Box 1680 Key West, Florida 33040 Dear Mr. White: On June 13, 1979, the enclosed contracts for Baker Act Matching Funds were received from Mr. Michael Cates. I have reviewed the contracts and identified the following concerns: 1. This is a totally new contract for the period from October 1, 1978, to September 30, 1979. It does not state that this contract supersedes the one signed on October 3, 1978, for $15,000 for the same period. Is Monroe County allocating $30,000 or $45,000 for Baker Act match? If the allocation is $30,000, could the supplemental allocation not be handled through amendment to the current contract, rather than a totally new contract? If a new contract is needed and the allocation is $30,000, should the new contract not stipulate that it supersedes the former one? 2. In addition to the Baker Act inpatient services which have been provided in the past, the Guidance Clinic of the Middle Keys is now establishing a crisis stabi- lization unit. One of the goals of this unit is to reduce the cost of serving Baker Act clients by providing intensive short term treatment in a local facility at a lower per diem rate than that incurred for hospitilization. It is anticipated A Mr. Ralph White Page 2 June 15, 1979 that $2,342 in Monroe County match will be needed for start-up costs and $3,950 will be required as match for crisis stabilization services for the period ending September 30, 1979. Can the con- tract be written with these funds "ear- marked", specifically for these purposes? 3. The contract provides no mechanism for reimbursing the Mental Health Board for local matching funds expended in establish- ing the crisis stabilization unit (start- up funds). Will it be acceptable for the Mental Health Board to submit copies of paid invoices to justify request for reim- bursement of match expended for start-up costs? Attempts to contact Mr. Cates and discuss these issues have been unsuccessful. I am, therefore, returning all three copies of the proposed contract, unsigned, and requesting your assistance in obtain- ing answers to the questions raised above. As a result of your letter, the Clerk has not furnished me with a copy of the Agreement for Baker Act Matching Funds dated October 3, 1978, of which I was unaware and was never approved by my office as is required by the Commission rules. 2. In light of said contract and the fact that it was executed for $15,000 originally, I concur with you that my proposed agreement sent to you under date of June 6, 1979, and my letter of June 14, 1979, should be amended to now reflect $30,000 in lieu of $15,000. 3. 1 enclose herewith a proposed supplemental agreement pro- viding for said amendment. 4. In regard to items 2 and 3 of your letter, I am unable to assist you at this time and I am advised by Mr. Danny Kolhage of Mr. White's office that he is unaware of any action on the part of the Board in regard to the crisis stabilization unit. I would suggest that in regard to the crisis stabilization unit that a member of your organiza- tion contact the County Administrator, Mr. William E. P. Roberts, Jr. and discuss same with him, whereupon the County Administrator can pro- pose the matter to the Board for appropriate action. The action of the Board for the additional $15,000 was only for the purpose of providing Baker Act funds in accordance with the Mrs. Barrie L. I decided to hold a hearing in each of the three areas of the county, and the delay in scheduling was a result of trying to achieve coordination among me, Chris Mankowitz and all three clinics. I appreciate your sending me the copies of the requested minutes. Unfortunately, we're still missing the Baker Act motion. I hate to ask you, but we've called and written at least six (6) times to the County Clerk's office with no success. If you can locate the specific reference to the Baker Act funding for us, we would not only appreciate it, but it would also make me rest somewhat easier. On October 1, we began the new contract cycle and have been paying bills for Monroe County residents under the Baker Act, with no formal notice of Monroe County's agreement to participate. Under that law, local govern- ments are required to match State funds in their jurisdictions. Since January 1, 1977, Monroe County has allocated only $2,295 per year for Mental Health Board administrative costs. That limited allocation has not even come close to covering the costs expended in activities directly related to Monroe County (i.e., contract development, travel for both staff and Monroe County members on the Board, program application reviews, special reports, etc.). I am enclosing for you a copy of my letter to you of May 29, 1981, which outlines the need for additional support of Mental Health Board activities. If this request is denied, we will not be able to reimburse any travel costs incurred by Monroe County appointed members, nor will we be able to provide technical assistance to the three mental health clinics, conduct special studies, hold special Mental Health Board committee meetings in Monroe County, administer the Baker Act match for Monroe County, nor comply with your request that the Mental Health Board participate in a work session with the members of the Monroe County Commission. During the 1980-81 fiscal year, the three (3) Keys mental health EXECUTIVE DIRECTOR clinics received $243,994 (7.601o) of the mental health funds, CHARLOTTE ST. JOHN. M.P.A. $218,440 (9. 70/o') of the alcohol funds, $131.439 (6 0) of the Baker Act funds, and $7,835 (4.20) of the Indigent Drug Program funds allocated by the Board (6.50 of all State funds allocated). In order to insure the continuation of funding for hospital and physician services under the Baker Act, it is necessary for the Board to secure local matching funds to cover at least twenty- five percent (257'0) of Baker Act charges. In its 1980-81 budget, Monroe County allocated $44,000 for this purpose. This money will allow the clinics to serve a projected 279 clients through the Crisis Stabilization Unit at the Guidance Clinic of the Middle Keys and contractual agreements with Florida Keys Memorial Hospital, Fisherman's Hospital, P.L. Dodge Memorial Hospital, and Highland Park General Hospital. Assuming only a six to seven percent (6 to 7 o) increase in the allocation of State Baker Act funds, the clinics will receive approximately $140,000 in State funds for the 1981-82 fiscal year and will need. approximately $46,700 in local match. The Dade-tIonroe Mental Health Board is, therefore, requesting the Board of County Commissioners of ,`.tonroe County to allocate $46,700 for Baker Act local matching funds for the October 1, 1991 September 30, 1982 fiscal year. Since the merger of the Florida Keys dental Health Board and the Dade County ~Mental Health Board in- _ January 1977, Monroe County has allocated $2,295 per year to the Board for these expenses. Board operating expenses, like those of agencies funded by the Board, have increased significantly during that time period. Simultaneously, the fiscal and programmatic responsibilities of the Board as it relates to funded agencies have increased. The Board is requesting the Board of County Commissioners of 11onroe County to allocate $3,250 to the Dade-l:ionroe Mental Health Board for the fiscal year beginning October 1, 1981. This allocation will bring the Monroe County participation in the Board's $200,000 operating budget in line with the percentage of funds allocated to Monroe County facilities.
