A Meeting of the Board of County Commissioners
convened at 9:00 a.m. on the above date at the Key Colony
Beach City Hall. Present and answering to roll call were
Commissioner Earl Cheal, Commissioner Douglas Jones,
Commissioner Jack London, and Mayor Wilhelmina Harvey~
Commissioner Stormont was not present. Also present were
"Danny L.-Kolhage,. Clerk~ Randy Ludacer, County Attorney~
Torn Brown, County Administrator~ County Staff~ members of
the Press and Radio~ and the general public.
All stood for the Invocation and Pledge of
Allegiance.
ADDITIONS, CORRECTIONS, DELETIONS
Motion was made by Commissioner Cheal and seconded
by Commissioner London to approve additions, deletions and
corrections to the Agenda. Motion carried unanimously.
PRESENTATION OF AWARDS
Presentation of the May Employee of the Month Award
was made to Michael D'Haem, Paramedic/Shift Supervisor,
Emergency Medical Services.
Michael Puto made a presentation to the Board on
behalf of Big Brothers, Big Sisters.

BULK APPROVALS
Commissioner Cheal discussed the proposed
Resolution of the Board of County Commissioners of Monroe
I County, Florida, authorizing the American Association of
Retired Persons to conduct bingo games in County owned faci-
lities used by said association. Motion was made by
Commissioner Jones and seconded by Commissioner Cheal to
postpone adoption of the Resolution. During discussion
motion was withdrawn. Motion was made by Commissioner
London and seconded by Commissioner Cheal to adopt the
following Resolution. Motion carried unanimously.

Community Services Director Peter Horton addressed
the Board concerning the approval of agreement between
Monroe County and Greiner, Inc. for General Airport
Consultant Services. Motion was made by Commissioner Cheal
and seconded by Commissioner Jones to approve the proposed
agreement with the addition on page A-2 of the following:
Identify changes in Laws and/or regulations and
their impacts on Monroe County Airports.
Motion carried unanimously.

Motion was made by Commissioner Cheal and seconded
by Commissioner Jones to grant approval of a Supplemental
Joint Participation Agreement between Monroe County and FDOT
regarding the MTH Terminal DRI, with the correction on
Exhibit B of the following:

Motion was made by Commissioner Jones and seconded
by Commissioner London to postpone consideration of authori-
zation to commence lawsuit against Priority Air and return
this item to staff to investigate the companys continued

Motion was made by Commissioner Jones and seconded
by Commissioner Cheal to grant approval of Information
Systems building addition to be funded by Captital projects
Fund #303-1988 Bond Issue monies. Motion carried
unanimously.
FLOOD VARIANCE APPLICATIONS
Motion was made by Commissioner Cheal and seconded
by Commissioner London to approve per staff recommendations
and conditions, the variance to the Flood Hazard Ordinance
for Monroe County Matecumbe Beach Park, u.S. No.1, MM 73,
Lower Matecumbe Key for a nonresidential bath facility
greater than 300 square feet below base flood elevation.
Motion carried unanimously.

Motion was made by Commissioner Cheal and seconded
by Commissioner Jones to approve the request by
Valdes-Fauli, Cobb, Petrey & Bischoff Law Office to use
Harry Harris Park on August 4, 1991, without the permission
for the consumption of alcohol. Roll call vote was taken

Motion failed. After further discussion, motion was made by
Commissioner London and seconded by Commissioner Cheal to
reconsider the previous action. Roll call vote was unani-
mous. Motion was made by Commissioner Jones and seconded by
Commissioner Cheal to approve the requested use of Harry
Harris Park by Valdes-Fauli, Cobb, Petrey & Bischoff Law
Office without the approval for the consumption of alcholic
beverages. Roll call vote was unanimous.
CONSTRUCTION PROGRAM MANAGEMENT - MK/G
Mr. Doug Fuller for the firm of Morrison
Knudson/Gerrits addressed the Board. Mr. William Henry for
the firm of William Henry/Architects Diversified made a pre-
sentation to the Board concerning the progress of the design
development of the record's storage building on Jackson
Square. Motion was made by Commissioner London and seconded
by Commissioner Jones to approve the design development
estimates for the record's storage building in Jackson
Square as presented. Roll call vote carried unanimously.
Motion was made by Commissioner Jones and seconded by
Commissioner London to approve an amendment to Fund #304
increasing the appropriation for the record's storage faci-
lity to $1,150,000.00. Roll call vote carried unanimously.
The Clerk advised the Board that he was in receipt
of a late bid on Package No.5, Site Grading and Caisson,
for the New Monroe County Detention Facility. Motion was
made by Commissioner Jones and seconded by Commissioner
London to accept and open the late received bid. Roll call

Motion failed. After further discussion motion was made by
Commissioner London and seconded by Commisioner Cheal to
authorize the Clerk to return the bid unopened. Roll call
vote carried unanimously. Motion was made by Commissioner
Cheal and seconded by Commissioner London to approve the the
award of bids for Bid Package No. 5 for site grading and
caissons for the New Monroe County Detention Facility to the
firm of Toppino's Inc., in the amount of $1,292,526.25.

Motion carried. During discussion of procedures used for
the bidding of construction of the facilities, the Board
discussed the Record's Center construction. The Clerk
advised the Commission that he would recommend that the tra-
ditional methods be used in the bidding and procurement of
construction services for the record's center on Jackson
Square. Motion was made Commissioner London and seconded by
I Commissioner Jones to direct that construction of the
record's center will proceed on the basis of the traditional
bidding process, rather than breaking the job up into many
individual componants. Roll call vote on the motion carried
unanimously. Motion was made by Commissioner London and
seconded by Commissioner Jones to approve Alternate No. 23
of the Bid Package No.5, Site Grading and Caissons, for the
New Monroe County Detention Facility. Roll call vote
carried unanimously. Motion was made by Commissioner Cheal
and seconded by Commissioner London to approve Alternate No.
24, of Bid Package No.5, for the New Monroe County
Detention Facility. Roll call vote carried unanimously.

The Clerk advised the:Board that he was in receipt
of late received bids for the planning, programming and ini-
tial schematics of the Jackson Square and Truman School
Renovations, recieved after the time for filing as per the
published notice. During Board discussion, the Board was
advised that these bids did not include dollar amounts, but
were expressions of interest and qualifications. Motion was
made by Commissioner Jones and seconded by Commissioner
London to authorize the Clerk to open the late received
bids. Roll call vote carried unanimously. The Board then
entered general discussion of the bidding process. Motion
was made by Commissioner Jones and seconded by Commissioner
Cheal to establish a Board policy, that the time of the cut-
off for the receipt of bids would coincide with the opening
of the bids, and that any bids received after that time
would be automatically rejected. Roll call vote carried
unanimously. Motion was made by Commissioner Cheal and
seconded by Commissioner Harvey to appoint the firm of
Morrison Knudson/Gerrits and the County Engineer, to review,
and rank the proposals and to recommend not to exceed five
firms who would make a presentation to the Board for final
selection. Roll call vote was unanimous.

The Board of Governors of District #l Lower and
Middle Keys Fire and Ambulance Disctict convened. Present
and answering to roll call were Commissioner Hal Halenza,

Community Development Block Grant over to the Monroe County
Housing Authority. During discussion motion was withdrawn.
Motion was made by Commissioner Jones and seconded by
Commissioner Harvey to refer the bids to the CDBG Review
Committee and to have all five bidders make a ten-minute
presentation to the Board at the next meeting. Roll call
vote was unanimous.
Motion was made by Commissioner Jones and seconded
by Commissiner London to adopt the following Resolution by
the Monroe County Board of County Commissioners affirming
the approval by the Director of Planning of the corrected
Plat of Coral Coast Subdivision, and authorizing the Mayor
to affix her signature to said corrected Plat. Motion

Development Block Grant bids. After further discussion

Director of Growth Management Bob Herman addressed
the Board. The following respondents to the RFP for
"Euthrophication and Trophic Structuring in Marine Plant
Communities in the Florida Keys," made presentations to the
Board. Sandra Vargo of the Florida Institute of Oceanography
and Dr. Brian E. Lapointe. Motion was made by Commissioner
Cheal to award the Contract for the project to the Florida
Institue of Oceanography Consortium. Motion died for lack
of a second. Motion was made by Commissioner Cheal and
seconded by Commissioner Jones to award the Contract to Dr.
Brian E. Lapointe. Roll call carried unanimously.
Motion was made by Commissioner Cheal to postpone
consideration of amendment to the WRT contract or authoriza-
tion to develope a contract with Horsley Witten Hagemann,
Inc. Motion died for lack of a second. Motion was made by

reject the option to proceed with Horsley, witten Hagemenn,
Inc. Roll call vote carried unanimously. Motion was made
by Commissioner Cheal to direct a letter to WRT relative to
the Board's concern over an apparent "bait and switch"
action on their part. During discussion, motion was
withdrawn. Motion was made by Commissioner Cheal and
seconded by Commissioner Jones to direct staff to coordinate
with all state and federal agencies to develop a methodology,
and funding to develop environmental carrying capacities and
to bring back to the Board, with County funding not to
exceed $50,000.00. Roll call vote was unanimous.
Mr. Herman advised the Board that he would be tra-
veling to Tallahassee, to meet with the Department of
Community Affairs concerning the Comprehensive Land Use Plan
procedures.
DIVISION OF PUBLIC WORKS
Public Works Director Dent Pierce addressed the
Board concerning a report from Joel Rosenblatt concerning
the condition of the Card Sound Bridge. Mr. Pierce also
advised the Board that the County had received proposals for
the Long Range Transportation Plan and that the Planning
Department, and the Department of Transportation and Mr.
Koppel would be producing a short-list.
Motion was made by Mayor Harvey and seconded by
Commissioner Jones for approval for the Road Department
Crews and their equipment to assist the Florida Audubon and
the U.S. Fish and Wildlife Service as requested by Mr.
Curtis Kruer, continued from the June 26, 1991 Board of
County Commissioners Meeting. Roll call carried unani-
mously.
Motion was made by Commissioner London and
seconded by Commissioner Jones to continue approval of the
Fee Schedule, Rental Rates and Regulations for use of Public
Facilities, Roads and Bridges in Monroe County, Florida,
until the receipt of a report from the Park's Board and to
refer this proposal to Park's Board for their review.
Motion carried unanimously.
COMMISSIONERS' ITEMS
Commissioner Cheal discussed the approval to
establish Board of County Commission policy that all current
and future policy, set by the Monroe County' Board of County
Commissioners, will "sunset" at the end of three years,
unless amended, revised or extended. No action was taken by
the Board.

The Board entered into a discussion of Big Pine Key
School and cooperative efforts from County Staff.
Commissioner Cheal discussed educational facilities in the
Lower Keys.
Motion was made by Commissioner Cheal and seconded
by Commissioner Jones to reconsider the Board's previous
action concerning a Resolution urging the State of Florida
and the USA to assist in constructing a fixed span bridge
replacement for the Jewfish Creek Bridge adopted earlier in
the meeting. Motion carried unanimously. Motion was made by
Commissioner Cheal and seconded by Commissioner London to

approve adoption with changes, changing Jewfish Creek Bridge
to Jewfish Creek Draw Bridge. Motion carried unanimously.

COUNTY ADMINISTRATOR
Coun~y'Administrator Tom Brown gave his report to
the Board. Mr. Brown discussed a letter from the Department
of General Services Administration concerning the Marathon
Regional Government Center. Mr. Brown also advised that he
had received a communication concerning the South Florida
Regional Planning Council's involvement in the Monroe County
Comprehensive Land Use Plan approval process. Mr. Brown
advised the Board of his appointment to a Mass Immigration
'Panel, that was meeting to consider the problems posed for
southeastern Florida counties concerning immigration.
Mr. Brown entered into a discussion concerning con-
sideration of interim inmate detention facility alter-
natives. Motion was made by Commissioner Jones and seconded
by Commissioner Harvey to proceed with the development of
alternate facilities to alleviate over-crowding expected
within the next year or two years. Roll call vote was taken

West City/Monroe County staff meeting concerning disposal of
Monroe County solid waste in the Key West Landfill. No
action was taken by the'Board.
Mayor Harvey nominated Commissioners' London,
Stormont and Cheal to serve on the Property Appraisal
Adjustment Board for the current year.
