'WHEREAS, the BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, desires to establish on Big Coppitt Key, Monroe
County, :rlorida, a playground for children living at Big Coppitt
Key and surrounding areas, and
1~EREAS, the BIG COPPITT VOLUNTEER FIRE DEPARTMENT, INC.,
is williIlg to lease to Monroe County, Florida, for a nominal fee,
property on said Big Coppitt Key for playground purposes, now,
thereforle,
'THIS INDENTURE, Made and entered into, in duplicate, this

da~y of August, A.D. 1976, by and between the BIG COPPITT
VOLUNTEE:R FIRE DEPARTMENT, INC., a corporation existing under the
laws of the State of Florida, hereinafter called the Lessor, which
term shall include its legal representatives, successors and
assigns 1N'herever the context so requires or admits, of the first
part, an(i the BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,
FLORIDA, a political subdivision of the State of Florida, herein-
after called the Lessee, which term shall include its legal re-
presentatives, successors and assigns wherever the context so
requires or admits, of the second part,
lNITNESSETH, that the Lessor by these presents leases unto
said Lessee the following described premises, situate, lying and
being in the County of Monroe and State of Florida, to-wit:

located in Government Lot 5, Section 22, Town-
ship 67 South, Range 26 East, Big Coppitt Key,

~6ook 4, Page 50, Public Records or Monroe County,
~Florida. .
~ro HAVE AND TO HOLD the premises as aforesaid unto the
said Lessee from the 15th day of August, 1976, for a term of
five (5) years then next ensuing, said lease being under the

1. The Lessee yielding and paying unto the said Lessor
the total rental of Five Dollars ($5.00) for the term of five (5)
years, said sum to be payable as follows:
a. One Dollar ($1.00) payable upon the execution
and delivery of this Lease which sum is to
cover the yearly rental for the first year
of this Lease and One Dollar ($1.00) on the
15th day of August, A.D. 1977, and One
Dollar ($1.00) on the 15th day of August
each and every year during the remainder of
the term of this Lease.
2. It is understood and agreed by and between the
Lessor and the Lessee that the Lessee will:
a. Use said premises for a children's park and
recreation area.
b. Pay the rent herein reserved at the time and
in the manner as stated herein.
c. Make no improper, unlawful or offensive use of
said premises.
d. To keep the premises in a clean, neat and
orderly condition.
e. Place no structure of improvements upon said
property without the consent of the Lessor.
f. At the expiration of the term of this lease,
without demand, quietly and peaceably de-
liver up full possession of said premises
in as good condition as they now are, damage
or destruction by fire and the elements only
excepted.
3. It is further understood and agreed by and between
the Lessor and the Lessee as follows:

That the Lessee shall have the right at the
expiration of this lease or any renewals
hereof to remove any improvements, equip-
ment or other property from the leased
premises, it being the intent hereunder
that any of said improvements, equipment
or other property shall remain at all times
the property of the Lessee.

At the termination of this Lease, the Lessee
shall have the option to renew this Lease
for an additional term to be mutually
agreed upon by the parties hereto.

The Lessor hereby covenants with the Lessee upon the
performarlce by the Lessee of the covenants and agreements herein-
before set forth t~at the Lessor will permit the Lessee to quietly
hold and enjoy the demised premises without any interruptions by
the Lessor or by any person or persons claiming by, through or
under it.

IN WITNESS WHEREOF, the party of the first part has caused
these presents to be signed in its name by its President and
Secretary and its seal to be affixed by said Secretary and the
party of the second part has caused these presents to be signed
in its name by its Chairman and its seal to be affixed by the
Clerk of the Circuit Court of the Sixteenth Judicial Circuit of
Florida, in and for Monroe County, Florida, and ex officio Clerk
of the BlDard of County Commiss ioners of Monroe County, Florida,
