A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY,
FLORIDA, APPROVING THE ANIMAL
CONTROL CITATION TO BE USED PURSUANT
TO SECTION 4-46 OF THE MONROE COUNTY
CODE.
WHEREAS, pursuant to Monroe County Code (MCC) Section 4-46, upon observing a
violation of Chapter 4 of the MCC, an animal control supervisor or animal control officer, or
any other law enforcement officer, may issue a citation; and
WHEREAS, the animal control citation used shall be in substantially the same form as
approved by Board resolution; and
WHEREAS, the animal control citation should be approved by the Board. of County
Commissioners for the purpose of ensuring enforcement of the Monroe County Animal
Control Ordinance; and
WHEREAS, Section 4-46, MCC sets forth the required information that shall be
contained in the citation;

1. The Board of County Commissioners of Monroe County approves the animal
control citation attached hereto and, pursuant to Sec. 4-46 of the Monroe
County Code, requires that all animal control contractors use citations in
substantially the same form as approved herein.

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA APPLAUDING THE OCEAN
CONSERVANCY AND FLORIDA KEYS NATIONAL MARINE
SANCTUARY FOR THEIR EFFORTS IN ORGANIZING AND
CARRYING OUT A KEYS -WIDE BEACH CLEANUP TO TAKE PLACE
ON SEPTEMBER 25, 2010.
WHEREAS, the Florida Keys have a diversity of coastal resources including fringing
mangroves, saltmarshes, seagrass meadows, nearshore patch reefs, offshore barrier reefs, and
sandy beaches; and
WHEREAS, the coast has provided the Keys with a rich scenic, cultural, and historical
heritage and constitutes a national recreational and economic resource supporting a robust
commercial fishing and tourist industry; and
WHEREAS, Monroe County is strongly committed to the wise management of its
coastline in order to ensure the natural and economic sustainability of this resource; and
WHEREAS, the proper disposal and recycling of solid waste is an important aspect of
protecting the Keys' coastal resources and achieving coastal sustainability; and
WHEREAS, the Ocean Conservancy has sponsored an annual County and Statewide
coastal cleanup in Florida since 1988, resulting in the nations' largest coastal cleanup effort; and
WHEREAS, the Ocean Conservancy and the Florida Keys National Marine Sanctuary is
sponsoring a coastal cleanup in the Florida Keys on Saturday, September 25, 2010;
WHEREAS, the coastal cleanup efforts of the Ocean Conservancy and the Florida Keys
National Marine Sanctuary are critically important to the protection of coastal resources in the
Keys;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA that:
1. The Board and citizens of Monroe County, the Florida Keys, support this laudable
effort with the same strength of spirit held by those who organized the cleanup and
volunteered their substantial time and energy.
2. The Board would like to commend the many businesses in the Keys that donated time
and materials to this effort, including the Monroe County Solid Waste Management
Department, the Florida Keys National Marine Sanctuary, and Keys' solid waste
haulers: Key Sanitary Service, Marathon Garbage Service, Waste Management Inc.,
and Veoila.

Re: Richard Road, Big Pine Key
Dear Mr. Pierce:
I represent Vern Porkowski, a neighboring owner of Richard Road in Piney Point
Subdivision. Mr. Porkowski has been in touch with you and other County personnel
regarding the unsafe and unauthorized use of Richard Road by the public as a boat
launching site to Pine Channel. There is no boat ramp at Richard Road. Boat trailers are
being backed down Richard Road into Pine Channel where the trailer and vehicle are at
risk of dropping off a ledge. Surely such an unsafe hazard should be abated by the
County or State. Neither the State nor the County should continue to assume the liability
for any potential personal harm or property damage incurred by those using Richard
Road as a boat launch site.
Enclosed you will find the agenda item from October 21, 2009 when the County
Commission considered a closure of the road but did not take action. The western
terminus of Richard Road is the mean high water line. The State of Florida owns the
western end of Richard Road as sovereign submerged land since the westernmost portion
of the road is below the mean high water line of Pine Channel. In fact, much of the road
is submerged at high tide.
Enclosed is a December 28, 2009 letter from the Florida Department of Environmental
Protection, Division of State Land, confirming the State's ownership of the latter part of
Richard Road.
By copy of this letter to the DEP, it is our hope that the County and DEP will work out an
arrangement whereby the launching of boats at Richard Road will be abated.
I look forward to hearing from you and the DEP. We will provide any information you
might request and stand ready to meet with you and the DEP as well as attend a County
Commission meeting in support of our request.

Re: Richard Road, Big Pine Key; Monroe County
Thank you for your recent inquiry requesting a determination of whether the Board
of Trustees of the Internal Improvement Trust Fund of the State of Florida owns
any portion of Richard Road, or the submerged lands lying waterward of Richard
Road at Pine Channel. The site is located in Section 34, Township 66 South, Range
29 East.
Records on file in the Title and Land Records Section of the Bureau of Surveying
and Mapping indicate all lands lying below the mean high water line of Pine
Channel at the end of Richard Road are state owned. Pursuant to Section 253.77 (1),
Florida Statutes, any activities affecting the submerged lands at this site would
require authorization from the Board of Trustees. Our records contain insufficient
information to determine whether any portion of the upland right-of-way is state
owned. Therefore, we would recommend that proprietary requirements normally
applied to state owned lands not apply to the uplands. The conclusions stated
herein are based on a review of records currently available within the Department
of Environmental Protection as supplemented, in some cases, by information
furnished by the requesting party and do not constitute a legal opinion of title. A
permit from the Department of Environmental Protection or other local, state, or
federal government agencies may be required prior to conducting activities at this
site.

Hi Beth,
I did a site visit at the right of way at the end of Richard Rd this week. The main issue regarding
launching any kind of vessel at the site is the fact that it's a wetland, and therefore not appropriate for use
as a boat ramp or to be developed as a boat ramp. In addition, the path going into the cleared area is
really not of appropriate width for a truck and trailer to safely get into. There is no area to park in there
either. Also, there are tons of fiddler crabs that would be crushed if a vehicle tries to drive in there.
There are several alternate sites for launching of vessels for the folks in that neighborhood. One is the
county boat ramp on State Rd 4A on Little Torch. That ramp puts boats into the same body of water -
Pine Channel. It's about 1 '/2 miles away as the crow flies. Also, there is the county boat ramp at Eden
Pines Colony on Big Pine, also dumping into Pine Channel. That is about 2 miles away. A couple of
miles to go to a boat ramp is a short distance by most boater's standards in the state.

Subject: Request to close Richard Road, Big Pine Key
The purpose of this memo is to request the closure of the western portion of Richard Rd,
Big Pine Key. As shown in the attached map, this portion of Richard Rd is undeveloped
and terminates on the open water of Pine Channel. The parcels just south of the
undeveloped ROW are owned and managed by the USFWS for conservation purposes.
Currently, the road is accessible by vehicles, which enables dumping and other illegal
activities. The County has received recent complaints related to these issues from
concerned neighbors. In order to avoid further dumping and damage to this natural area,
I am requesting that a barricade of some kind be placed at this location. The barricade
should allow for pedestrian access. I would be happy to meet with you on site to discuss
the situation.

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, HONORING WARREN JOHNSTON AND
THE PROPELLER CLUB OF THE UNITED STATES OF AMERICA.
WHEREAS, the Propeller Club of the United States of America member Mr. Warren Johnson
had the foresight, leadership and vision to recommend installation of Sea Beacon 2 System, known as
Racon Beacons, to protect the natural resource of the United States & the State of Florida known as the
third largest barrier reef in the world located within the Florida Keys National Marine Sanctuary; and
WHEREAS there has not been a ship grounding on the reef tract that runs from Fowey Rocks to
Loggerhead Key in the Dry Tortugas Since the installation of the Racon Beacon System in 1999; now
therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,
FLORIDA, that:
1. We honor the Propeller Club of the United States and its member Mr. Warren Johnson with
appreciation and thanks for helping protect this National Treasure, the Offshore Barrier Reef that lies
within the boundaries of the Florida Keys National Marine Sanctuary.
2. This resolution shall be effective as of the date of its passage.

AGENDA ITEM WORDING: Discussion and direction to explore opening some presently
barricaded county roads that previously offered public access to the water.
ITEM BACKGROUND: Over time, some county roads that offered public water -access have been
closed with barricades in an effort to prevent such nuisance problems as littering and loitering. Although
well intentioned, the barricaded and fenced closures may have only denied public access to the water
while having a minor lessening affect on the problems of littering and loitering. In some cases, the
aforementioned problems have been made worse due to trespassing on adjoining private property and
the inviting atmosphere of the privacy and seclusion offered by fences, barricades and the eliminated
normal traffic flow in the areas. The closure of many of these access areas has put pressure on the few
neighborhoods where access areas remain open and seems to be in opposition to our goal of public
access to the water.
