04/05/2000 Special ~ MINUTES OF THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS 2000/1 03 Special Meeting Board of County Commissioners Wednesday, April 5, 2000 Key West, Florida A Special Meeting of the Monroe County Board of County Commissioners convened at 10:00 A.M., on the above date at the Harvey Government Center at Historic Truman School. Present were Commissioner Wilhelmina Harvey, Commissioner George Neugent, Commissioner Mary Kay Reich, Commissioner Nora Williams, and Mayor Shirley Freeman. Also present were Isabel C. DeSantis, Deputy Clerk; James T. Hendrick, County Attorney; James Roberts, County Administrator; County Staff, members of the press and radio; and the general public. ADDITIONS, CORRECTIONS, DELETIONS ~ There were no Additions, Corrections, or Deletions to the Agenda. County Attorney James T. Hendrick discussed with the Board approving the resolutions of Ocean Reef Club and Ocean Reef Community Association concerning the destruction of mangroves adjacent to the Coral Lane project and directing that action be taken consistent with those resolutions. After discussion, motion was made by Commissioner Williams and seconded by Commissioner Reich that as part of the entire approach in restoration and mitigation planning, a Restrictive Covenant be placed on the units alerting to the fact that the units, lots and adjacent property is not what they would be buying, subject to restrictions determined by county biologists; and alternatively, that the developer be fined a maximum amount. After further discussion, the motion was amended by the maker with the second accepting to add the following language to Section 2. of the Resolution: The BOCC endorses the imposition offine(s) commensurate with the profit which the violator would expect to reap as a result of its wrongful acts. Further, the BOCC supports restrictions, preserved by record notice running with the land, preventing further alteration or trimming of the affected area in perpetuity. RESOLUTION NO. 135-2000 See Resolution Book No. 145 which is incorporated herein by reference. Roll call vote was unanimous. The Board discussed a Resolution asking for permission to effect a voter referendum to -- create the "Village of the Lower Keys" to include Summerland Key, Cudjoe Key, Ramrod Key, SugarloafKey, Saddlebunch Key and the Torch Keys. The following individuals addressed the 04/05/00 2000/1 04 -- Board: Gordon West, representing the SugarloafProperty Owners' Municipal Services Study Group; John Ulrich, Robert Schneider, representing the Big Pine Key Civic Association; and Capt. Mills, representing the Keyswide Civic Association. After discussion, Mayor Freeman withdrew her item. There being no further business to come before the Board, motion was made by Commissioner Williams to adjourn the meeting. Danny L.
