LEASE AGREEMENT
CRAIN BROADCASTING, INC. and
MONROE COUNTY, FLORIDA
THIS AGREEMENT made and entered into this dl1,t' day of
JIAW\-e.- 1987, by and between CRAIN BROADCASTING, INC.,
hereinafter referred to as "Lessor" and BOARD OF COUNTY COMMIS-
SIONERS OF MONROE COUNTY, FLORIDA, hereinafter referred to as
"Lessee".
WIT N E SSE T H:
The Lessor does hereby let and lease unto the Lessee that
portion of the Lessor's building that is situated 400 feet due
north of MM 26.5 on Ramrod Key, Florida, as is necessary for the
construction and maintenance of an antenna at the 200-235 foot
level of the Lessor's tower. Sufficient space in the building is
also leased located upon said premises for the Lessee's equip-
ment, all under the following terms and conditions:
I. The term of this lease shall conrrnence upon the date
entered above and shall continue for a period of ten (10) years.
The Lessee must notify the Lessor in writing sixty (60) days
prior to the intended cancellation date.
In return for tower space Lessee agrees to perform
weekly maintenance on the emergency power generator located at
the tower site. This weekly maintenance will include: Running
the generator at least one hour once a week, and check the fuel,
oil, water, battery and overall condition of the generator at
leas t once a week.
These checks will be logged weekly by the
person doing the checks.
If the person performing the checks
finds anything wrong with the generator they will notify the
chief operator of WWUS inrrnediately so repairs can be made prompt-

II. No maintenance or tower work shall be performed by the
Lessor on property of the Lessee.
III. In the event of partial or total destruction of said
tower by wind or other casualty, the same shall be repaired as
expediently as possible at the expense of the Lessor; provided
that
if
said tower
cannot be
economically repaired or
reconstructed, the Lessor may elect not to rebuild or repair and
may terminate this lease by giving immediate notice to the Lessee
of such election.
IV. The Lessee will carry liability insurance covering the
loss or damage to property or injury to or death to persons
occurring on the demised premises or of any matter growing out of
the j oint use and occupancy of said premises in a company or
companies agreeable to and approved by the Lessor and such policy
or policies, at the expense of the Lessee, will be so endorsed as
to protect the Lessor as well as the Lessee. The Lessee shall
also provide that such policy or policies shall not be cancelled
or terminated or allowed to lapse without such company or com-
panies giving the Lessor notice in writing at least ten (10) days
prior thereto.
V. The use of the Lessor's premises during this lease
shall be limited to normal service of Lessee's equipment as
needed by the Lessee. The Lessee or its agents may have free
access to said premises at all reasonable times and under reason-
able restriction for the purpose of operation, inspection,
maintenance, removal, repair, and replacement of the Lessee's
equipment.
VI. This lease shall extend to the successors and assigns
of the parties hereto and be binding on the same.
IN WITNESS WHEREOF, the parties hereto have set their hands
