Supplement No. 4SUPPLEMENTAL AGREEMENT NO. FOUR TO CONTRACT FOR PROFESSIONAL SERVICES DATED OCTOBER 24, 1990 BETWEEN MONROE COUNTY, FLORIDA AND DAVID VOLKERT & ASSOCIATES, INC. THIS SUPPLEMENTAL AGREEMENT, made and entered into this L day of L)(t , 1996, by and between Monroe County, hereinafter referred to as the Owner, and David Volkert & Associates, Inc., hereinafter referred to as the Consultant; WITNESSETH THAT: WHEREAS, the Owner and the Consultant entered into an Agreement on the 24th day of October. 1990, whereby, the Consultant is to provide necessary professional services associated with improvements to the Key West International Airport, as more specifically set forth in said Agreement as Phase I Terminal Renovation and Expansion Project. WHEREAS, the Owner has requested for the consultant to proceed with Professional Services required to provide Engineering Design and Design Cost Estimating Services required to Design a new Water Main Lateral (Fire Line) to supply fire protection water service to the Annex Building. The Design shall include Utility Coordination, Water Main Design/ Analysis, Utility Plan added to the existing overall site plan and Utility Details describing a new water line from the existing water main adjacent to Roosevelt Boulevard to the new Annex Building. The Existing, complete, Plans and Specifications will remain otherwise unchanged, and WHEREAS, the Consultant is agreeable to completing the required work for fees that are acceptable to the Owner and in accordance with the latest requirements for of the Federal Aviation Administration for federal funding of projects; NOW, THEREFORE, for and in consideration of the mutual covenants hereinafter stipulated-ty be kept and performed, the parties hereto agree that the contract of 24, October 1990, bdP3u0plem*ed as:follows: ARTICLE 1 - SCOPE OF BASIC SERVICES = _ NJ or, SECTION 1 - GENERAL: - n 1. The Consultant shall produce Design Revisions appropriate for boding the 4�nstruF6- ion of the Key West International Airport Terminal Renovation Project with the Addition of'a new Fire Protection Water Main Extension from the existing Water Main adjacent to Roosevelt Boulevard to the new Annex Building. The Design Revisions will include Modification of the existing: A. Mechanical Systems Design, to revise the Site Utility Design to include the design of a new Fire Protection Water Main, to extend from Roosevelt Boulevard to the new Annex Building. B. Construction Cost Estimates and Design Analysis/ Engineer's Report, to comply with the new Utility Design parameters. C. Construction Specifications, to comply with the new Utility Design. . , < 2. The Consultant shall provide Engineering Design Services to include Mechanical Engineering. 3. The Consultant shall provide Engineering Planning, Design, Specifications and Contract Documents appropriate for bidding the construction of the new Fire Protection Water Line as identified herein. These Services will encompass only the A/E Services outlined in the U.S. Department of Transportation, FAA AC No. 150/5100-14B, dated 11 /12/88 as Design Phase and Bidding or Negotiation Phase. 4. The Consultant will submit revised 100% Plans, Specifications and Design Report for Owner and Agency Review and will include provisions for responses to comments from same. 5. The Consultant will consult with Airport Representatives, County, State and Federal Government Agencies as necessary to clarify and define the requirements of the Project and review available data as necessary. SECTION II - ADDITIONAL SERVICES: Is hereby incorporated in its entirety by reference from Supplementary Agreement No. Three Dated October 18, 1995. ARTICLE II - GENERAL PROVISIONS SECTION I -.RESPONSIBILITIES OF THE OWNER: As a party to this Agreement, the Owner shall: A. Make available for Consultant's use all record drawings, maps, soil data, etc. that are readily available to the Owner. B. Designate a person to act with authority on Owner's behalf and respond in a timely manner to submissions by Consultant providing approvals and authorizations as appropriate so that work may continue at a normal pace. C. Pay all costs associated with special services authorized by the Owner. SECTION II -.METHOD OF PAYMENT: The Consultant agrees to provide professional services for those general services included in Article I - Scope of Services. The owner agrees to pay the Consultant as compensation for these services on a Lump Sum Basis as follows: BASIC SERVICES: DESIGN REVISIONS TO INCLUDE A NEW FIRE PROTECTION WATER MAIN FROM ROOSEVELT BOULEVARD TO THE NEW ANNEX BUILDING. Note: Quoted Man Hour Rates are per Supplemental Agreement Number Three dated October 18, 1995. DESCRIPTION: ENGINEER CADD AMOUNT 1. Utility Coordination: 12 hrs. @ $ 51.97+ 0 hrs. @ $48.04 = $623.64 2. Water Main Design/ Analysis: 12 hrs. @ $51.97+ 0 hrs. @ $48.04 = $623.64 3. Utility Plans: 8 hrs. @ $51.97+ 8 hrs. @ $48.04 = $800.08 4. Utility Details/ Specifications: 4 hrs. (a) $51.97+ 16 hrs. (a) $48.04 = $976.52 TOTALS: 36 hrs. @ $51.97+ 24 hrs. @ $48.04 = $3,047.88 Lump Sum 2 . .. • A. Partial payments for all services performed by the Consultant under the terms of the Agreement shall be made no more often than monthly to the Consultant by the Owner, based on percent complete of the work in progress. Payments shall be due and payable within thirty (30) days of the date of invoice. B. For services involving additional supplemental agreements the scope of services and maximum amount of compensation to be paid will be included therein. C. The Owner will pay the Consultant for special services performed by subconsultants at the actual invoice amount. SECTION III - MISCELLANEOUS: Is hereby incorporated in its entirety by reference from Supplementary Agreement No. Three dated October 18, 1995: IN WITNESS WHEREOF, the parties hereto have made and executed this Agreement in duplicate as of the day and year first above written.
