08/27/1992 MONROE COUNTY ;-- : L- 1'1 ., . --'-' r-'i,"".r-, STANDARD EMPLOYMENT AGREEMENT __ .; C l;~ ~ /: ~-, ~ day of Au- This agreement entered into this , gust, 1992, for the period from this date until Novem- ber 13, 1993, by and between the Monroe County Board of County Commissioners, a political subdivision of the State of Florida, hereinafter referred to as "Board" and Thomas W. Brown, hereinafter referred to as "Employee". In consideration of the mutual covenants, promises, and representations contained herein, the parties. agree as follows: The Board hereby employs, engages, and hires Employ- ee as the County Administrator, under the direct manage- ment of the Board of County Commissioners. Employee shall carry out to the best of his ability the following functions and duties: In addition to the jurisdiction, authority and du- ties which may be conferred upon the Employee by other provisions of the Monroe County Code, the Employee shall have the following jurisdiction, authority and duties, as described in Addendum A (Attached signed copy of job description). 1. Employee agrees that he will at all times faithful- ly, industriously, and to the best of his ability, experience and talents, perform all of. the duties that may be required of and from him pursuant to the terms hereof. 2. This board shall pay Employee, and Employee shall accept from the Board, in full paYment for Employ- ee's services hereunder, compensation as follows: (a) Salary of $69,874.20 per annum. (b) Benef its and services recei ved by other Monroe County employees, inclUding but not limited to life insurance, medical, hospitalization, dental and vision care, retirement, holidays, annual and sick leave and Social Security benefits as provided by the Monroe County Personnel Policies and Procedures except as expressly amended below: (c) Employee, at the direction of the Board of Coun- ty Commissioners, shall represent the County's inter- ests at national, state and local professional socie- ty functions. 3 . The Employee shall be entitled to annual cost of li ving raises as may be awarded to Monroe County employees each fiscal year beginning October 1. 4. Merit raises as may be awarded on an annual basis at the Monroe County Board of County Commissioners approved rate, if so recommended by the Board of County Commissioners. 5. Employee shall devote all of his time, attention, knowledge, and skill during working hours solely to County matters, and Employee shall not engage in the practice of his profession in the private sector. 6. The Employee shall have the use of "County services and personnel to carry out the functions of his job, ( 2) including.,. but not limited to: A suitable automobile, legal, accounting, secretarial and clerical assistance. (Office space," .utilities, telephone services, custodial services, books, library, postage, office supplies, photocopy equipment, furniture, office equipment and computer equipment as may be necessary.) 7. Employee shall have the following amenities in addi- tion to those mentioned above: (a) An additional five (5) days administrative leave. Nothing in this agreement shall prevent, limit or otherwise. interfere with the right of the employee to resign at any time from his position with the County, providing the employee shall give the Commission 90 days notice, unless the parties. shall othe-rwri.se agree. 8. The Board shall reimburse the Employee for all trav- el and lodging expenses on approved County business at the rate specified under Florida Statutes. 9. Employee may be terminated in the fo.llowJ.ng manner: ( a) For Cause. The Board of County conunissioners may remove the Employee from office for cause as set forth in the MCi>nroe County Emplo.yment Policies and Procedures Manual in accordance with the procedure set forth in the County Administration Law of 1974, also known as. Part III of Chapter 125, Florida Statutes, as amencl- ed. ( 3 ) (b) Termination Without Cause. The Board of Coun- ty Commissioners may remove the Employee at any time without cause by enactment of a resolution at any regularly convened Board Meeting in accordance with the procedures set forth in the County Administration Law of 1974, also known as Part III of Chapter 125, Florida Statutes, as amended. Upon adoption of said resolution, the Board shall cause to be paid to the Employ- ee six (6) months severance pay, together with paYment for accrued annual leave not yet taken by him. Full paYment shall be made by the Board wi thin twenty (20) days of such termina- tion. Addi tionally , in the event that said Employee is removed for cause under the provisions of 9. (a) ab0ve, and a court of competent jurisdiction renders a jUdge- ment which shall become final after appeal, he shall receive his reasonable attorney's. fees and court costs incurred in successfUlly bringing said suit, if Employee is adjudicated not guilty under 9.(a). In the event that the Board shall vote to abolish the Employee's position during Employee's. term of of- fice, the same shall be deemed a remDval without cause under the provisions of this subsection. Series fi417 COtlliTY ADMINISTRATOR r~AJOR FUNCTION Highly responsible administrative and management work directing and coordinator all phases of County government functions and activities under the jurisdiction of the Board of County Commissioners. ILLUSTRATIVE DUTIES (NOTE: These are intended only as illustrations of the various types of work performed. The omission of specific duties does not exclude them from the position if the work is similar, related, or a logical assignment to the position.) ~ Administers and carries out the directives and policies of the Board of County Commissioners and enforces all Orders. Resolutions, Ordinances, and Regulations of the Board to insure they are faithfully executed. Reports to the Board on actions taken pursuant to any directive or policy within the time set by the Board. Responsible for the administration of all departments which the Board has authority to control. Directly responsible for the assimilation and distribution of the agenda for the Board of County Commissioners' meeting. Attends meetings of the Board and is authorized to participate in the discussion in any manner. Provides an annual report to the Board on the state of the County, the work of the previous year, and any recommendations for actions or programs the Administrator deems necessary for the improvement of the County and welfare of its residents. -, Provides the Board, or individual members, upon request, with data or information concerning County government. Provides advice and recommendations of County government operations to the Board. Prepares and submits to the Board for its consideration and adoption, an annual operating budget, a capital budget, and a capital program. Establishes the schedules and procedures to be followed by all County departments, offices, and agencies in connection with the budget, and supervises and administers all phases of the budgetary control process. Supervises the care and custody of all County property. Recommends to the Board a current position classification and pay plan for all positions in the County service. -; Directs the negotiation of leases, contracts, and other agreements, including consultant services, for the County, subj ec.t to the approval of the Board. Makes recommendations concerning the nature and location of County improvements. Assures that all terms and conditions in all leases, contracts, and agreements are performed and notifies the Board of any noted violations. Perform other duties as may be required of him by the Board of County Commissioners. KNOWLEDGE, ABILITIES AND SKILLS Knowledge of administrative and management concepts and practices. Knowledge of financial and budget matters. Knowledge of modern business methods and procedures as applied to County government. Ability to delegate authority and responsibility. Ability to maintain an efficient organization and to establish and maintain satisfactory work relationships with department heads, County employees and the public. Ability to communicate"; effectively with the public, business and civic groups. Ability to present ideas and pro9rams orally and in writing. MINIMUM QUALIFICATIONS Graduation from an accredited four (4).year college or university with a degree in Public Administration, Business Administration or related field, supplemented by courses in management techniques and considerable progressively responsible experience in administrative and management work for a county or other governmental agency. A comparable amount of training or experience may be substituted for the minimum qualifications.
