05/26/1993L C O N T R A C T THIS AGREEMENT, made and entered into this 26th day of May, 1993, between Monroe County, Florida (Owner), and Power Depot, Inc. (Contractor): W I T N E S S E S: That the parties hereto, for the consideration hereinafter set forth, mutually agree as follows: I. SCOPE OF THE WORK -n s �O The Contractor shall provide six portable stand _.,dies`el efagine generator sets in accordance with the Spec ificat ns daLed aril 12, 1993, Addendum #1, his bid dated August 6-r1993 z ands his submittal information dated May 10, 1993, all attached haret6and incorporated as part of this contract document. II. INDEPENDENT CONTRACTOR At all times and for all purposes under this agreement the Con- tractor is an independent contractor and not an employee of the Board of County Commissioners for Monroe County. No statement contained in this agreement shall be construed so as to find the contractor or any of his/her employees, contractors, servants, or agents to be employees of the Board of County Commissioners for Monroe County. III. ASSURANCE AGAINST DISCRIMINATION The Contractor shall not discriminate against any person on the basis of race, creed, color, national origin, sex, age, or any other characteristic or aspect which is not job related, in its recruiting, hiring, promoting, terminating, or any other area affecting employment under this agreement or with the provision of services or goods under this agreement. IV. ASSIGNMENT The Contractor shall not assign this agreement, except in writing and with the prior written approval of the Board of County Commis- sioners for Monroe County and Contractor, which approval shall be subject to such conditions and provisions as the Board and Con- tractor may deem necessary. This agreement shall be incorporated by reference into any assignment and any assignee shall comply with all of the provisions of this agreement. Unless expressly provided for therein, such approval shall in no manner or event be deemed to impose any obligation upon the Board in addition to the total agreed -upon price of the services/goods of the contrac- tor. V. COMPLIANCE WITH LAW In providing all services/goods pursuant to this agreement, the contractor shall abide by all statutes, ordinances, rules and regulations pertaining to, or regulating the provisions of, such services, including those now in effect and hereinafter adopted. Any violation of said statutes, ordinances, rules and regula- tions shall constitute a material breach of this agreement and shall entitle the Board to terminate this contract immediately upon delivery of written notice of termination to the contractor. VI. INSURANCE Contractor will be responsible for all necessary insurance cover- age as indicated by an "X" on the attached form identified as WC1 attached hereto and incorporated as part of this Contract Docu- ment. VII. HOLD HARMLESS The Contractor shall defend, indemnify and hold the County, as outlined on the attached form identified as IND1, attached hereto and incorporated as part of this contract document. VIII CANCELLATION Either of the parties hereto may cancel this agreement with or without cause by giving the other party sixty (60) days written notice sent certified mail of its intention to do so. IX. FUNDING AVAILABILITY In the event that funds from Facilities Maintenance Contractual Services are partially reduced or cannot be obtained or cannot be continued at level sufficient to allow for the purchase of the services/goods specified herein, this agreement may then be termi- nated immediately at the option of the Board by written notice of termination delivered in person or by mail to the contractor. The Board shall not be obligated to pay for any services provided by the contractor after the contractor has received written no- tice of termination. X. PROFESSIONAL RESPONSIBILITY The Contractor warrants that it is authorized by law to engage in the performance of the activities encompassed by the project herein described, subject to the terms and conditions set forth in the Request for Proposal dated April 12, 1993 which is at- tached hereto and incorporated herein as a part of this con- tract/agreement. The provider shall at all times exercise inde- pendent, professional judgement and shall assume professional responsibility for the services to be provided. Continued fund- ing by the Board is contingent upon retention of appropriate 2 local, state, and/or federal certification and/or licensure of contractor. XI. NOTICE REQUIREMENT Any notice required or permitted under this agreement shall be in writing and hand delivered or mailed, postage prepaid, to the other party by certified mail, returned receipt requested, to the following: FOR COUNTY FOR CONTRACTOR Monroe County Public Works Power Depot, Inc. 5100 College Road 5200 NW 77th Court Key West, FL 33040 Miami, FL 33166 ATTN: Michael Lawn XII. COMMENCEMENT AND COMPLETION The Contractor shall commence work immediately upon receipt of notice to proceed. The Contractor shall prosecute the work with faithfulness and diligence and shall complete the work in accor- dance with the following schedule of completion. Upon receipt of Notice to Proceed the Contractor shall take no longer than one hundred (100) calendar days to complete the work after which a One Hundred Dollar ($100.00) a day liquidated dam- age will be assessed. XIII. PARTIAL AND FINAL PAYMENTS In accordance with the provisions fully set forth in the Request for Proposal dated April 12, 1993, and subject to additions and deductions as provided, the Owner shall pay to the Contractor as follows: Upon receipt of each generator set, a partial payment will be made within thirty (30) days after receipt of the Contractor's request for partial payment. The Owner shall make partial pay- ments to the Contractor on the basis of the prices listed on his bid dated May 5, 1993, less ten percent (10) of the amount of such price which is to be retained by the Owner until all work has been performed strictly in accordance with the Agreement and until such work has been accepted by the Owner. Upon receipt of the final generator set, final payment on of this Agreement shall be made within sixty (60) day completion by the Contractor of all work covered by this ment and acceptance of such work by the Owner. SCOPE: ; See attached. DOCUMENTS: All work specified herein shall be performed in accordance with the Standard Building Code, the National Electric Code, and all State, County, and Local Ordinances. EXECUTION: Proposals to be considered shall be submitted to Monroe County Purchasing Department, Cross Wing, Room #002, Public Service Building, Stock Island, Key West, Florida no later than 10:00 AM on May 6, 1993. Work shall be completed within thirty (30) days of proposal acceptance and issuance of Notice to Proceed. PERMITS AND LICENSES: Prior to the commencement of the work, the Contractor shall obtain all required permits. The Contractor shall furnish copies of all current licenses as a part of this proposal. INSURANCE: Contractor will be responsible for all necessary insurance cover- age as indicated by an "X" on the attached forms identified as INSCKLST 1-4, as further detailed on forms WC2, GL2, VL2, GIR 1, and GIR2. Certificates of Insurance must be provided to Monroe County on, the County prepared form within fifteen days after award of bid. ' } If SECTION 16200 - PORTABLE STANDBY POWER SYSTEM 1. SCOPE: Requirements contained in this specification shall apply to and govern the work under this section. WORK INCLUDED: a i Provide labor and materials necessary to assemble six (6) weather -protected and portable standby diesel engine -genera- tor sets of the latest commercial type and design as speci- fied herein. SUBSTITUTIONS: Proposed deviations from the specifications shall be treated as follows: Requests for substitutions shall be made a minimum of ten (10) days prior to bid date. Manufacturers catalog data shall accompany each request and authorized acceptance shall be by addenda only. Under no circumstances will assemblers of units be acceptable. To qualify as a manufacturer, the engine and generator must be manufactured as a complete engine -generator set and supplied by that manufacturer's authorized dealer only. SUBMITTAL: The contractor shall furnish information showing.manufac- turer's model numbers, dimensions, and weights, for -.engine, generator, and major auxiliary equipment. The contractor shall submit copies of pertinent drawings and schematic diagrams for approval and shall .include the following: ; a. Engine -generator set including plans and elevations or riser views clearly indicating entrance points for each of the interconnections required. b. Fuel consumption rate curves at various loads, ventila- tion and combustion CFM requirements. c. Weather -protective enclosure details and certification of manufacturing method per specifications. d: Exhaust silencer and flexible exhaust connector including mounting details. e. Certification of engine replacement parts in stock at supplier's facilities. f. Battery charger, battery, and battery rack, location and mounting details. g. On -board fuel tank, venting, fuel connection points, and fill cap location. h. Generator set towing trailer with details of all specified items. i. Actual electrical diagrams including schematic diagrams, and interconnection wiring diagrams for all equipment to be provided. j. Legends for all devices on all diagrams. k. Oil sampling analysis laboratory location and information. 1. Optional system service contract information including authorized dealer's name and location. M. Manufacturer's and dealer's written warranty: Two (2) years. 16200-2 The specified standby kW shall be for continuous electrical service during interruption of the normal utility source and shall be certified to this effect.by the manufacturer for the actual unit supplied. These ratings must be substantiated by- manufacturer's standard published curves. Special ratings or maximum ratings are not acceptable. 2. PRODUCT: The engine shall be watercooled inline or *vee- type, four-stroke cycle compression ignition diesel. It shall meet specifications when operating on number 2 domestic burner oil. Two-stroke cycle engines or those diesel engines requiring premium fuels will not be con- sidered. The engine shall be equipped with fuel,. lube oil and intake air filters, lube oil cooler, fuel trans- fer pump, fuel priming pump, service meter, gear -driven water pump, and unit mounted instruments, including a fuel pressure gauge, water temperature gauge, and lubri- cation oil pressure gauge. a. Governor - The engine governor shall maintain a frequency regulation not to exceed 3% (1.8 hertz) from no load to full rated load. Units equipped with hydra -mechanical or mechanical governors shall have a vernier control with positive locking mechanism for manual operation and adjustment. b. Mounting - The unit shall be mounted on a portable towing trailer and shall be provided with a minimum 375 gallon on -board fuel tank as specified elsewhere. C. Safety Devices - Safety shutoffs for high water tempera- ture, low oil pressure, overspeed, and engine overcrank shall be provided, as well as low water level and pre - shutdown alarms on oil pressure and water temperature. d. Guards - Guards shall be provided over all exposed moving parts as required by OSHA. GENERATOR: A. The generators shall be rated for continuous standby service: Three (3) @ 100 KW, 125 KVA, 120/208/480 volt; Two (2) @ 150 KW, 188 KVA, 120/208/480 volt; One (1) @ 250 KW, 313 KVA, 120/208/480 Volt. Each at 0.8 power factor, three phase, Wye four wire, 60 hertz, 1800 RPM, with triple voltage change over switches (Hi -Low Wye and Delta Voltage). 16200-3+�M b. Type - The generator shall be a three phase, single bearing, synchronous type built to NEMA, standards. .Class F insulation shall be used on the stator and rotor; and no materials which will support fungus;'_growth shall be used. The generator shall incorporate reactive droop compensation for parallel operation and shall include a resetable thermal protector for exciter/regulator pro- tection against extended low power factor loads:: z c. Regulator - A generator mounted, volts -per -hertz; type exciter/regulator shall be provided to match the charac- teristics of the generator and engine. Voltage regulation shall be ±1% from no load to full rated load. Readily accessible voltage droop, voltage level, and voltage gain controls shall be provided. Voltage level adjustment shall be a minimum of ±5%. The solid-state regulator module shall be shock -mounted and epoxy - encapsulated (i.e., not just epoxy coated) for protection against vibration and atmospheric deterioration. WEATHER -PROTECTIVE ENCLOSURE: The intent of this specification is to provide the owner with a portable generator set and enclosure complete in every detail and requiring no additional in -field modifications or assembly, except where specifically allowed by these specifications. The enclosure is to be accurately dimen- sioned so as to be in compliance with the National Electrical Code (NEC), and the National Fire Protection Association (NFPA) for clearance of all specified items included therein, and all applicable fire codes for a structure and application of this type. Construction drawings, engineering blueprints, or other bid documents accompanying these specifications which show switchgear and/or other service or distribution equipment within the generator set enclosure must be considered com- plementary to and not in lieu of this written specification. Drawings submitted for approval shall reflect this fact clearly and any contradiction or omission shall be brought to the attention of the designing engineer prior to bid. The enclosure shall be of formed steel construction. The design and construction shall be modular in that the side panels, doors, and louvers shall not exceed 36" in width and shall be a minimum thickness of 14 gauge for all component parts. The roof of the enclosure shall meet or exceed the minimum gauge requirements specified but, in addition, shall be strengthened in such a manner as to support the largest commercially available exhaust silencer recommended by the manufacturer for this application. 16200-4 a. Construction - All sheet metal used in the construction of the enclosure shall be hot -dipped galvanized after forming the component parts and rp ior-to•final•assembly. This sequence of metal forming, hot -dipped galvanizing, then final assembly of the enclosure must be noted on the drawings submitted for approval and.a factory certifica- tion of this manufacturing process shall accompany the "as -built" drawings provided to the owner. b. Doors - All doors on the enclosure shall be striteg'acally located in areas as to allow ease of maintenance on the generator set and allow good access to and visibility of instruments,- controls, engine gauges, etc. The doors shall be fitted with bolt -on, piano -type hinges construc- ted with brass hinge pins of a diameter not less than .25". Each door shall be fitted with flush -mounted, adjustable, key -lock latches. c. Louvers - All louvers shall be designed to prevent the entrance of driving rainwater, but shall have sufficient free area to allow for 120% of the total engine/generator cooling air requirements used in this application. d. Components - All components of the enclosure shall be assembled utilizing .375" minimum cadmium -plated bolts, nuts, and lock washers. In addition, watertight neoprene flat washers shall be used on all roof bolts. e. The manufacturer of the enclosure shall provide mounting brackets for the exhaust silencer specified. In addi- tion, a tail pipe extension terminating in a horizontal plane and cut at a 450 angle to prevent the entrance of rainwater shall also be supplied. Further, a stainless steel, seamless flexible exhaust tube and all necessary bolts, flanges, and 'gaskets to mate with the engine and the exhaust silencer shall be provided. The length of the flexible tubing shall be such that additional solid metal nipples or sections shall not be required to be provided as spacers between the engine exhaust or the exhaust silencer. f. Finish - Upon final assembly of the enclosure, it shall be prime painted with a minimum of two (2) coats of rust -inhibiting primer. The final finish painting shall be a minimum of two (2) coats of en- gine enamel. The color scheme of the completed unit shall be an aesthetically pleasing design, which is to be submitted to the engineer for approval. 16200-5 g. Sound Attenuation - The entire enclosure except for the louvered openings shall have sound attenuation material mechanically attached to the interior surfaces of the unit. Sound absorbing material shall consist of specially manufactured foam designed for this purpose. The foam sound absorption material shall be held in place by expanded metal grating to form a removable section easily inspected by maintenance personnel. The sound attenu- ation material and fastening system shall '-appy l.to the enclosure roof as well as the side panels and door h. All internal wiring as required by these specifications shall be in conduits made from liquid -tight material specifically manufactured for electrical use. All connec- tions at the generator set shall be flexible. i. Interior Lighting - A*battery operated light deriving its power from the engine cranking batteries shall be installed in a strategic location within the enclosure and shall be controlled by a switch located by one of the entrance doors. The light shall be large enough to provide illumination in an emergency situation yet not such that an overburdening drain will be placed on the starting batteries. The switch controlling this light shall be a wind-up timer type which automatically shuts off after a preset interval not to exceed one (1) hour. j. Running Beacon - A weatherproof, rotating beacon light shall be mounted atop the enclosure and wired to operate off generator output voltage or battery voltage each time the engine runs. This beacon shall be amber in color. k. A weatherproof, rotating beacon light and police -type siren shall be mounted atop the enclosure and wired to operate off battery voltage in the event of an engine fault or alarm condition. The beacon will be red in color. 1. oil & Water Drains - All necessary fittings, hoses, shut- off valves, etc. shall be provided by the manufacturer of the enclosure to facilitate lube oil and water drain at the exterior of the enclosure. In addition, engines equipped with crankcase breather tubes shall have this tube terminate at the exterior of the enclosure directly under the radiator air discharge louver. 16200-6� Ir m. Enclosure Flooring - The floor of the enclosure shall be designed and constructed in such a manner as to prevent the entrance of rodents. This shall be accomplished with solid metal or "diamond plate" but, in any.event, must be capable of supporting any ancillary equipment specified which may be secured to it (such as batteries and racks, etc.). Minimum floor thickness shall be .25" (: inch). n. Under no circumstances shall the floor area or any of its parts be considered for cooling air intake or discharge requirements of the generator set or its associated equipment, nor shall its properties as a "heat -sink" or heat dissipating medium be utilized in any manner whatsoever in this application. o. All items shown on the plans which accompany this speci- fication shall be supplied and wired including, but not limited to, the following: 1. Emergency DC battery operated interior light fed from generator set starting batteries. 2. Fault shutdown/pre-alarm flashing siren beacon and run beacon mounted and wired atop the enclosure. 3. Rain dress for exhaust pipe and tail pipe extension. 4. Foam sound attenuation material on interior surfaces to be mechanically secured -_not glued on. COOLING SYSTEM: a. Radiator - A radiator with blower type fan shall be sized to maintain safe operation at 110°F ambient temperature without derating the unit. This info-tmation shall be evident in the manufacturer's published data. Total air flow restriction from the radiator shall not exceed 0.5" of water, at both inlet and outlet. b. The engine cooling system shall be pre-treated by the engine supplier for the inhibition of internal corrosion. c. A low water level contactor shall be fitted in the expansion tank of the radiator and wired to the safety shutdown system as specified herein. 16200-7 ,J FUEL SYSTEM: a. On -board Tank - The unit shall be. equipped. with an on -board fuel tank of 375 gallon minimum capacity and shall be supplied with a lockable- fill cap. All necessary fuel vent lines for proper engine performance shall be provided as well as a means to readily detect the fuel level in the tank without the use of a measuring stick. b. The fuel tank deck plate shall be formed from steel!of a minimum metal thickness of .25" N")• c. Filter/Separator - In addition to the standard fuel fil- ters provided by the engine manufacturer, there shall also be installed a primary fuel filter/water separator in the fuel inlet line to the engine. The filter shall be a Racor or equal. EXHAUST SYSTEM: a. Exhaust Silencer - A Silex model JD critical location type silencer, muffler companion flanges, and flexible stainless. steel exhaust fitting properly sized shall be furnished by the enclosure manufacturer. The silencer shall be mounted so that its weight is not supported by the engine nor will exhaust system growth due to thermal expansion be imposed on the engine. Exhaust pipe size shall be sufficient to ensure that exhaust back pressure does not exceed the maximum limitations specified by the engine manufacturer. b. The silencer and tail pipe extension shall be supplied as a completely installed system by,.. the enclosure manufacturer. C. Rain Skirt - At the point where the exhaust pipe flexible tubing penetrates the roof of the enclosure, a suitable "rain skirt" and collar shall be provided by the manufac- turer. It shall be designed to prevent the entrance of rain and allow for expansion and vibration of the exhaust piping without chafing or stress to the exhaust system. This detail must appear on the drawings submitted for approval. 16200-8- AUTOMATIC STARTING SYSTEM: a. Starting Motor - A 24 volt DC electric starting system with positive engagement shall be furnished. b. Automatic Control - Fully automatic -generator set start - stop controls in the generator control panel shall be provided. Controls shall provide shutdown: for low oil pressure, high water temperature, overspeed, ands crank. Controls Controls shall include a 30 second single cranking cycle limit with lockout. c. Alternator - A unit mounted battery charging alternator shall be supplied on the engine. It shall be 24 volt, 35 amp. with an automatic voltage regulator. d. -Batteries - A lead -acid storage battery set of the heavy duty diesel starting type shall be provided. Battery voltage shall be compatible with the starting system. The battery set shall be rated no less than 172 ampere hours. Necessary cables and clamps shall be provided. e. Battery Tray - A battery tray shall be provided for the batteries and shall conform to NEC 480-7(b). It shall be constructed of wood and so treated as to be resistant to deterioration by battery electrolyte. Further, construc- tion shall be such that any spillage or boil -over battery electrolyte shall be contained within the tray to prevent a direct path to ground. f. Battery Charger - A current limiting battery charger shall be furnished to automatically recharge batteries. Charger shall float at 2.17 volts per cell and equalize at 2.33 volts per cell. It shall include overload protection, silicon diode full wave rectifiers, voltage surge suppressor, DC ammeter, DC voltmeter, and fused AC input. AC input voltage shall be 120 volts, single phase. Amperage output shall be no less than twelve (12) amperes. Charger shall be wall mounting type in NEMA 1 enclosure, and mounted and wired within the enclosure for the generator set. MAIN LINE CIRCUIT BREAKER: a. Type - A main line, molded case circuit breaker mounted upon the unit and installed as a load circuit interrupt- ing and protection device. TOWING TRAILER: The towing trailer with integral 375 gallon on -board fuel tank shall be a tandem axle type fabricated from ASTM 1-36 structural members 58,000/80,000 PSI with coped cross members continuously welded perpendicular on maximum 30" cen*rs to the main platform support members. Main supports to be 6" channel, 72" wide with 1/4" diamond plate platform. Deck length shall be no less than 15 feet and the fuel storage tank is to be baffled on a maximum of 30" centers. Generator sets which weigh in excess of 6,900 pounds shall be installed on tri-axle trailers, and those weighing in excess of 11,400 pounds shall be installed on quad -axle trailers ,with a minimum deck length of 18 feet. After fabrication, the fuel tank shall be hydrostatic test- ed for leaks. All appropriate fill, vent, suction, and dis- charge lines will be included and identified on the drawings submitted for approval. Also included will be a drain tap with plug on the fuel tank as well as a fuel sight gauge. TOWING EYE: The towing eye for the trailer shall be rated for 20,000 pound gross trailer weight and is to be 6:" O.D. x 3" I.D. It shall have a vertical load capacity of 4,000 pounds. HYDRAULIC SURGE BRAKES: The trailer shall be equipped with a hydraulic surge brake actuator rated at 22,000 pounds gross vehicle weight with a tongue load capacity of 5,000 pounds. A shock absorbing spring to provide smooth, positive stopping power over a wide range of loads and speeds is to be provided. The rated capacity is to be for highway service and for use with a standard lunette hitch. Break -away provisions to lock up the trailer brakes in an emergency shall also be included, and brakes shall be included on all wheels. 16200-11 - - RUNNING GEAR: All axles shall be rated 6,000 pounds each and shall-iriclude spindles, saddles, U-bolts, and 12" x.2" hydraulic brakes. Tires shall be 12 ply tran=_port type (not mobile home tires) for heavy equipment, F rated, 8.0 x 14.5, mounted on heavy duty 7.0 x 14.5 wheels with a 3280 pound rim load capacity. MISCELLANEOUS TRAILER EQUIPMENT: The trailer shall be fitted with reinforced fenders covered with anti-skid material for use as boarding steps by mainte- nance personnel. Stop and taIl lights shall be flush mount- ed within the rear bumper provided on the trailer. Clearance lights, turn signals, license holder and light, reflectors, and all other equipment required by the I.C.C. shall be in- cluded and installed, as well as two (2) 30" safety chains, a front load lift jack with sand shoe, lashing rings appropri- ately positioned to chain the unit in place for transport or for use in high wind conditions, and a spare tire for the unit. POWER CORDS AND STORAGE: Fifty foot (50') power cords shall be supplied for the bat- tery charger and for generator output voltage as specified above. Both cords shall be removable from their respective storage box fabricated by manufacturer. The generator power cable shall be fitted at one end with a Crouse -Hinds plug sized in accordance with the generator output ampacity, the N.E.C., and the jobsite receptacle requirements. The other end of the cord shall be fitted with a device as re- quired to disconnect it from the main line circuit breaker - for storage on the trailer. SCHEDULED OIL SAMPLING: In order to forecast and minimize engine failure, the sup- plier of the equipment must provide an oil sampling analysis kit which operating personnel shall utilize for scheduled oil sampling. The laboratory to which oil samples will be sent shall be located at and be a part of the local generator set supplier's facility, and shall be open to inspection during normal working hours. Independent laboratories not a part of the engine supplier's facility are disallowed as to confor- mance with this specification. 16200-12 Scheduled oil sampling shall be of spectrophotometry method as opposed analysis method and shall be accurate one part per million for the following a. Lead the atomic absorption .to the. spectrographic to within a fraction of elements: i In addition, the sample shall be treated for the presence of water, fuel dilution, and anti -freeze. All equipment needed to take oil samples shall be provided in a kit at the time of acceptance and shall include the following: a: Sample extraction gun (1) b. Oil sampling bottles (10) c. Postage paid nailers (10) d. Written instructions (1) e. Portable storage box (1) IMMEDIATE notification shall be provided to the owner when analysis shows any critical reading. If readings are normal, a report showing that the equipment is operating within established parameters shall be provided. This scheduled oil sampling kit shall be made available, at additional cost, to the owner beyond the mandatory starter kit specified previously and shall be optional for the owner to continue the purchasing after the starter kit has been depleted. SYSTEM SERVICE CONTRACT: The supplier of the standby power system must provide a copy of and make available to the owner his standard service con- tract which, at the owner's option, may be accepted or refused. This contract will accompany documents, drawings, - -'- - catalog cuts, spet;iii�ni.�v:. -�.'-__��., wiring or outlinedraw- ings, etc. submitted for approval to the designing engineer. The contract shall be for the complete services rendered over a period of one (1) year. 16200-13 3. EXECUTION: The engine, generator, trailer, enclosure, and -all major items of auxiliary equipment shall be manufactured in the U.S. by manufacturers currently engaged in the* production of such 'equip,: ent. The unit shall be shipped to the Marathon Public Works Yard, 10600 Aviation Blvd, Marathon Florida, by an author- ized dealer having a parts and service facility within Monroe and/or Dade County, Florida. In addition, and in order not to penalize the owner for unnecessary or prolonged periods of time for service or repairs to the system, the bidding generator set supplier must have no less than eighty percent (80%) of all engine replacement parts in his stock at all times. Certified proof of this requirement shall be provided by the supplier in his submittal data, and a personal inspection of the suppli- et's facilities shall be made by the designing engineer or his appointed representative to substantiate claims made by the generator set supplier. All conduits, wire, cables, fuel lines, etc. within the enclosure or upon the trailer shall be furnished and installed by the manufacturers authorized dealer only. TESTING: Units that are so large that they cannot be shipped aboard a transporting vehicle without special permits over -the -road shall be tested as a complete assembly for a period of one (1) hour as a totally assembled package prior to its being "knocked -down" for usual shipment. The manufacturers must provide certification that the testing took place at their factory, together with photo- graphs of the assembled unit as it appeared while running under .full load and with all specified equipment there- in. Photographs shall be 8" x 10" minimum size, in col- or, and shall be of the interior as well as the exterior of the package. Units that can ship without being disassembled for shipment must be tested by the manufacturer for a period of one (1) hour under full load; however, the provision of photographs will not be necessary, as local, engineer - witnessed testing as specified herein will suffice as evidence of a complete package. 16200-14 r In either event, prior to acceptance of the equipment, it shall be tested to show it is free of any defects and will start, run, and be subjected to -full' load* test through the use of dry type load banks utilized for this purpose at the facility of the local generator set supplier -.-- The load bank will be capable of definite and precise incre- mental loading and shall not be dependent on the generator control instrumentation to read amperage and voltage -of each phase. Rather, the test instrumentation will serve as a check of the generator set meters. Salt water brine tanks or those load banks requiring water as a source for cooling are not acceptable for this purpose and are disallowed and will not be utilized for this test. Load bank testing shall be done in the presence of the owner's engineer or his appointed representative at the local supplier's facility prior to shipment to the jobsite. Testing shall be for a period of four (4) hours under full load and be capable of accepting full block load. All transportation for the owner's representative shall be provided by the generator set supplier at no added cost. START-UP INSTRUCTIONS: On completion of the installation, start-up shall be per- formed by the engine manufacturer's trained dealer service representative. Four (4) copies of operating and maintenance instruction manuals shall be supplied for each generator system and proce- dures explained to operating personnel. WARRANTY: The generator set furnished under this section shall be guaranteed against defective parts and workmanship under terms of the manufacturer's and dealer's standard warranty. But, in no event, shall it be for a period of less than two (2) years from date of initial start-up of the system and shall include labor and travel time for necessary repairs at the jobsite. Submittal data received without written warranties as specified will be rejected in their entirety. 16200-15� WORKERS' COMPENSATION INSURANCE REQUIREMENTS FOR CONTRA•C Jr BETWEEN- ' MONROE COUNTY, FLORIDA AND Prior to the commencement of work governed by this contract, the Contractor shall obtain Workers' Compensation Insurance with limits sufficient to respond to the applicable state's statutes. In addition, the Contractor shall obtain Employers' Liability Insurance with limits of not less than: $200,000 Bodily Injury by Accident $500,000 Bodily Injury by Disease, each employee $500,000 Bodily Injury by Disease, policy limits Coverage shall be maintained throughout the entire term of the contract. Coverage shall be provided by a company or companies authorized to transact business in the state of Florida and the company or companies must maintain a minimum rating of A -VI, as assigned by the A.M. Best Company. If the Contractor has been approved by the Florida's Department of Labor, as an authorized self -insurer, the County shall recognize and honor the Contractor's status. The Contractor shall be required.to submit a Letter of Authorization issued by the Department of Labor and a Certificate of Insurance, providing details on the Contractor's Excess Insurance Program. If the Contractor participates in a self-insurance fund, a Certificate of Insurance will be required. In addition, the Contractor will be required to submit updated financial statements from the fund upon request from the County. WC2 GENERAL LIABILITY INSURANCE REQUIREMENTS FOR , CONTRACT,---'- BETWEEN MONROE COUNTY, FLORIDA AND Prior to the commencement of work governed by this contract} the Contractor shall obtain General Liability Insurance. The Contractor will not be permitted to commence work governed by this contract (including pre -staging of personnel and material) until satisfactory evidence of the required insurance has been furnished to the County as specified below. Delays in the commencement of work, resulting from the failure of the Contractor to provide satisfactory evidence of the required insurance, shall not extend deadlines specified in this contract and any penalties and failure to perform assessments shall be ' imposed as if the work commenced on the specified date and time, except for the Contractor's failure to provide satisfactory evidence.' The Contractor and any Sub -Contractors) shall maintain the required insurance throughout the entire term of this contract and any extension-s specified in the attached schedules. Failure to comply with this provision may result in the immediate suspension of all work until the required insurance has been reinstated or replaced. Delays in the completion of work resulting from the failure of the Contractor to maintain the required insurance shall not extend deadlines specified in -this contract and any penalties and failure.to perform assessments shall be imposed as if the work had not been suspended, except for the Contractor's failure to maintain the required insurance. The Contractor and all Sub -Contractors) shall provide, to the County, as satisfactory evidence of the required insurance, either: o Monroe County's Certificate of Insurance or o A Certified copy of the actual insurance.policy. The County, at its sole option, has the right to request a certified copy of any or all insurance policies required by this contract. If a certificate of insurance -is provided, the County prepared form must be used. "ACORD FORMS" ARE NOT ACCEPTABLE. GIR 1 All insurance policies must specify that they are not subject to cancellation, non -renewal, material change, or reduction_in coverage unless a minimum of�-forty-five (45) days prior notification is given to the -County by the insurer.
