formal administrative
proceeding and who is an attorney who has entered an appearance or non-attorneys who have
entered a similar notice of appearance in matters before an administrative board or quasi-judicial
proceeding. where the rules of such entity permits representation by a non-attorney. The
exclusion for attorneys and non-attorneys representing clients in quasi-judicial and formal

administrative proceedings encompasses discussions with the County's attorneys regarding the
matter.
SECTION 2. Section 2-148, Monroe County Code, definition of Principal shall be amended to
read as follows:
Principal means the person, partnership, joint venture, trust, association, corporation,
governmental entity or other entity, for-profit or non profit, which has contracted for, employed,
retained or otherwise engaged the services of a lobbyist:.
SECTION 3. SEVERABILITY. Should any provision of this Ordinance be declared by a
court of competent jurisdiction to be invalid, the same shall not affect the validity of this
Ordinance as whole, or any part thereof, other than the part declared to be invalid. If this
ordinance or any provision thereof shall be held to be inapplicable to any person, property or
circumstances, such holding shall not affect its applicability to any other person, property or
circumstances.
SECTION 4. CONFLICT WITH OTHER ORDINANCES. All ordinances or parts of
ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict.
SECTION 5. INCLUSION IN THE CODE OF ORDINANCES. The provisions of this
Ordinance shall be included and incorporated in the Code of Ordinances of the County of
Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to
conform to the uniform numbering system of the code.
SECTION 6. EFFECTIVE DATE. This Ordinance shall take effect upon filing with the
Department of State as provided in Section 125.66(2), Florida Statutes.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,

PLANNING COMMISSION AND OTHERS OF LOBBYING
ACTIVITIES; PROVIDING FOR SEVERABILITY; PROVIDING FOR
THE REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH;
PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY
CODE OF ORDINANCES; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the operation of an open and responsible government requires the full
opportunity of the people to seek redress of grievances and to express their opIDions on executive
and legislative actions; and
WHEREAS, it is important to the integrity of the governmental process that the citizens be
informed of, or have accessible information regarding, efforts to influence legislative and
executive actions; and
WHEREAS, public disclosure of the persons and entities represented by those who seek to
influence governmental action is essential to citizens' confidence in the integrity of their local
government; and
WHEREAS, persons who appear before the Board of County Commissioners, Planning
Commission, Contractors Examining Board and many of the advisory boards to the Board of
County Commissioners may, from time to time, omit to disclose in identifYing themselves to the
public body that they represent interests other than their own'person interests; and
WHEREAS, there is an intent to require registry of every person who attempts to influence
legislative and administrative decision-making of governmental entities for the benefit of a person
or entity other than themselves in order to more fully inform the citizens as to the persons or
entities for whom the benefits are being sought;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA:
SECTION 1. Section 2-148, Monroe County Code, shall be amended by adding the following
definitions:
Board means the Monroe County Board of County Commissioners.
Compensation means a payment, distribution, loan, advance, reimbursement, deposit, salary, fee,
retainer, or anything of value provided or owed to a lobbying firm, directly or indirectly, by a
principal for any lobbying activity.

County means Monroe County, Florida.
County chairman and County mayor are interchangeable tenns which mean the Chairman of the
Monroe County Board of County Commissioners.
County office means any governmental office staffed by employees under the authority of the
Board of County Commissioners.
Development permit means the same as this term is defined in F.S. 9 163.3164.
Expenditure means the same as this term is defined in F .S. ~ 112.3215.
Lobbyist means any person, partnership, corporation or other business entity that lobbies on
behalf of a principal. Lobbyist does not mean a County or other government official employee or
any other person affiliated with any government while acting in his or her official capacity. Any
person who only appears in his or her individual capacity for the purpose of self-representation
without compensation or reimbursement, or other personal benefit, to express support of or
opposition to any item, shall not be required to register as a lobbyist.
Planning Commission means the local planning agency, as further described in the land
development regulations of the Monroe County Code.
Principal means the person, partnership, joint venture, trust, association, corporation,
governmental entity or other entity which has contracted for, employ~ retained or otherwise
engaged the services of a lobbyist.
SECTION 2. Section 2-148, Monroe County Code, definition of Lobbying shall be amended to
read as follows:
Lobbying means seeking, on behalf of another person or entity, to influence the Board,
Contractors Examining Board, Planning Commission or any advisory body with respect to a
decision in the area of policy or procurement or an attempt to obtain the goodwill of a County
official or employee.
"Lobbies" also means influencing or attempting to influence, on behalf of another, the Board's
action or non-action through oral or written communication or an attempt to obtain the goodwill
of a member or employee of the Board.. of County Commissioners or any board or council under
their authority.

SECTION 3. Registration of Lobbyists. Section 2-154, Monroe County Code, shall be
created to read as follows:
2-154. Registration and Re-registration of Lobbyists.
a) All lobbyists shall register and re-register with the County Administrator's Office at
the times specified in this article and on the forms prescribed from time to time by the County
Administrator.
(b) The forms prescribed for the registration and re-registration of lobbyists shall require,
at a minimUlIl, the following information and State under oath:
(1) The lobbyist's name and business address;
(2) The name and business address of each principal represented;
(3) The specific areas ofthe principal's govermnental interest;
(4) Where the principal is a corporation or association, the name of the chief
executive officer of the corporation or association;
(5) Where the principal is a general partnership or joint venture, the names of all
partners;
(6) Where the principal is a limited partnership, the name of the general partner or
partners;
(7) Where the principal is a trust, the names of all trustees and beneficiaries;
(8) Where the principal is a partnership, joint venture, corporatioI4 association,
trust or nongovernmental entity other than a natural perSOI4 the names of all
natural persons holding, directly or indirectly, a five (5) percent or more
ownership interest in the entity; and
(9) Disclosure of any business, professional or fumilial relationship that the
lobbyist or any employee of the lobbyist may have with any county officer or
county employee.
(c) The County Administrator or his designee shaU post the Registry to the County
website on a quarterly basis reflecting registrations which have been filed in accordance with this
ordinance.
(d) All lobbyists shall register with the County Administrator or his designee within five
(5) business days of being retained as a lobbyist, before engaging in any lobbying activities,
whichever shall come first, and re-register prior to January first of each year. Lobbying prior to
registration is prohibited. Each lobbyist who ceases lobbying for a particular principal shall file a
written notice of withdrawal.
(e) County employees shall be diligent to ascertain whether persons required to register
pursuant to this section have complied. Employees of a County office many not knowingly permit
a person who is not registered pursuant to this section to lobby the employees of that office.

(1) Upon discovery of violations of this section. any person may file a sworn complaint
with the County Administrator.
(g) Investigation of violations; penalties; validity of actions.
(1) The County Attorney or County Administrator, or their designee, shall be
informed by any County employee or officer who knows of any person
engaged in lobbying activities who has failed to comply with the registration
reporting requirements of this article and, in each such instance, shall conduct
such investigation as he or she shall deem necessary under the circumstances.
The resuhs of each investigation shall be reported to the Board.
(2) After determination of a first violation of registration requirements, the Board
may warn, reprimand or censure the violator or may suspend or prohibit the
violator :from appearing on behalf of any principal before the Board or any
County advisory body or from otherwise lobbying for any principal in any
fashion for a period of time; provided, however, that any suspension or
prolnbition may not exceed a period of two (2) years, and no sanction shall be
imposed unless the lobbyist allegedly in violation has been afforded reasonable
notice and an opportunity to be heard. After determination of a subsequent
violation. the Board shall suspend or prolubit the violator from appearing on
behalf of any principal before the Board or any County advisory body or from
otherwise lobbying for any principal in any fashion for a period of time;
provided, however, that any suspension or prohibition may not exceed a period
of two (2) years, and no sanction shall be imposed unless the lobbyist allegedly
in violation has been afforded reasonable notice and an opportunity to be
heard. The penalties provided in this subsection shall be the exclusive penalties
imposed for violations of the registration requirements of this article. The
failure or refusal of any lobbyist to comply with any order of the Board
suspending or prohibiting the lobbyist from lobbying shall be punishable as
provided by law and shall otherwise be subject to such civil remedies as the
County may pursue, including injunctive relief.
(3) The Board of County Commissioners may void any action or contract entered
into in connection with a procurement matter where the County chairman, one
or more County commissioners, or a member of the pertinent procurement
committee has been lobbied in violation of the registration reporting
requirements.
(h) This section shall sunset on November 30, 2010.

ITEM BACKGROUND: The County filed suit in U.S. District Court against internet travel service
providers to collect the full amount of tourist deyelopment tax on rooms booked through their services.
The Court has certified the case as a class action so Monroe County is the class representative of all
Florida counties which have adopted tourist development taxes but which have not opted out of the
plaintiff. Mediation is scheduled to be conducted prior to June 16th BOCC meeting so a closed session
is needed to discuss any settlement proposal that by result from mediation. Per F. S. 286.011(8), the
subject matter of the meeting shall be confined to settlement negotiations or strategy sessions related to
litigation expenditures.
Present at the meeting will be the Commissioners, County Administrator Roman Gastesi, County
Attorney Suzanne Hutton, Chief Assistant County Attorney Bob Shillinger, special litigation counsel Jay
Shapiro and Tod Aronovitz as well as a certified Court Reporter.

ITEM BACKGROUND: By statute, the Mayor is designated as a member of the Canvassing Board.
If she is not able to serve, the BOCC ~~shall appoint as a substitute member one of its members who is
not a candidate with opposition in the election being canvassed and who is not an active participant in
the campaign or candidacy of any candidate with opposition in the election being canvassed." F.S.
102.141(1)(c). Because the canvassing board is scheduled to meet more than a dozen times in Key
West, Mayor Murphy has determined that it would be an imprudent use of County travel dollars for her
to serve. If no commissioner is able to serve on the Canvassing Board, the Chief Judge shall appoint a
substitute member.
