11/22/1977 Agreement AGREEMENT rrhl.S Ad. h- 22nd greement entere lnto t lS .day of NOvember , 1977, by and between the BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, hereinafter referred to as "Owner" and KENSON, PHILLIPS, TRICE, CARR SMITH AND ASSO- ClATES, INC., hereinafter referred to as "Architect", for the following project: West Martello Tower Development, Phase .1 Proj ect, hereinafter referred to as ".Proj ect" J WIT N E SSE T H: That in consideration of the mutual covenants herein con- tained, the Owner and the Architect hereby agree as follows: 1. The Architect shall prepare and provide structural review of the building, including recommendations as to which areas are in immediate need of repair. 2. The Architect shall make recommendations as to appro- priate solutions to those areas that are in need'of repair includ- ing practical alternative solutions. .3. The Architect shall make reconnnendations as to methods ~of solving architectural problems, such as alternate methods of restoring badly damaged exterior and interior brick without de- straying the character of the fort as a civil war relic. . , ~. 4. The Architect shall recommend me~hods of solving .further water i~fi~tration and resulting efflorescence. t 5. The Architect shall make subsoil and foundation in- vestigations to determine cause and possible solutions to the building's settling. 6. The Architect shall recommend alternative methods of renovating drainage and sewerage system. 7. The Architect shall provide a site plan showing methods of regrading in and around the building so as to prevent further drainage back-up. Page ~l of 3 Pages 8. The Architect shall recommend amount of defoliation and root deadening so ~s to leave the site as pleasant looking as possible,' but more importantly to assure the large root systems are not destroyed which would impair the subsoil bearing capacity. 9. The Architect shall recommend methods of providing proper ventilation for the walls so as to prevent moisture build- ing up. 10. The Architect shall provide specifications and method of application for a,water-repellant coating and waterproofing materials for the exterior walls and roofing. 11. The Architect shall make proposals and suggestions which may be related functionally to the display techniques to enhance the quality of the museum and art gallery. 12. The'Architect shall assemble the previously listed points in appropriate format to serve as a master plan for the restoration of the tower over a period of years. 13. The parties agree that the total fee for the above services will be invoiced monthly at a rate of 2.5 times actual hourly payroll rates, toget?er with all other direct costs (travel" lodging, meals, long distance telephone and printing) as accumu- lated during the current billing month. The total fee for the above service fees shall not exceed Five Thousand Dollars ($5,000.00). .~. fl. \1 . 14. The Architect agrees to comply wit~ the "Policies and Procedures for Historic Preservation Grants-In-Aid", a copy of which is attached hereto and made a part hereof. . 15. The Architect agrees to complete the services provided for hereirl \.vithin twel~Je (12) months from the effective date of this Agreenlent. 16. The parties agree that the Architect shall submit copies of the report set forth herein for review and comment by the Division of Archives, History and Records Management, Depart- ment of State of the State of Florida, prior to preparation of the formal report. The parties agree that each shall cooperate and co- ordinate tne services provided for herein with the Division of Archives, History and Records Management as necessare to assure mutual understanding and agreement on the objectives, require- ments and limitations of the Project in relation t6 the state and federal historic preservation programs. The above contract constitutes the entire undertaking for professional services and is all inclusive. . The Architect/Engineer is to be sole interpretor for the contract within the outline of services previously indicated. As each item of this report is to be implemented, KENSON, PHILJ-,IPS, TRICE, CARR SMITH AND ASSOCIATES, INC., will provide, if authori~ed, detailed drawings and specifications under separate contract' and on individual fee quotation.
