02/24/1988 LEA S E TH I S LEASE, made th is 16th day of February , 1988, by JOHN E. CARTER and EDWARD D. CARTER of the County of Monroe, State of Florida, the Board of County Commissioners actinR_as the Board of Governors of hereinafter referred to as Lessor and/THE MUNICIPAL SERVICE DISTRICT OF MONROE COUNTY, a pol itical subdivision of the State of Florida, hereinafter referred to as Lessee. WIT N E SSE T H: That in consideration of the covenants herein contained, on the part of said Lessee to be kept and performed, said Lessor does hereby Lease to said Lessee the fol lowing described property: The East 1/2 of the SE 1/4 of the SE 1/4 of Section 9, Township 60 S., Range 40 E., Monroe County, Florida. TO HAVE AND TO HOLD the same for the term of one (1) year from the 15th day of June, A.D., 1987, provided, however, either party of this Lease may cancel said Lease upon sixty (60) days notice in writing. The Lessee shal I pay to the Lessor the sum of six hundred dollars ($600.00) per month the first payment being due upon execution of this agreement, subsequent payments shal I be made on or before the first day of each month. This Lease is made upon the following conditions: 1. The property is to be used by the Lessee for a temporary storage of abandoned vehicles. 2. The Lessee shal I not assign this Lease or sublet any part of the premises without written consent of the Lessor. 3. The Lessee shall maintain the leasehold premises in a sanitary and orderly manner and comply with the laws of the State of Florida. 4. The Lessee shal I hold the Lessor harmless from any and al I causes of action, suits or claims that may arise by virtue of third parties using the leasehold premises and Lessee covenants and agrees that it wi I I protect the Lessor against any and al I causes or manners of actions that may arise from third parties by virtue of any injuries or damage caused to said third parties whi Ie in, around or upon the leasehold premises. 5. Upon the termination of this Lease, the Lessee shal I return the property being leased to its original condition including but not limited to the removal of stored vehicles and other material placed upon the property during the term of this lease. 6. The Lessee agrees to reimburse the Lessor for any costs incurred in the enforcement of this Lease, including but not I imited to reasonable attorneys fees.
