AGENDA ITEM WORDING: Discussion of bid proposals from Stand Up for Animals, Inc. (SUFA) to operate
Big Pine and Marathon Animal Control.
ITEM BACKGROUND: Per attached Bid Re -Cap, sealed bids were opened on April 28, 2010, and SUFA was
the lone bidder at $327,880 per year to operate the Big Pine and Marathon Animal Control facilities and provide
animal control and enforcement services from MM 16.7 to MM 69 utilizing two (2) County -owned vehicles;
this bid is $64,400 (or 24.4%) over current contract costs.
Three alternate bids were also requested, and SUFA bid $332,880 utilizing only one County -owned vehicle
instead of two; and should Keys Energy not renew the Big Pine Shelter Lease, SUFA proposed $307,880 using
two County vehicles, or $312,880 using only one County vehicle, to cover the same service area but without the
Big Pine facility.
After discussions with SUFA representatives, SUFA proposed $287,000 to operate the Marathon Shelter only,
and only provide services from the 7 Mile Bridge to MM 70; this proposal is $23,523.44 over current contract,
and leaves no coverage from MM 16.7 to MM 40. Alternatively, SUFA proposed $290,000 to cover the current
territory, for a one- to two-year term, closing the Big Pine Shelter, and be able to retain all County fees charge to
animal owners/adopters. These fees are revenue to the County and equal approximately $11,000 per year for the
Big Pine/Marathon service area; this proposal would cost the County approximately $301,000 which is $26,523
over current contract.
PREVIOUS RELEVANT BOCC ACTION: On May 18, 2005, the Board approved the original contract; on
June 15, 2005, the Board approved an amendment adding annual CPI adjustment and changing the contract term
to three years with two (2) one-year renewal options; on May 16, 2007, the Board approved a second CPI
adjustment, and on June 18, 2008, and May 20, 2009, the Board approved the first and final one-year renewal
terms.

MONROE COUNTY REQUIREMENTS FOR ANIMAL CONTROL ON BIG PINE KEY
In response to several inquiries regarding the County's obligations to have an animal control shelter on Big
Pine Key I have reviewed the Comprehensive Plan, the Big Pine Key/No Name Key Livable CommuniKeys
Master Plan, the Habitat Conservation Plan and the Incidental Take Permit for the Key Deer. I have included
the language from the relevant policies from the planning documents and the conditions from the HCP and
ITP below. Continued research was not successful in locating any additional documentation regarding a
requirement for the establishment or continued operation of an animal control shelter on Big Pine Key.
Staff believes that the intent of the Comp Plan Policy, especially Policy 207.7.8, is to enforce animal control
laws. The removal of feral and free roaming cats and dogs from Big Pine Key and No Name Key is essential
for the survival of endangered species within the National Key Deer Refuge (which extends from Bahia
Honda to Sugarloaf Key), particularly the Lower Keys Marsh Rabbit and the Key Deer.
It is apparent that some organizations interpret Policy 207.7.8 to require a shelter on Big Pine because the
Policy language indicates that the County will adequately staff a shelter. While this interpretation has been
put forth by others, staff s interpretation of the Policy is more directly related to the overall Goal 207- the
protection and conservation of existing wildlife and wildlife habitats, and Objective 207.7 — the
implementation of activities to prohibit the destruction of the Key Deer and to protect its habitat. Thus, staffs
interpretation of 207.7.8 is specific to the need to eliminate threats to the endangered species within the
Refuge through the removal of feral cats and free roaming dogs.
Monroe County Environmental Resources staff has discussed the County's obligations regarding free roaming
pets on Big Pine and No Name Keys with the U.S. Fish and Wildlife Service (FWS) at each of our annual
reviews of the HCP monitoring report. The FWS staff that has oversight of the ITP, which is not the same
staff as the Key Deer National Wildlife Refuge staff, has indicated in these annual meetings that Monroe
County has met the requirements of the HCP/ITP regarding animal control and has not stated that a sh
elter on
Big Pine is required. Again, these documents only included an educational requirement, which q was met
through the development of a brochure for distribution to the residents of BigPine and No Name e Key. While
I have been told that this brochure was created and distributed, I have not been successful in finding
a copy of
it.
Comprehensive Plan:
Policy 207.3.1
Big Pine and No Name Keys shall be high priority areas for controlling free -roaming dogs. In addition, by
January 4, 1998, the County Biologist shall identify other areas within the County where priority should be
placed in enforcing animal control laws so as to protect native wildlife populations.
Policy 207.3.3
By January 4, 1998, the Monroe County Animal Control Department shall develop and begin implementation
of an Animal Control Plan. The plan shall address long-term staffing and facility needs within the Upper,
Middle and Lower Keys for protecting residents and native wildlife populations from the hazards of free-
roamingdomestic pets.

By January 4, 1998, the County Biologist shall designate Key deer habitat on big Pine Key, No Name Key,
and other keys as appropriate, as priority areas for enforcement of animal control laws. Adequate staff shall
be provided at the animal shelter on Big Pine Key to enforce animal control laws.
