This letter is to serve as an amended addendum to the Lower Matecumbe Key
Agreement between Monroe County and BRW, Inc., for the Revision of the
Monroe County Comprehensive Plan.
Monroe County (hereinafter called the "COUNTY") must revise its comprehensive
plan in timely compliance with state laws and rules, including but not
limited to Chapter 9J-5 "Minimum Criteria for Review of Local Government
Comprehensive Plans and Determination of Compliance", Florida Administrative
Code, Chapter 9J-11 "Procedural Rule for Review of Local Government Compre-
hensive Plans and Plan Amendments", Florida Administrative Code, Chapter
9J-12 "Schedule for Submission of Revised Local Government Comprehensive
Plans", Florida Administrative Code, and Part II of Chapter 163 "County
and Municipal Planning and Land Development Regulation", Florida Statues
and obtain from the Florida Department of Community Affairs, (hereinafter
referred to as the "STATE"), a Notice of Intent finding the plan in compli-
ance with state laws and rules.
The COUNTY has determined that it is necessary, expedient and to the best
interest of the COUNTY to retain, obtain or employ BRW, Inc (hereinafter
referred to as the "Consultant") to render and perform consulting and other
professional services in connection with the revision of the Monroe County
Comprehensive Plan.
ARTICLE 1. SERVICES TO BE PROVIDED BY CONSULTANT
The CONSULTANT warrants to the COUNTY that the CONSULTANT is professionally
competent to perform and render the services to be performed and rendered
by the CONSULTANT pursuant to the provisions of this AGREEMENT. In reliance
by the COUNTY upon said warrant, the CONSULTANT shall perform and render
the professional planning services in the form of a work assignment described
in EXHIBIT "A" attached hereto and made a part of this AGREEMENT.

ARTICLE 2. TIME OF COMPLETION
The services to be rendered by the CONSULTANT shall be commenced upon written
notice from the COUNTY and the CONSULTANT shall make every effort to complete
the services defined in Article 1 above, in accordance with EXHIBIT "A",
provided that the COUNTY meets all obligations to the CONSULTANT described
in this AGREEMENT, including, but not limited to, the timely review of
work products, preparation of the public participation element, the scheduling
and timely completion of required workshops and hearing, receipt and review
of public comment within the proposed time frames. Where the COUNTY has
not met any obligation to the CONSULTANT, the CONSULTANT shall provide
notice to the COUNTY within 10 days indicating the nature of the obligation
not fulfilled. The CONSULTANT shall be entitled to additional time, if
it so requests, should the COUNTY cause delays.
ARTICLE 3. COMPENSATION
A. Certain work will be financed through the STATE's Local Government
Comprehensive Planning Assistance Program. The CONSULTANT will submit
all work products for this Local Government Planning Assistance Grant,
and submit an invoice for such work to Monroe County
B. Actual monthly compensation will be based on the schedule of fees con-
tained in EXHIBIT "B" of the Lower Matecumbe Key Community Plan Contract.
Total compensation to the CONSULTANT for work conducted under this AGREEMENT
shall not exceed $305,000.
C. If, through the COUNTY quality review, any work task is found to be
incomplete or inaccurate, the CONSULTANT will be notified of said deficien-
cies within 10 days of receipt and compensation for that portion of the
work may be withheld until the CONSULTANT corrects the deficiency.
D. Any additional work authorized by the COUNTY shall be reimbursed on
a direct expense and hourly basis in accordance with the rates provided
in EXHIBIT "B" of the Lower Matecumbe Key Community Plan Contract.
ARTICLE 4. DURATION AND TERMINATION
This AGREEMENT shall remain in full force and effect until all Tasks are
completed but not later than December 31, 1990.
ARTICLE 5. COVENANTS BY THE COUNTY
The COUNTY hereby covenants and agrees:
A. That the Assistant County Administrator for Growth Management of Monroe
County is hereby appointed as a single Authorized Representative of the
COUNTY with respect to any particular service to be performed by the CON-
SULTANT pursuant to this AGREEMENT. The Authorized Representative shall

have the authority to transmit instructions, receive information, interpret
and define the policy of the COUNTY and decisions pertinent to services
covered by this AGREEMENT. The Assistant County Administrator for Growth
Management shall have the right from time to time to designate such other
employees of the Monroe County Planning Department as said Assistant County
Administrator may deem advisable to serve as the Authorized Representative
in the absence of said Assistant County Administrator.
B. To make available at no cost to the CONSULTANT all existing records,
reports, maps, plans, aerial photographs, fiscal data and other existing
data which may resonably be required for work under this AGREEMENT.
C. To give prompt notice to the CONSULTANT whenever the COUNTY observes
or otherwise becomes aware of any defect in the day-to-day performance
of work under this AGREEMENT.
D. To give careful and reasonable consideration to the findings and recom-
mendations of the CONSULTANT and to respond in a timely manner so as not
to unduly delay the CONSULTANT's work called for by this AGREEMENT.
ARTICLE 6. INSURANCE
The CONSULTANT shall secure and maintain such insurance as will protect
it from claims under the Worker's Compensation Act. Further, the CONSULTANT
shall secure and maintain, during the period of this AGREEMENT, public
liability and property damage insurance which will protect it and the COUNTY
from claims for bodily injury, death or property damage which may arise
from the performance of its services under this AGREEMENT.
ARTICLE 7. LEGAL RESTRAINTS AND LIMITATIONS
The CONSULTANT acknowledges that the COUNTY, as a unit of local goverment
and a subdivision of the State of Florida, is subject to restraints, limita-
tions, regulations and controls imposed or administered pursuant to numerous
applicable laws, ordinance, rules and regulations of federal, state, regional
and certain local jurisdictional governmental agencies or authorities.
The CONSULTANT agrees that all professional services rendered or performed
by the CONSULTANT pursuant to the provisions of this AGREEMENT shall be
in compliance therewith.
ARTICLE 8. QUALITY OF WORK
The service shall be performed by the CONSULTANT to the reasonable satis-
faction of the COUNTY and all questions, difficulties and disputes of any
nature whatsoever that may arise under or by reason of this AGREEMENT,
the prosectuion and fulfillment of the services hereunder and the character,
quality, amount of the parties, shall be settled by recourse to litigation
under Florida law.

ARTICLE 9. NOTICES
All notice requests and authorization provided for herein shall be in writing
and shall be delivered or mailed addressed as follows:

or addressed to either party at such other address as such party shall
hereinafter furnish to the other party in writing. Each such notice, request
or authorization shall be deemed to have been duly given when so delivered,
or if mailed, when deposited in the mails, registered, postage paid.
ARTICLE 10. SUBCONSULTANTS
It is expected that the CONSULTANT shall have in-house capability to provide
all the services required by the AGREEMENT. When the CONSULTANT finds
it necessary to utilize the services of a subconsultant, the CONSULTANT
shall first obtain the approval of the COUNTY and then select a subconsultant
using a selection procedure acceptable to the COUNTY. The CONSULTANT shall
require each subconsultant to adhere to appropriate provisions of this
AGREEMENT. The utilization of any such subconsultant by the CONSULTANT
shall not relieve the CONSULTANT from any liability or responsiblitity
to the COUNTY pursuant to the provisions of this AGREEMENT.
ARTICLE 11. ACCEPTANCE
When the services of the CONSULTANT are complete, the CONSULTANT shall
notify the COUNTY in writing. Thereupon, the COUNTY, within thirty (30)
days, shall either provide its written acceptance or give the CONSULTANT
written notice of any unfinished services or deficiency to be corrected.
The CONSULTANT shall notify the COUNTY in writing when all such items have
been completed or corrected, and the COUNTY shall give its acceptance or
exception in writing within thirty (30) days thereafter; if such written
notice of acceptance or exception is not given within such a period of
time, the services shall be deemed to have been accepted by the COUNTY.
However, acceptance of the work performed by the CONSULTANT shall not be
construed to be an acceptance of improper work or defective or deficient
work.

ARTICLE 12. FORCE MAJEURE
Neither party shall be considered in default in performance of its obli-
gations hereunder to the extent that performance of such obligations, or
any of them is delayed or prevented by Force Majeure. Force Majeure shall
include but not be limited to hostility, revolution, civil commotion, strike,
epidemic, accident, fire, flood, wind, earthquake, lack of/or failure of
transportation facilities, any law, proclamation, regulation or ordinance
or other act of government, or any act of God or any cause whether of the
same or different nature, existing or future; provided that the cause whether
or not enumerated in this article, is beyond the control and without the
fault or negligence of the party seeking relief under this article. Prompt
notice should be given to either party, stating the cause and length of
the delay.
ARTICLE 13. RESTRICTIONS
BRW,INC. represents that it presently has no interest and shall not acquire
any interest, direct or indirect, which would acquire any interest, direct
or indirect, which would conflict in any manner with the performance of
services required to be performed under this agreement as provided in Section
122.311, et seq., Florida Statutes.
BRW, INC. further represents that, in the performance of the agreement,
no persons having any such interest shall be employed and are so bound.
BRW, INC. shall promptly notify the COUNTY in writing by certified mail
of all potential conflicts of interest for any prospective business asso-
ciation, interest or other circumstance which may influence or appear to
influence BRW's judgement or quality of services being provided hereunder.
Such written notification shall identify the prospective business association,
interest or circumstance, the nature of work that BRW,INC. may undertake
and request an opinion of the COUNTY as to whether the association, interest
or circumstance would, in the opinion of the COUNTY, constitute a conflict
of interest if entered into by BRW, INC. The COUNTY agrees to notify BRW,INC.
of its opinion by certified mail within 30 days of receipt of notification
by BRW, INC.. If in the opinion of the County, the prospective business
association, interest, or circumstance would not constitute a conflict
of interest by BRW, INC. the County shall so state in the notification
and BRW, INC. shall, at his opinion, enter into said association, interest
or circumstance and it shall be deemed not in conflict of interest with
respect to services provided to the COUNTY by BRW, INC. under the terms
of this agreement.
Further, such conflict provisions shall extend to BRW, INC. and its sub-
contractors for a period of two years beyond termination of this agreement.

ARTICLE 14. AUTHORITY TO EXECUTE
Each of the parties hereto covenants to the other party hereto that it
has lawful authority to enter into this AGREEMENT, that the governing or
managing body of each of these parties has approved this AGREEMENT and
that the governing or managing body of each of the parties has authorized
the execution of this AGREEMENT in the manner hereinafter set forth.

WORK PROGRAM
EXHIBIT A
1) Consultant's Responsibilities
It shall be the responsibility of the consultant
a) To carry out, on behalf of Monroe County, all transmittals of
intermediate deliverables, of draft documents, and of final
products to persons specified by Monroe County, but not to exceed
the number of persons/copies identified in section 2) below.
All requirements of 9J-11, F.A.C. regarding number of copies
to be transmitted for review of the comprehensive plan and other
documents, and regarding the nature of such transmittals, shall
also be met by the consultant. However, where 9J-11, F.A.C.
requirements and/or requests by Monroe County would result in
the reproduction and/or transmittal of more than the maximum
number of copies identified, Monore County will process an amendment
to this contract/Scope of Services, or otherwise provide for
the payment of additional reproduction and/or mailing/transmittal
costs not included in this Scope ofServices.
Transmittals shall be by methods also specified in 2) below.
b) To accomplish the completion of tasks identified in the section
on "Tasks Descriptions" below in substantial conformance with
the schedule shown in the section entitled "Project Schedule"
below. Deviation from the "Task Descriptions" and "Project
Schedule" may be accomplished subject to agreement by the Assis-
tant County Administrator for Planning for Monroe County (or
the BOCC, if required) and by the consultant.
2) Consultant's Transmittals
a) Number of Copies: i) Unless otherwise indicated in the section
on Task Descriptions, the consultant shall
provide 20 copies of materials developed
for presentation at each Citizen workshop.
ii) Unless otherwise indicated, the consultant
shall provide 20 copies of materials devel-
oped for presentation at each BOCC workshop.
iii) Unless otherwise indicated, to provide
Monroe County staff with 8 copies of all
memorandum, draft elements and other deliverables
to facilitate staff review. These copies
are included in the totals listed in i)
and ii) above.
iv) To provide the DCA, at time of submittal
of the draft TSD for unofficial review
(see Task Description for Task 6.2.) a
total of two copies.
v) To provide the DCA, at time of transmittal
of the proposed comprehensive plan, the
Technical Support Document, or at time of
transmittal of the adopted comprehensive
plan with the requuired number of copies
pursuant to 9J-11, F.A.C.
b) Format for Transmittals
All documents representing draft materials, or intermediate
deliverables, and including draft plan elements or memoranda
representing conclusions which require staff or other review,
shall be transmitted in the following format unless otherwise
agreed upon by the consultant and Monroe County staff.
- for documents less than 25 pages - loose leaf format, stapled
as necessary
- for documents of between 25 and 150 pages, spiral bound,
with or without card stock covers as necessary
- for documents exceeding 150 pages and for documents
representing complete drafts or final copies of the TSD,
complete plan document, 3-ring binders with appropriate cover
"slipins", as necessary.
c) Method of Transmittal
Intermediate, draft or final work products shall be transmitted,
as determined to be necessary by the consultant, after consul-
tation with Monroe County staff, generally as follows:
- for documents subject to review prior to workshop or hearings,
by first class mail.
- for documents subject for review at workshops or hearings,
by hand at the workshop or hearing
- for documents transmitted to the DCA and to other local governments,
by certified mail, return receipt requested.
3) Monroe County Staff Responsibilities
It shall be the responsibility of Monroe County staff to:
a) Carry out all tasks asssigned to staff in a timely manner to
facilitate the completion of this Scope of Services on schedule.
b) Provide for access by the consultant to all other Monroe County
department personnel, as requested by the consultant, for the
purposes of obtaining information, discussing items involving
that department, and facilitating the review of consultant's
products by that department, within a timeframe conductive to
the timely completion of each task identified in this Scope
of Services.
c) Provide, to the consultant, in a timely manner and as necessary,
mailing addresses, cover materials, meeting/workshop and/or
public hearing agenda, and other items which may be necessary
to facilitate and/or serve as attachments to scheduled transmittals
of materials to the DCA, and to other persons as deemed necessary,
in order to provide for the authorized transmittal of materials
to all parties described above.
TASK 1 - PHASE 1 DATA BASE DEVELOPMENT
Three subtasks will be accomplished under Task 1. These are listed below,
and are described in sections 1.1, 1.2, 1.3 following.
1.1. Preliminary Data Collection
1.2. Development of Land Use - Related Multipliers
1.3. Generalized Future Land Use and Associated Population projections.
1.1. Preliminary Data Collection
1.1.1. Objectives
a) To collect data items required for completion of other sub -
tasks in Task 1
1.1.2. Consultant's Responsibilities
a) Utilize population projections obtained from BEBRs for Monroe
County, and adjust these using (where available) population
projections for incorporated areas of Monroe County, to arrive
at residential and seasonal population projections for years
2000 and 2010 for unincorporated Monroe County. If projections
for incorporated areas are not available then the consultant
shall generate such data, with consultation with Monroe County
staff and with DCA's concurrence on methodology utilized,
pursuant to 9J-5.005 (2) (e), F.A.C.
b) Obtain other data as required to complete Task 1 from the
State Data Center, or other sources. Such items may include
projections of persons -per -household multipliers, and other
data items.
c) Obtain and evaluate data from any Transportation Studies
utilized for base year (1980) validation of the transportation
modeling effort. Such data may be substituted for, or be
utilized to assist in the verification of, extimates of unin-
corporated Monroe County's population and/or be utilized
to generate additional data required. Also, collect and
evaluate data on existing conditions of the street/highway
including transportation systems data regarding airport facil-
ities. This also includes review of existing documents,
and goals/objectives/policies regarding transportation systems
and their plans. Monroe County Staff assistance directed
toward obtaining this data will be required.
d) To identify, with Monroe County staff assistance, for all
services provided by Monroe County, the unit (or, if necessary,
alternative units) of measurement by which service level ade-
quacy is likely to be measured, and obtain preliminary
estimates of recommended Levels of Service for each public
service or system. Identification of the measurement criteria
with which Level of Service may be quantified or decided is
preferred at time of this subtask so that population and future
development projections, to be developed under section 1.3
below, can be accomplished in a manner consistent or compatible
with these measurement criteria, which will permit the direct
use of projections generated under section 1.3 during Level
of Service analysis in subsequent tasks in this Scope of Services.
1.1.3. Monroe County Staff Responsibilities
a) To provide the consultant with access to Building Permit
data and Certificate of Occupancy data for years 1980-1987,
subject to availability.
b) To assist the consultant by expediting responses from county
agencies/departments.
c) To review data items generated, and to be available for con-
sultation when alternative data collection methodologies are
being considered.

1.2.1. Objectives
a) To develop and quantify land use interrelationships which
will characterize future development in Monroe County, for
the purpose of assisting in generating projections of future
development by land use type.
1.2.2. Consultant's Responsibilities
a) Develop multipliers/indices which may be utilized to estimate
future land uses supportable by growth for years 2000 and
2010 in Monroe County. These may include "retail sales/square
foot of gross floor area", "percentage by dwelling unit type
for projected housing demand", "employees per hotel room",
and other indices/multipliers which will be utilized to assist
in projecting future land uses for Monroe County.
1.2.3. Monroe County Staff Responsibilities
a) Review and provide comment on multipliers/indices developed
for purposes of this subtask
1.2.4. Products
a) Quantified "land use -related" multiplers, and other numerical
constants to be utilized to assist the development of future
land use projections for Monroe County.
b) Documentation of mathematical expressions/formulae which utilize
the multipliers to generate projections of future development.
1.3 Generalized Projections
1.3.1. Objectives
a) To project the amount of future development for unincorpor-
ated Monroe County by land use type, for years 2000 and 2010.
b) To project the total population associated with the projected
development by land use types for unincorporated Monroe County
for years 2000 and 2010.
c) To project the amount of future development and population
by utilizing land use, population and employment group categories
suitable for ( and compatible with) transportation modeling,
suitable for projecting future public facility needs, and suitable
for manipulation in order to engage in the mapping of projected
land uses by well-defined future land use categories consistent
with rule 9J-5.006, F.A.C.
1.3.2. Consultant's Responsiblities
a) To utilize the results of the existing land use survey for unincor-
porated Monroe County, population projections for unincorporated
Monroe County, results and conclusions generated in subsection
1.2 above, inventories of approved development, and other data
to generate projections of future land uses for years 2000 and
2010 by land use type. These development projections shall
be represented in terms of square footages, dwelling units,
acreages under parks and other public facilities, and by other
units of measurement as necessary to complete other tasks in
this Scope of Services.
1.3.3. Monroe County Staff Responsibilities
a) Review and comment on results of future development, and population,
projections for unincorporated Monroe County.
1.3.4. Products
a) Projections of future development for years 2000 and 2010 for
unincorporated Monroe County by land use type, and at a level
of detail sufficient to provide for transferability to categories
on a Future Land use Map developed pursuant to 9J-5.006 (4),
F.A.C. (see also b below).
b) Population projections associated with each residential land
use type referenced in item 1.3.4. a) above, for years 2000
and 2010.
TASK 2 - DEVELOPMENT AND EVALUATION OF ALTERNATIVE PRELIMINARY LAND USE
CONCEPTS FOR FUTURE DEVELOPMENT FOR YEAR 2010
Six subtasks will be accomplished under Task 2. These are listed below
and are described in Sections 2.1 through 2.6 following.
2.1 Graphic representation of Existing Land Use Patterns and Location/Land
Uses for Major Approved Developments in Unincorporated Monroe County.
2.2 Graphic Representation of Opportunities/Constraints for Future Develop-
ment.
2.3 Develop Locational Standards for Future Land Uses in Unincorporated
Monroe County.
2.4 Develop preliminary goals, objectives and policies
2.5 Develop alternative Future Land Use Concept (Year 2010)
2.6 Develop Recommended Future Land Use Concept
2.1 Graphic Representation - Existing/Approved Developments
2.1.1. Objectives
a) To graphically represent the nature and intensity/density
of existing and approved land uses for unincorporated Monroe
County.
2.1.2. Consultant's Responsiblities
a) To utilize the results of the existing land use survey for
unincorporated Monroe County to provide a graphic summary
of existing land use patterns. Acreage totals by Township
and by Section will be utilized, along with inspection of
existing land use maps to generate existing land use "summary"
graphics for unincorporated Monroe County ( see also b) below,
and 2.1.4.).
b) To utilize information on approved zoning districts and Devel-
opments of Regional Impact to produce an overlay graphic
for the existing land use ("summary") map. This overlay
will indicate approved development not reflected on the existing
land use summary graphic and will utilize the same land use
categories as those utilized on the existing land use "summary"
graphic to be developed in subsection 2.1.1.a) above ( see
also 2.1.4. below).
2.1.3. Monroe County Staff Responsibilities
a) To provide consultant with two copies of the Monroe County
Zoning Atlas at the start of this task (see also c) below),
in lieu of the consultant making these copies.
b) To review map/overlay developed under 2.1.2. a) and b) above.
c) To provide the consultant with information on DRI applications
and approved rezoning which are either not reflected on the
copy of the zoning atlas provided pursuant to a) above, or
are approved following start of this task. This is to provide
current information to the consultant on development approvals
to be recognized during development of the Future Land Use
Map.
2.1.4. Products
a) Map and overlay developed under subsection 3.1.2.
b) above.
2.2 Graphic Representation of Opportunities/Constraints for Future Development
2.2.1. Objectives
a) To map areas subject to development constraints, and to show
locations of major physical features (natural or man-made)
which represent major opportunties for development.
b) To, through use of an overlay mapping procedure, show areas
for which development is either preferred, or is subject
to constraints.
2.2.2. Consultant's Responsibilities
a) To gather data on the spatial distribution/locations which
are associated with significant opportunities for, or constraints
on, future development. These will include:
- major wetlands systems (marine, estuarine, and any isolated
freshwater systems)
- areas currently used, or programmed for use as effluent
disposal fields, or sanitary landfill or ashfill sites
- areas subject to coastal flooding with wave action (velocity
zone)
- Major existing and future roadways, and planned roadway
alignments and associated current volume/capacity constraints
or opportunities
- Aircraft Noise Impact areas associated with the Key West
and Marathon Airports
- Major recreational areas
- Current and planned water/wastewater treatment facilities
and service areas.
b) The consultant will develop maps and overlays depicting these
and other (where applicable), opportunities and constraints
(see also 2.2.3. below, and 2.3.1. below, and 2.5.2
2.2.3. Monroe County Staff Responsibilities
To ensure that other county departments respond in a timely
manner to requests from the consultant to provide data to be
used in the development of map(s) described in subsection 2.2.2.a)
above.
2.2.4. Products
a) Maps showin information on opportunities and constraints collected
in 2.2.2. a? above.
2.3. Develop Locational Standards for Future Land Uses
2.3.1. Objectives
To identify general standards for the preferred location of
various land use intensities utilizing sound planning principles.
Such standards shall be developed with regard to the specifics
of Monroe County, and recognize opportunities and constraints
identified in subsection 2.3.2.a)
below.
2.3.2. Consultant's Responsibilities
a) Identify general locational standards for land use intensities
(see also 2.3.1. above, 2.3.3.a) and 2.3.4. below).
b) To recognize current community objectives/policies regarding
the future development of the U.S. 1 corridor and other areas
for which policy has emerged during, or since, adoption of
The Florida Keys Comprehensive Plan. These policies will be
considered in identifying general standards for the location
of various land use intensities, but are subject to reevaluation
(see also 2.3.4. below).
2.3.3. Monroe County Staff Responsiblities
a) Provide input for the development of, and review and provide
comment on the general standards developed under subsection
2.3.3.a) above.
b) Provide information to the consultant on current land use and
comprehensive planning policies for areas of unincorporated
Monroe County to update consultant on the community's land
use objectives.
2.3.4. Listing, by land use intensity category, of appropriate general
standards used to define areas suitable for future development.
These standards may be based on sound planning principles,
may refer to characteristics identified pursuant to subsection
2.2.2. above, may reflect community objectives/policies referred
to in subsection 3.3.2.b) above, or be developed by other means.
2.4. Develop Preliminary Goals, Objectives, and Policies (GOP's)
2.4.1. Objectives
a) To draft GOPs for unincorporated Monroe County's future
development.
b) To generate conceptual GOP concepts so as to facilitiate
discussion by staff and the BOCC for purposes of selecting
more specific GOP's (see 7.2 below) and formulatin a recommended
Land Use (LU) plan concept ( see section 2.6 below.
2.4.2. Consultant's Responsibilities
To develop, pursuant to subsection 2.2.2 above, preliminary
conceptual GOPs. The GOPs at this stage may utilize des-
criptions and concepts not reflected in existing analysis
and descriptions and may utilize broad ranges of terminology
to describe issues and concepts.
2.4.3. Monroe County Staff Responsibilities
To review and provide comment on the alternative GOPs, arrange
the BOCC discussion meeting and insure that direction from
the BOCC is voted on.
2.4.4. Products
a) Broad GOPs for 2010, suitable for continued preparation
of Comprehensive Plan Elements and selecting the appropriate
and preferred land use concept in Section 2.6 below
2.5 Develop Alternative Land Use Concepts for Year 2010
2.5.1. Objectives
a) To graphically illustrate different land use concepts for
unincorporated Monroe County's future development.
b) To generate alternative future land use concepts so as to
facilitate discussion by staff and the BOCC for purposes
of selecting a recommended future land use concept.
2.5.2. Consultant's Responsibilities
To utilize overlays developed pursuant to subsection 2.2.2.
above to prepare land use concepts generally meeting the
locational standards. The land use concepts may utilize
descriptions or categories not reflected on any overlay
and may utilize broad ranges of intensity, activity centers
and other broadly defined terms to define the land use concepts
which are developed.
2.5.3. Monroe County Staff Responsibilities
To review and provide comment on the alternative land use
concepts.
2.5.4. Products
a) Alternative land use concept maps for 2010, suitable
for presentation to the BOCC at workshops. A maximum
of three alternatives will be developed.
2.6 Develop a Recommended Land Use Concept Map for Year 2010
2.6.1 Objectives
a) To utilize staff reviews to formulate a recommended land
use concept for transmittal to the BOCC for their review.
b) To describe the rationale for the land use patterns re-
flected on the recommended Land Use Concept Map for
presentation to the BOCC workshop.
2.6.2. Consultant's Responsibilities
a) To develop a "final" Land Use Concept Map to be recom-
mended to the BOCC at a public workshop. This selected
concept will be developed after consideration of staff
comments on alternative concepts presented pursuant to
2.5 above.
b) To prepare, and discuss at the BOCC workshop, a descrip-
tion of the rationale associated with the recommended
Land Use Concept Map.
c) To transmit a memorandum to Monroe County staff providing
description/rationale of the recommended Concept Map,
for use as handout materials at the BOCC workshop.
d) To transmit to BOCC member, and other parties if neces-
sary, copies of handout materials provided by the consultant
for use at the BOCC workshop. Such materials should
be transmitted to BOCC members one week prior to the
joint workshop.
2.6.3. Monroe County Staff Responsibilities
a) To schedule a public workshop for consultant's presen-
tation of the preferred Land Use Concept Map and associated
rationale. This workshop is to be scheduled to occur
during week sixteen (16) following contract execution.
2.6.4. Products
a) Land Use Concept Map to be recommended to the BOCC.
b) Memorandum outlining rationale associated with the recom-
mended Land Use Concept Map.
TASK 3 - DISTRIBUTION OF FUTURE DEVELOPMENT BASED ON SELECTED LAND USE
CONCEPT MAP.
This task involves two processes, as follows:
a) Map Traffic Analysis Zones and Water/Wastewater/Solid Waste Planning
Areas to facilitate b) below, and
b) Assignment of 2010 Development Projections by Traffic Analysis
Zone and by Water/Wastewater/Solid Waste Planning Areas, in a manner
consistent with the recommended Land Use Concept Plan.
3.1. Map Traffic Analysis Zones and Water
Areas and Assign 2010 Development, P,
by These Sub -Areas of Monroe County.
3.1.1. Objectives
Wastewater/Solid Waste Planning
pulation and Employment Projections
a) To provide "subsectors" of Monroe County sized and located
so as to permit the analysis of level of service and asso-
ciated capital improvements to provide adequate roadways
and water/wastewater/solid waste systems to provide services
for year 2010 development.
b) To provide a spatial matrix on which future development
(and associated employment and population) can be distri-
buted, so as to produce a detailed spatial distribution
of future (2010) development in Monroe County.
c) To "distribute" future development anticipated for Monroe
County in a manner so as to facilitate the development
of, and then the "placement" of recommended categories
for the Future Land Use Plan Map.
d) To provide a basis for Level of Service analyses and other
analyses necessary for development of the Traffic Circu-
lation, Potable Water, Sanitary Sewer and Solid Waste
sub -elements of the comprehensive plan.
e) To develop a map showing distribution of future development
(2010) to facilitiate the periodic re-evaluation in up-
coming years of the validity of the land use assumption
used to assist in the development of the Future Land Use
Element to be developed pursuant to this Scope of Services.
3.1.2. Consultant's Responsibilities
a) To obtain maps and background data on Traffic Analysis
Zones (TAZs) from the Florida State Department of Trans-
portation staff, and maps of appropriate water, waste-
water and solid waste planning areas from the Monroe County
Public Works Department. These maps will be revised,
as necessary, to facilitate assignment of development
projections and other data for unincorporated Monroe County
required for transportation network modeling and for water
demand and wastewater flow projections.
b) To utilize the recommended Land Use Concept Map developed
in Section 2.6 above, and as revised and concurred with
by the BOCC, to estimate development projections for year
2010 and other related data by Traffic Analysis Zone (TAZ)
and by water/wasterwater/solid waste planning areas.
This data will be graphically represented. This subtask
entails the use of the countywide development projections
for year 2010 developed in section 1.3 above, and the
use of land -use related multipliers developed in section
1.2 above. Resident and seasonal population will be totaled
for this purpose to provide development projections by
sub -area of Monroe County which reflect a "maximum" demand
on public infrastructure and services ( see also c) below,
and 3.1.3.b) below).
c) To provide ( and transmit) maps and data to Monroe County
staff for review of the development/population projections
by TAZ and by water/wastewater/solid waste planning areas,
and to receive comments from staff as to consistency of
the projections with the selected Land Use Concept Map
developed under 2.6 above, and to also receive and address
comments/recommendations as to changes to the proposed
development projections developed under 3.1.2.b) above
(see also 4.1. b) and c) below, and 5.1 below).
3.1.3. Monroe County Staff Responsibilities
To review and provide comment on the development/population
"distribution" by TAZ and by water/wastewater/solid waste
planning area, regarding consistency with the selected
Land Use Concept Map developed in subsection 2.6 above.
3.1.4. Products
a) A spatial distribution of year 2010 development and associated
variables, revised as necessary pursuant to Monroe County
staff recommendations (see also 4.1.c) below, and 4.2.b)
below, and 5.2.2.a) below).
b) Maps of Traffic Analysis Zones and water/wastewater/solid
waste planning areas for subsequent tasks.
TASK 4 - PRELIMINARY ANALYSIS OF ADEQUACY OF CURRENTLY PLANNED
TRANSPORTATION, WATER/WASTEWATER SYSTEMS AND SOLID WASTE
DISPOSAL
4.1 Objectives
a) To evaluate the level of adequacy of the adopted " Major Thorough-
fare Plan" and "Right -of -Way Needs" Maps' network for accommodating
future development in Monroe County.
b) To provide a comparison of the water/wastewater and solid waste
demand and use projections generated using the 2010 development
"distributions" produced in subsection 3.1 above, with those
projections indicated in adopted water and 201 wastewater systems
plans.
c) To provide a generalized countywide estimate (for the principal
street and highway system), and generalized planning area estimates
(for water,wastewater supply/treatment systems and solid waste
disposal), of the impact on each public facility which the 2010
development distribution (developed in 3.1) above is anticipated
to have on the planned Major Thoroughfare system (for transportation),
and is anticipated to have on the adopted 201 Wastewater, adopted
water system plans and solid waste disposal plans for Monroe
County. Also, to indicate the level of adequacy of the planned
road network and water/wastewater/solid waste systems to accomodate
year 2010 development projection, as distributed pursuant to
the products described under subsection 3.1. above.
4.2 Consultant's Responsibilities
a) To develop flow factors, cost factors, disposal factors and other
assumptions which are concurred with by various agencies responsible
for road network, water/wastewater systems and solid waste planning
and improvements. These are to be used in conducting analyses
necessary for this and other tasks.
b) To utilize 2010 development/population/employment by TAZ (see
subsection 3.1 above) to evaluate the adequacy of the adopted
Major Thoroughfare Plan's road network to provide traffic circu-
lation for year 2010. This will involve the use of existing
FDOT Models or comparable model to accomplish an evaluation of
the adequacy of the network to accomodate 2010 traffic.
c) To utilize 2010 development projections by water/wastewater/solid
waste planning areas to assess the adequacy of: the adopted 201
Plan, the adopted water system plan and any adopted or draft
solid waste management programs for Monroe County, to provide
future water supply, and handle future wastewater flows and handle
future solid waste disposal of deficiencies, if any, will be
reported (see also 4.3.a) below).
d) To provide (and transmit) materials containing results of analyses
conducted in 4.2.b) and c) above to Monroe County planning staff
for review and comment. Also, to meet with other county departments
as requested by Monroe County staff.
e) To obtain input from Monroe County departments and other agencies
in the form of guidelines and suggestions for the modification
of roadway, water, solid waste and wastewater system plans, where
necessary, to accommodate future demand for these facilities.
4.3. Monroe County Staff Responsibilities
a) To review and provide comment on consultant's findings from sub-
section 4.2.b) and c) above.
b) To review consultant's product (see 4.4.a) below), provide comments/
recommendations on same, and coordinate meetings as may be necessary
with the consultant and with other county agencies and/or authorities.
4.4. Products
A summary assessment to Monroe County staff in the form of a
brief memorandum of any deficiencies in the current capital facil-
ities' plans for transportation (roadways), water/wastewater
systems and solid waste disposal plans as determined by those
plans' capabilities to accomodate year 2010 development projections
at adequate levels of service (see also 4.3.b) above).
TASK 5 - DEVELOP DETAILED FUTURE LAND USE MAP
This task will be overlapped with Tasks 6 and 7, with analysis and products
associated with Tasks 6 and 7 serving as inputs into the process described
in Task 5.
Task 5 has two subtasks as follows:
5.1. Develop and Conduct Reviews of Proposed Categories and Applicable
Locational Criteria for Defining Future Land Uses on the Future Land
Use Map, and
5.2 Apply Land Use Categories to Develop a Detailed Future Land Use Map
(first draft)
5.1 Develop Proposed Categories for Defining Future Land Uses on the
Future Land Use Map
5.1.1. Objectives
a) To develop proposed categories for the future Land Use
Map consistent with Rule 9J-5.006(4)(a) and (b), F.A.C.
and to implement rule 9J-5.006(3)(c)7., F.A.C. These
proposed land use categories should also exercise the
option defined in 9J-5.006(4)(c), F.A.C. to develop "mixed
use" categories permitting combinations of development
types under discrete land use categories.
b) To facilitate the development of the type and amount of
land uses shown on the map developed under Task 2.6 above.
5.1.2. Consultant's Responsibilities
a) To utilize the Existing Land Use Survey data, and the
analyses conducted pursuant to 9J-5.006(2)(a), F.A.C.
(see Task 6), other analyses and data developed pursuant
to 9J-5 F.A.C. and proposed policies regarding implemen-
tation of the Future Land Use Map located in other elements
of the comprehensive plan (from Task 7) to develop a range
of categories suitable for application to areas of Monroe
County. Such categories shall also meet or exceed re-
quirements of 9J-5.006(4), F.A.C.
b) To develop locational criteria, by categories shown on
the first draft Future Land Use Map, for the appropriate
location of each use or combinatiion of uses to be indi-
cated on the Future Land Use Map. Also to develop other
assumptions which may be necessary for development of
the Future Land Use Map. ( See also 5.2.2.d) below.)
c) Investigate and recommend, where feasible, any develop-
ment incentive provisions associated with the application
of proposed land use categories. Such provisions may
address deficiencies identified in the Florida Keys Com-
prehensive Plan.
d) Develop, where appropriate, Future Land Use Map categories
which may aid the implementation of policies developed
under Task 7.2 below.
e) To develop Future Land Use categories which are suitable
for implementation through land development regulations
to be developed pursuant to ch. 163.3202, F.S.
f) To transmit materials for, and conduct a workshop during
week 24 following contract execution with the BOCC for
presentation of, and the receipt of comments/recommendations
on, the proposed land use categories and locational criteria
developed in a) and b) above and to utilize Monroe County
staffs' and the BOCC's input/recommendations provided
at this workshop to revise, as necessary, recommended
categories and their locational criteria to be utilized
on the Future Land Use Map. Issues requiring staff and
BOCC input at the referenced workshop may include:
- determining the degree to which current zoning districts
are used to define categories on the Future Land Use
Map.
- determining the appropriate maximums for development
intensities and densities in Monroe County.
- the application of development credits for environmen-
tally sensitive areas and for the provision of public
facilities and the implementation of any system of
development credits through the application of categories
on the Future Land Use Map, as a mechanism for natural
resource protection.
- the use of development incentive provisions based on
the adequacy and availability of public facilities
and services.
- the degree to which mixed use categories should be
utilized on the Future Land Use Map and the context
within which such categories should be used (see also
g) below).
g) To transmit, following revisions made to the proposed
land use cate ories and associated locational criteria
pursuant to 4? above, revised land use categories and
locational criteria to the BOCC for purposes of a workshop
to be conducted pursuant to h) below.
h) To conduct a workshop of the BOCC for the purposes of
presenting, and receiving comments/recommendations on,
the proposed land use categories and associated locational
criteria. Also, consultant will conduct revisions, as
necessary, to the categories and/or criteria pursuant
to BOCC comments/recommendations (see also 5.1.3.d) below).
5.1.3. Monroe County Staff Responsibilities
a) To provide input on, and conduct review of, proposed
land use categories developed pursuant to the objectives
identified in 5.1.1. above, as necessary.
b) To provide input pursuant to this task, and pursuant
to Task 7, on the utilization of proposed policies located
in other elements of the comprehensive plan.
5.1.4. Products
A proposed system of future land use categories (see
5.2.2.a) below.
5.2 Apply Land Use Categories to Develop a First Draft Future Land Use
Map
5.2.1. Objectives
a) To distribute the various categories of future land uses
such that all areas in Monroe County are designated for
one or more future land uses.
b) To assign proposed land use categories to parcels of land/
areas of Monroe County such that, at a minimum, all develop-
ment projected and distributed ( In Task 3 above) can
be accommodated.
c) To utilize the Future Land

5.2.2. Consultant's Responsibilities

subsection 7.2 below, and which interrelate with the
categories shown on the Future Land Use Map (first draft),
into the process described in subsection 5.2.2.b) above.
c) To utilize data developed pursuant to Tasks 2,6 and 7
(e.g. existing land use and zoning data, data on the
location of natural and/or man-made boundaries, an inventory
of natural resources and the location and nature of current/
programmed/planned public facilities and public service
areas to identify boundaries to be utilized for describing
the extent of each area designated for one or more future
uses.
d) To apply locational criteria developed in subsection 5.1.2.b)
above, pursuant also to limitations defined in items a),b),
c) above, to determine and map appropriate locations for
areas/parcels to be shown under each proposed future land
use category on the Future Land Use Map. (See also 5.1.2.b)
above).
e) To transmit materials for and assist the County staff in
the conducting of workshops for the purpose of reviewing
and providing comment on assumptions used to develop the
draft Future Land Use Map, and on the detailed pattern
of future land uses shown on the draft map. Also to respond,
if necessary, to recommedations by the staff and BOCC for
change to the draft Future Land Use Map.
5.2.3 Monroe County Staff Responsibilities
a) To review, and provide input on, consultant's drafts of
the Future Land Use Map, on locational criteria used to
develop such map, and to provide comment on other assump-
tions utilized in developing such map.
b) To schedule BOCC workshops and public participation meeting
as designated in Exhibit A for review of assumptions to
be utilized in development of the Future Land Use Map
(first draft), and for review of the first draft Future
Land Use Map, and for discussion and obtaining recommendations
on policy (see Task 7) which interacts with the Future
Land Use Map. Such workshops may be scheduled in conjuction
with additional activities ongoing in Task 7, and shall
be subject to limitations described in subsection 5.1.3.c)
above.
5.2.4. Products
a) A first draft Future Land Use Map consistent with require-
ments of Rule 9J-5, F.A.C. Also, a description of each
land use category utilized on the first draft Future Land
Use Map identifying permitted uses and density/intensity
and identifying policies (see Task 7) which impact the
application of each category (see also 5.3.2.b) below).
b) A memorandum documenting locational criteria utilized
in development of the Future Land Use Map described in
a) above, and documenting other assumptions utilized in
developing the first draft map (see also 5.3.2.b) below).
5.3. BOCC Review of First Draft Future Land Use (Plan) Ma
5.3.1. Objectives
a) To facilitate BOCC review of the consultant's first draft
of the Future Land Use Map.
b) To facilitate public discussion before the BOCC at a publicly -
noticed workshop on the (PARCEL -SPECIFIC) land use categories
proposed on the first draft Future Land Use Map, and obtain
public comments on same, particularly from property owners
regarding the designation of their property on the map,
and provide opportunity for owners and interested parties
to request changes to the proposed (draft) Future Land
Use Map.
c) To provide an opportunity for consultant to provide recom-
mendations to the BOCC on requests to redesignate areas
or individual parcels on the draft Future Land Use Map.
d) To gain BOCC concurrence (not final approval) on the first
draft Future Land Use Map to be utilized for public facilities
impact analyses.
5.3.2. Consultant's Responsibilities
a) To transmit the products identified in subsection 5.2.4
a) and b) above (future land use categories, related
policies, and draft Future Land Use Map), and to present
same at a publicly -noticed workshop of the BOCC, to re-
ceive comment on the consistency of the proposed Future
Land Use Map with the selected Land Use Concept Map and
associated rationale (described as a product under sub-
sections 2.6.4. above). Comment from the BOCC shall be
noted by the consultant and be addressed by the consul-
tant during work under subsection 7.3.2.a) below. The
BOCC shall limit public comment on the Future Land Use
Map during this hearing to comment of the nature of the
categories of Future Land Uses (see 5.1.4.a) proposed
for use, and on locational criteria used to assist in
making decisions on the location of various designations
on the Future Land Use Map. Public comment on parcel -
specific land use designations shall be deferred to public
participation workshops arranged by Monroe County during
the week of March 18, 1990.
c) To assist the Monroe County staff with a series of duly -
noticed public participation workshops throughout Monroe
County, and to transmit materials for such workshops to
the staff, to explain the nature and function of the draft
Future Land Use Map, to provide information on the asso-
ciated categories of land uses and applicable regulations,
and on policy interrelated to the draft Future Land Use
Map. Such public participation shall be conducted for
the purpose of providing information to residents, property
owners, and other interested individuals on the proposed
category applied on the first draft Future Land Use Map
to each individual parcel within each subarea for which
a workshop is being conducted. A maximum of three (3)
such workshops shall be conducted. The consultant shall
be responsible for responding to questions regarding the
proposed land use classification system, the first draft
Future Land Use Map, and associated policies affecting
the implementation of the proposed categories.
5.3.3. Monroe County Staff Responsibilities
a) To establish the boundaries of a maximum of three (3)
subareas of Monroe County consistent with subsection
5.3.2.a) above for the purposes of conducting public
participation on the first draft Future Land Use Map
pursuant to subsection 5.3.2.c) above. The consultant
will assist in determining such boundaries at the request
of Monroe County staff.
b) To schedule, and to provide notice to the public of the
BOCC workshop to be conducted during week 27. And provide
notice for public participation workshops conducted pur-
suant to subsection 5.3.2.c) above.
c) To schedule and provide public notice for a maximum of
three (3) public workshops conducted pursuant to 5.3.2.c)
above, and to be held during week 28.
d) To maintain record of the proceedings of workshops des-
cribed in subsections 5.3.2.b) and c) above, for the
purpose of documenting the public participation program.
e) To provide recordation of requests for changes to the
first draft Future Land Use Map submitted by property
owners or their authorized representatives, or by other
residents of Monroe County. Notice for the Public Partici-
pation workshops shall also describe a procedure by which
requests for change can be submitted to the consultant
for consideration following the conclusion of the workshop.
Also, notice shall be provided at the workshops conducted
pursuant to this section of a date certain by which all
requests for change should be submitted in order to be
considered for inclusion/change on the final recommended
Future Land Use Map described in 9.4. below. Such date
shall be set for a maximum of 10 working days following
the date of the final workshop conducted pursuant to this
subsection.
f) To provide comment on consultant's recommendations de-
veloped in response to any requests for change to proposed
land use categories and/or their proposed placement on
the first draft Future Land Use Map.
5.3.4. Products
a) A (proposed) first draft Future Land Use Map, revised
as necessary pursuant to comments/recommendations resulting
from BOCC workshops described in section 5.3.2. above
(see also 7.3.2.a) below).
b) Policies, as appropriate ( and if necessary), for which
implementation is tied to the Future Land Use Map, and
which are developed pursuant to Task 7 below, as revised
following BOCC workshops conducted under section 5.3.2.
above.
TASK 6 - PHASE II DATA COLLECTION AND ANALYSIS BY ELEMENT
This task is overlapped with Tasks 5 and 7. Certain data items developed
pursuant to this task serve as inputs for Task 5 (e.g. see 5.1.2.a) above),
and for inputs for Task 7.
This task is comprised of two subtasks, as follows:
6.1. Data Collection and Analysis Pursuant to Rule 9J-5, F.A.C.
6.2 Data and Analysis Compilation into a Draft Technical Support Document
(TSD) and obtain an "Unofficial" Department of Community Affairs Review
of the TSD.
These subtasks are detailed below.
6.1. Data Collection and Analysis Pursuant to Rule 9J-5. F.A.C.
6.1.1. Objectives
a), To collect, for each element identified as a required
comprehensive plan element by, FAC 9J-5 all data required
by 9J5, for each element, and to document such data.
b) To conduct all analyses identified in 9J-5 for each com-
prehensive plan element, and also conduct other analyses
if determined by the consultant to be necessary for pur-
poses of preparing a defensible comprehensive plan for
Monroe County. Also, to document such analyses and iden-
tify conclusions developed from such analyses.
c) To provide data and analyses useful for development of
work products identified under Tasks 5,7,and 8.
6.1.2. Consultant's Responsibilities
a) To carry out primary and secondary data collection and
analyze such data to whenever possible, generate conclusions/
findings useful for preparation of work products identified
in Tasks 5,7, and 8 of this Scope of Services (see also
6.2.1.c) below).
b) To resolve, by means of negotiation with the Florida Department
of Community Affairs personnel responsible for pre -adoption
and post -adoption (compliance) reviews of the comprehensive
plan for Monroe County pursuant to s.163.3184 (6) and
(8), F.S., any questions arising from either:
- interpretation of 9J-5 data and analysis requirements,
or
- the use of substitute data in lieu of required data
identified in 9J-5, or
6.2
- interpretation of 9J-5.005(2) (a), F.A.C. requiring
linkage between plan goals, objectives and policies,
and data collection and analysis conducted pursuant
to 9J-5, or
- questions concerning DCA approval of data collection
and/or analysis methodologies.
c) Develop data and analyses in a manner condusive to the
update of such data, and conclusive to periodic reeval-
uation of conclusions drawn from that data, in order to
facilitate the implementation of 9J-5.005 (7) (b), F.A.C.
6.1.3. Monroe County Staff Responsibilities
a) To facilitate, to the maximum extent possible, the pro-
vision of available data to the consultant (in a timely
manner) from other county agencies.
6.1.4. a) Data and analysis conducted pursuant to 9J-5, F.A.C. (see
also 5.1.2.a) above).

and obtain DCA and Staff Review of TSD
6.2.1. Objectives
a) To present all data and analyses conducted pursuant to
6.1. above in the form of tables, maps, charts, graphs
and "write-ups", with sources identified for all data.
b) To provide, only where necessary, documentation of metho-
dologies used to conduct analyses developed in 6.1. above.
c) To compile data and analysis developed in 6.1. above into
a single draft document suitable for publication as part
of all of a Technical Support Document which may be subse-
quently indexed, in part or in whole, to the comprehensive
plan document described in 9.4.a) below. (See also 9.2.C)
below.)
d) To effectuate, if possible, an early review of the draft
document described in c) above by the staff of the DCA,
and by Monroe County staff, for consistency with 9J-5,
F.A.C., and to obtain responses/comments/recommendations
from the DCA (on items where DCA, in the course of a review,
has made an unofficial determination that data and analysis
provided do not meet criteria of 9J-5) as to changes which
have to be effectuated to achieve consistency of the data/analy-
sis with 9J-5.
6.2.2. Consultant's Responsibilities
a) To prepare the draft TSD pursuant to objectives outlined
in subsection 6.2.1. above.
b) To transmit the draft TSD to DCA staff and request an
unofficial review of, and comment on same.
c) To receive DCA's and Monroe County staff's comments and,
where available, DCA's recommendations pertaining to consist-
ency of the data and analysis contained in the TO with
requirements of Rule 9J-5.
d) To revise the TO as required to achieve a favorable finding
of consistency with 9J-5, from DCA, and to address Monroe
County staff comments provided pursuant to subsection
6.2.3.a) below.
6.2.3. Monroe County Staff Responsibilities
a) To conduct review and provide comment on the draft TSD
simultaneously with DCA review of the TSD.
6.2.4. Products
a) TSD, as revised pursuant to subsection 6.2.2.d) above,
suitable for providing background data, analysis and
support for goals, objectives, and policies described
in 7.2.4.a) below (and included in the draft plan document
described in 9.4.a) below).
TASK 7 - COMPREHENSIVE PLAN ELEMENT PREPARATION
This task will occur simultaneously with Task 5 and 6, and will be comple-
mented by the development of the Capital Improvements Element (CIE) to
be developed under Task 8 below. The CIE is the only comprehensive plan
element not prepared under this task.
This task consists of seven subtasks, listed and described below.
7.1 Determine a suitable format to be used consistently for each element
of the plan document, including a consistent format for maps, and
a recommended document size and structure for publication of the plan
document.
7.2 Develop goals, objectives, and polices for each required element
(except the capital improvements element) of the draft comprehensive
plan.
7.3 Develop final draft of the Future Land Use Map, and other maps which
serve as policy tools.
7.4. Prepare documentation of implementation mechanisms as necessary, to
be contained in sections of the draft plan containing G/O/P, which
will facilitate the achievement of such G/O/P.
7.5. Prepare a section of the draft comprehensive plan which identifies
monitoring and evaluation procedures required by 9J-5.005(7) F.A.C.
7.6. Conduct two BOCC workshops to review Final GOPs and Land Use Plan.
7.7. Conduct two Planning Commission public hearings to hear comments and
make recommendations to BOCC.
7.1 Develop Plan Format and Structure
7.1.1. Objectives
a) To determine a format suitable for publication of the
comprehensive plan document.
b) To determine a format suitable for producing each element
of the plan document.
c) To develop a draft Table of Contents for the comprehensive
plan document described in 9.4.a) below.
7.1.2. Consultant's Responsibilities
a) To recommend an appropriate size, scale, and format for
maps, tables and other plan document components (see also
7.1.3.a) below).
b) To recommend to staff a consistent format suitable for
the production of comprehensive plan elements, considering
such items as requirements for indexing between TSD and
the plan document (see also 6.2.2.e) above 7.1.3.a) below).
c) To develop, and recommend to staff, a proposed Table of
Contents for development of the comprehensive plan document.
7.1.3. Monroe County Staff Responsibilities
a) Review and approve document format presented by the consul-
tant under 7.1.2.a) and b) above.
b) Review and approve the proposed Table of Contents for
the plan document developed under 7.1.2.c) above pursuant
to 7.1.1.c) above, and approve, or approve with revisions,
or work with consultant to develop an alternative Table
of Contents for development of the comprehensive plan
document.
7.1.4. Products
a) Written material describing plan document format and Table
of Contents (see also 7.2.2.b) below, and 7.4.2.b) below).
7.2 Develop Final Draft Goals, Objectives, Policies
7.2.1. Objectives
a) To develop draft goals, objectives and policies (G/O/P)
to address deficiencies or problems identified.
b) To develop draft G/O/P to meet requirements of 9J-5, F.A.C.,
and to be consistent with the requirements of 9J-5.021,
F.A.C. regarding local plan consistency with the Compre-
hensive Regional Policy Plan and regarding consistency
with the State of Florida Comprehensive Plan (see also
7.2.2.a) below).
c) To utilize data and analysis described under Task 2 above
to provide the basis for G/O/P developed for each element
of the comprehensive plan (see also 7.2.2.a) below).
7.2.2. Consultant's Responsibilities
a) To develop G/O/P for each comprehensive plan element re-
quired pursuant to 9J-5, F.A.C., and meeting objectives
7.2.1.a) through c) above.
b) To document G/O/P developed under 7.2.2.a) above in a
manner consistent with the plan document format described
in subsection 7.1.4.a) above.
c) To transmit G/O/P developed under a) above, and documented
pursuant to b) above, to staff for comment and/or recom-
mendations (see also d) below, and 7.2.3.a) below, and
7.4.2.d) below, and 7.5.2.0 below).
NOTE: Consultant and Monroe County have no obligation
to prepare the port element of the plan. The Key
West Seaport is wholly within the City Limits of
Key West and not controlled by the Monroe County
Board of County Commissioners.
d) To respond to staff comments/recommendations provided
pursuant to 7.2.3.a) below.
7.2.3. Monroe County Staff Responsibilities
a) To review, for each comprehensive plan element, draft
G/O/P prepared by the consultant, and provide comments
and/or recommendations as necessary (see also 7.2.2.c)
above).
7.2.4. Products
a) Draft of G/O/P for all comprehensive plan elements, ex-
cept Capital Improvements Element (see also 5.1.2.a) above,
and 5.2.2.b) above, and 6.2.4.a) above and 8.4.4.a) below).
7.3 Develop Final Draft of the Future Land Use Map, and other Maps
7.3.1. Objectives
a) To finalize the Future Land Use Map.
b) To develop and finalize all other maps required (or
recommended by the consultant) for inclusion in the plan
document.
7.3.2 Consultant's Responsibilities
a) To utilize the (revised) first draft Future Land Use Map
described under 5.3.4.a) and:
i) revise as necessary to achieve consistency with, or
to facilitiate the implementation of any policies
developed pursuant to subtask 7.2. above.
ii) revise as necessary to address comments/recommendations
received by the consultant at the workshop conducted
under subsection 5.3.2.b) above.
b) To utilize the final Future Land Use Map as developed
(revised) under a) above to revise the development dis-
tributions by TAZ and water/wastewater/solid waste planning
areas so as to reflect the changes made to the first draft
Future Land Use Map during development of the map described
in 5.3.4.a) above. This will generate a finalized spatial
distribution of 2010 development, and associated data,
suitable for public facilities analyses. (See also 8.2.a)
below).
c) Conduct, by use of an iterative process, a highway system
alternatives analysis using current information and data
generated by FDOT and the County, to develop a highway
and major street network to provide for adequate levels
of service in 2010.
NOTE: This analysis and other transportation analyses,
and other sections of this Scope of Services per-
taining to development of the Traffic Circulation
Element for the comprehensive plan, assumes the
availability of a suitably validated model, and
the ability of the consultant to receive necessary
assistance from FDOT, including the availability
of computer time if necessary, from the Florida
Department of Transportation pursuant to subsection
9J-5.002(4) and (5), 9J-5.007(2)(b) and (3)(b)
3, F.A.C., and s.163.3204, F.S. Where a validated
model or FDOT computer time is not available on
a timely basis, this Scope of Services shall be
subject to amendment.
It is also understood that Monroe County is consid-
ering amending this scope of service to add a more
in depth Transportation Planning element to include
the development of a specialized Transportation
Model and Methodology for Capacity Analysis. This
scope of service will be amended to include said
additional scope.
d) To develop other maps, as required by 9J-5, F.A.C. and/or
as determined by the consultant to be necessary for devel-
opment of the comprehensive plan document.
e) To transmit products described in 8.3.4.b) below to Monroe
County staff for review and comment/recommendations.
7.3.3. Monroe County Staff Assistance
a) To review and provide comment on all maps described under
7.3.4.a), b), and c) below and to facilitate (where necessary)
the timely response by county departments and agencies,
FDOT, DCA and the Florida Keys Aquaduct Authority to requests
by the consultant for information or for review of consultant's
map products.
7.3.4. Products
a) Final draft of the Future Land Use Map (see also 7.3.2.e)
above).
b) Future Traffic Circulation Map, including year 2010 net-
work (see also 7.3.2.e) above).
c) Other plan document maps
for definition of areas
plan.
7.4. Document Implementation Provisions
7.4.1. Objectives

7.4.2. Consultant's Responsibilities

mentation mechanisms pursuant to the intent of 9J-5.005(6),

b) To integrate these implementation mechanisms as part of
the format developed for each plan element, as described
in the product listed in 7.1.4.a) above.
c) To identify implementation mechanisms in policies developed
under this subtask, so as to provide certain general guidelines
for the development of land development regulations pursuant
to s.163.3203, F.S., following completion of work under
this Scope of Services.
d) To transmit proposed implementation mechanisms to staff
for review, comment and/or recommendations simultaneous
with proposed maps (see 7.3.2.e) above), and with proposed
plan monitoring, update, and evaluation procedures (see
7.5.2.c) below).
7.4.3. Monroe County Staff Responsibilities
a) To review, and provide comments/recommendations regarding
proposed plan implementation provisions developed pursuant
to 7.4.2.a) above.
7.4.4. Products
Plan implementation objectives and policies identifying
programs, activities, and the nature of land development
regulations which will implement the comprehensive plan.
These will be integrated with, and will be transmitted
as part of the goals, objectives, and policies described
in subsection 7.2.4.a) above.
7.5 Develop Plan Monitoring, Update and Evaluation Procedures
7.5.1. Objectives
To develop plan monitoring, update and evaluation procedures
and integrate these procedures into the comprehensive
plan document.
7.5.2. Consultant's Responsibilities
a) Identify procedures which can be adopted (as part of the
comprehensive plan), and which are designed to:
- provide for continuous monitoring of the impact and
the successes/failures of the comprehensive plan, and
are suitable for use in the preparation of Evaluation
and Appraisal Reports on the revised comprehensive
plan
- provide for plan evaluation, and facilitate update
of the comprehensive plan following the evaluation.
and which will meet the requirements of 9J-5.005(7), F.A.C.
b) Revise, as necessary, any monitoring, updating and eval-
uation procedures developed under a) above in response
to Monroe County staff comments/recommendations.
c) Transmit revised monitoring, evaluation and updating pro
cedures to Monroe County staff along with G/O/P and plan
implementation provisions enumerated above to Monroe County
staff for review and comment/recommendation.
7.5.3. Monroe County Staff Responsibilities
To review, and provide recommendations on monitoring,
update and evaluation procedures developed pursuant to
subsection 7.5.2. above.
7.5.4. Products
a) A section of the draft comprehensive plan containing
monitoring, updating, and evaluation procedures.
7.6. BOCC review of GOP's and LUP Map
7.6.1. Objective
To provide the BOCC opportunity to review and comment
on Final GOPs and final LUP map
7.6.2. Consultant's Responsiblitities
a) To attend two BOCC workshops, provide a review of material
and answer questions.
b) To provide appropriate number of drafts for BOCC review.
7.6.3. Monroe County Staff Responsibilties
a) To schedule workshops with BOCC for weeks 31 and 33 for
the purpose of facilitating BOCC review of the final draft
of GOPs and Land Use Map
b) To provide a record of proceedings of the workshops held
for purpose of documenting decisions, comments and recommen-
dations.
c) To receive direction from the BOCC and relay that direction
to the consultant
d) To review and comment on the draft GOPs and Land Use Map.
7.7 Planning Commission (PC) as LPA, Public Hearing and Recommendations

7.7.1. Objective

the Monroe County Planning Commission the opportunity
to review, comment and make recommendations to the BOCC
7.7.2. Consultant's Responsibilitiy

material and answer questions.
b) To provide appropriate number of drafts for the PC.
7.7.3. Monroe County Staff Responsibilities
a) To schedule Public Hearings and properly advertise for
the weeks of 31 and 33.
b) To provide record of proceedings
TASK 8 - CAPITAL IMPROVEMENTS ELEMENT PREPARATION
8.1 Objectives
a) To prepare a Capital Improvements Element consistent with 9J-
5.016, F.A.C., and consistent with other plan elements developed
under Task 7 above.
8.2. Consultant's Responsibilities
a) To project costs of providing infrastructure and services necessary
to achieve proposed levels of service, for year 2010, and using
the development scenario projected on the map showing development
by subarea in Monroe County as revised pursuant to subsection
7.3.2.b) above. Other maps, data and policy developed pursuant
to Task 7 (and particularly the Future Traffic Circulation Map
developed in subsection 7.3.2.c) above will also be utilized
to develop cost data for capital improvements.
b) To project the revenue stream to be generated by all revenue
sources currently available to the county for capital improvements,
by use of a series of analyses identified under 9J-5.061(2)(f),F.A.C.,
and to determine projected level of revenue surplus/deficit to
offset costs identified for the period covering "current year",
2010, and to address existing deficiencies.
c) To consider and recommend, if necessary, modifications to proposed
levels of service, and/or alternative revenue sources for providing
necessary capital improvements.
d) To develop and recommend, on the basis of the county's current
Capital Improvements Program, and on the basis of associated
cost and revenue projections and policy developed pursuant to
f) below, a revised Capital Improvements Program for the initial
5-years following the anticipated adoption date of the revised
comprehensive plan consistent with projections of revenue sources
for the same 5-year period.
e) To identify existing facility plans which may require revisions
pursuant to capital improvements needs projected in subsection
a) above.
f) To develop and recommend G/O/P for the Capital Improvements Element
consistent with 9J-5.016(3), F.A.C. This entails the development
and recommendation of policies, standards and provisions regarding
the implementation of capital improvements, and the mandatory
consistency of proposed development with level of service standards,
and other provisions in 9J-5.016(4),F.A.C. (see also d) above.)
g) To develop and recommend requirements and procedures for the
annual revision of the Capital Improvements Element (CIE)
h) To consider, during the development of the Capital Improvements
Element, plans and procedures of county departments, where these
are consistent with other plan elements and with proposed provisions
in the CIE.
i) To conduct meetings with Monroe County agencies including the
office of Budget, necessary to collect required data, establish
or revise recommended levels of service, assess existing defici-
encies, project the costs of capital improvements, identify
policies for capital improvements programming and other tasks
associated with the preparation of the CIE.
j) To conduct, following preparation of the draft CIE, a workshop
event with the BOCC for purposes of facilitating review, comment
and recommendation for revisions (as necessary) to the draft
CIE. The consultant will receive the BOCC's comments and recom-
mendations on the draft CIE at this workshop.
k) To transit copies of the draft element to PFCAC members and staff
in preparation for the workshop described in subsection j) above.
8.3 Monroe County Staff Responsibilities
a) To facilitate meetings between the consultant and other Monroe
County staff, scheduled in a timely manner so as to permit the
development of the CIE.
b) To review, and provide comment on, the consultant's draft CIE.
c) To schedule a workshop event of the BOCC for the purpose of a
consultant's presentation of the draft CIE, and to facilitate
the receipt of BOCC comments/recommendations on the draft CIE.
This workshop is to be scheduled for week 33.
8.4 Products
a) A draft of the CIE required by 9J-5, F.A.C.
TASK 9 - PREPARE COMPLETE DRAFT OF PLAN AND TECHNICAL SUPPORT DOCUMENTS
9.1. Objective
To revise the draft plan elements pursurant to staff and BOCC
comments received during workshops held pursuant to sections
7 and 8 above.
9.2. Consultant's Responsibilities
a) To review the comments/recommendations on the draft comprehensive
plan elements made by the BOCC during the course of reviews during
Tasks 7 and 8, and to recommend changes to address BOCC comments/
recommendations to the draft plan.
b) To conduct reviews of proposed changes (recommended pursuant
to a) above) with Monroe County staff and departments as necessary.
These reviews are conducted to obtain concurrence with staff
as to the changes to the plan elements proposed by the consultant.
9.3. Monroe County Staff Responsiblilities
To review, and facilitate the timely review by other county staff
and agencies, the revisions to the plan document by the consultant
pursuant to 9.2. b) above.
9.4. Products
a) Final consultant drafts of plan and Technical Support documents.
TASK 10 - TRANSMITTAL OF FINAL DRAFT PLAN BOCC FOR PRE -COMPLIANCE REVIEW
PUBLIC HEARINGS ON PLAN
10.1. Objectives
a) To deliver the Task 9 products to the BOCC
b) To transmit the proposed plan (with recommendations) to the BOCC
c) To complete a BOCC precompliance hearing on the proposed compre-
hensive plan held pursuant to s.163.3184(15)(b)1.,F.S.
10.2. Consultant's Responsibilities
a) To transmit copies of the proposed plan document, Technical Support
Document to staff, and to provide for distribution to the BOCC.
b) To assist the staff in conducting a maximum of two public hearings
to be held by the BOCC to present materials for review, comment
and finally, for the adoption of the proposed comprehensive plan
document.
c) To receive comment from the public, and the BOCC at the first
pre -compliance public hearing held pursuant to subsection b)
above, and to make changes, (as necessary) to the plan document
and to address concerns raised by the BOCC members and/or the
public.
NOTE: This public hearing is to be held with the intent of
obtaining public input, and provide opportunities for
comments and recommendations by BOCC members prior to
the second BOCC hearing conducted pursuant to e) below.
This is intended to reduce, to a minimum, changes which
may be requested following the DCA's compliance review,
and which may necessitate a "second round" of compliance
review by the DCA.
d) To deliver copies of each of the following to BOCC members following
revisions pursuant to c) above:
TSD
Proposed Plan Document
No (major) changes to either the proposed plan are anticipated
at this final public hearing.
e) To transmit materials for, and conduct a second pre -compliance
public hearing of the BOCC, pursuant to s.163.3184 (15)(b) 1.,
F.S. to review the final draft of the plan document (along with
its companion TSD), to authorize the transmittal of the proposed
comprehensive plan to the DCA (pursuant to s.163.3184 (3)(a),
F.S.) for compliance review. This Scope of Services anticipates
that a very minimum amount of change be made at this BOCC public
hearing, and assumes that major public comment and resultant
changes to the plan document and TSD, will occur during the course
of the PC hearings and the public hearing conducted by the BOCC
(described in subsection b) above). The consultant will also
prepare any additional changes necessary to the plan document
and TSD, following the second BOCC pre -compliance and authorization
to transmit meeting prior to the transmittal of proposed plan
and TSD to DCA
f) Following conclusion of the BOCC public hearing authorizing the
transmittal of the proposed plan to the DCA (see e) above), to
reproduce and transmit copies of the plan document and the TSD,
to the DCA and to any other unit of local government that has
filed a written request with the BOCC for the proposed plan pur-
suant to s.163.3184 (3)(a),F.S., with up to a maximum of 6 copies
for transmittal to such local governments,
10.3. Monroe County Staff Responsibilities
a) To schedule and provide due public notice as prescribed by Florida
Statute for the "pre -compliance review" BOCC public meetings,
and for all public hearin s conducted by the PC and/or the BOCC,
and described under 1.2.b� and e) above.
b) To maintain a record of the proceedings of the public workshop
and public hearings described in this task.
10.4 Products
Final plan document, and TSD ( not subject to compliance review
but to be transmitted to the DCA as background material for the
plan document, and to demonstrate compliance with data and analysis
requiremwnts of 9J-5, F.A.C.). Under this task, the proposed
plan, and TSD, are transmitted to the DCA, and the adopted plan
will then be subject to review by the DCA pursuant to s.163.3184
(3)(a), F.S.
TASK 11 - COORDINATION WITH THE DCA AND THE REGIONAL PLANNING C"ISSION
RPC
11.1 Objectives
a) To provide for ongoing contact with the DCA and the RPC during
the duration of the plan revision process to ensure plan compliance
with the State Comprehensive Plan, the Comprehensive Regional
Policy Plan, and Florida Law and Rules.
11.2. Consultant's Responsibilities
a) To, where necessary, communicate by phone, in writing, and/or
meet with representatives of the DCA, the RPC and with other
state and regional agencies to resolve issues and obtain input
relating to the plan revision process. This task is included
in this Scope of Services to facilitate the issuance of a Notice
of Intent finding the revised plan in compliance with state laws
and rules, including (but not limited to) ch. 85-57 (the state
Comprehensive Plan Act), the Comprehensive Regional Policy Plan,
ch.163 (the Local Government Comprehensive Planning and Land
Development Regulation Act), chs. 9J-5 and 9J-11 and 9J-12, F.A.C.
and ch 380 (the Land and Water Management Act).
b) To achieve the issuance of a Notice of Intent finding the plan
in compliance by the DCA. However, where the DCA fails to issue
such a Notice of Intent as a result of DCA objections to changes
to the comprehensive plan which have been requested by the BOCC
and which have not been recommended by the consultant, then the
consultant shall not be responsible for DCA's failure to issue
a Notice of Intent finding the plan in compliance with state
law and rules.
TASK 12 - CITIZEN PARTICIPATION
12.1 Objectives
a) To address the provisions regarding public participation contained
in FAC 9J-5.004
b) To achieve public input and comments during the Comprehensive
Plan preparation and adoption process.
12.2 Consultant's Responsibilities
a) To be accessable to county staff for consultation regarding public
participation.
b) To attend appropriate public participation meetings and explain
comprehensive plan progress and proposed objectives as requested
by Monroe County staff.
c) To provide copies of plan drafts for public participation as
requested by Monroe County and as required by the agreement.
12.3 Monroe County Staff Responsibilities
a) To prepare public participation program in accordance with F.A.C.
9J-5.004.
b) To arrange the public participation meetings and provide for
the leadership of those meetings.
c) To insure proper recordation of meetings and proper response
to public comments.
d) To insure that opportunities for written comments are provided.
e) To provide proper notice.
f) To make available in appropriate places at appropriate times
copies of drafts and other documentation.
12.4. Products
A public participation program prepared by the Monroe County
staff.
