Lewin County Administrator Monroe County Post Office Box 1029 Key West, Florida 33040 Re: West Martello Tower Stabilization Project Dear Mr. Lewin: This letter, when fully endorsed, shall constitute a binding agreement for the maintenance of and public access to the benefits derived from Federal historic preservation grant-in-aid assistance to the West Martello Tower Stabilization Project pursuant to current Federal policies and procedures for the administration of such assistance under the Historic Preservation Act of 1966 as amended, and the provisions of the Historic Preservation Grant Award Agreement dated June 3, 1980. This Agreement shall be effective for a period of five (5) years following the date of the endorsement below. In consideration of the sum of ten thousand dollars ($10,000) received in Federal grant-in-aid assistance from the Heritage Conservation and Recreation Service, United States Department of Interior, the Board of County Commissioners, Monroe County hereby agrees: 1. to assume the cost of continued maintenance and repair of the West Martello Tower so as to preserve its architectural and historical integrity in order to protect and enhance those qualities for which it was deemed eligible for and listed on the National Register of Historic Places, 2. to provide for public access to all areas of the property for which Federal historic preservation funds have been expended, for the purpose of observing and otherwise enjoying the benefits of such expenditures, for no less than twelve (12) days each calendar year, FLDRIDA-State of the Arts The Capitol · Tallahassee, Florida 32301 · (904) 488-3680 11f - Mr. Kermit H. Lewin July 2, 1980 Page Two 3. to provide for a~cess to the property by authorized representa- tives of the Heritage Conservation and Recreation Service, United States Department of Interior', and/or the Division of Archives, History and Records Management, Florida Department of State for the purpose of verification of compliance with the conditions of Federal grant assistance and the provisions of this Agreement, and 4. to execute, in the event of sale of the property during the period of this Agreement, a legally binding covenant to the property deed to provide that the subsequent owners or successors in interest shall assume the responsibility for and carry out the obligations of this Agreement for the remainder of the effective period of agreement. Nothing in this Agreement shall prohibit the County or its successors in interest from seeking financial assistance from any source available, or from charging a reasonable, nondiscriminatory admission fee.
