AGENDA ITEM WORDING: An Attorney-Client Closed Session of the Board of County
Commissioners in the matter of Monroe County v. Price line. com, et ai, 09-10004CV.
ITEM BACKGROUND: The County filed suit in U.S. District Court against internet travel service
providers to collect the full amount of tourist development tax on rooms booked through their services.
The Court has certified the case as a class action so Monroe County is the class representative of all
Florida counties which have adopted tourist development taxes but which have not opted out of the
plaintiff. Mediation is scheduled to be conducted prior to June 16th BOCC meeting so a closed session
is needed to discuss any settlement proposal that by result from mediation. Per F. S. 286.011(8), the
subject matter of the meeting shall be confined to settlement negotiations or strategy sessions related to
litigation expenditures.
Present at the meeting will be the Commissioners, County Administrator Roman Gastesi, County
Attorney Suzanne Hutton, Chief Assistant County Attorney Bob Shillinger, Assistant County Attorney
Cynthia Hall, special litigation counsel Jay Shapiro and Tod Aronovitz as well as a certified Court
Reporter.

AGENDA ITEM WORDING:
Closed session of the Board of County Commissioners to discuss collective bargaining with the
Professional Firefighters of Monroe County, IAFF Local 3909.
ITEM BACKGROUND:
The current collective bargaining agreement (CBA) includes a reopener clause for the purpose of
discussing additional wage and benefit changes. The current CBA took effect on October 1, 2008 and
runs through September 30, 2011. Any changes negotiated now (part-way through this contract) would
be applicable through that date. The management bargaining team is requesting this closed session in
order to get direction from the BOCC on several issues.

The current CBA was ratified by the BOCC on December 30,2008.
