HomeMy WebLinkAboutSupplement No. 44 SUPPLEMENTAL AGREEMENT NO. 4 TO CONSULTANT AGREEMENT This Supplemental Agreement, made and entered into this 15th day of July , 1980, by and between THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA (hereinafter referred to as "County") and M. VINCENT PROTHEROE, P.E. Consulting Engineer 123 N.W. 23rd Street Gainesville, Florida 32607 (hereinafter referred to as "Consultant") WITNESSETH: In accordance with the Consultant Agreement dated the 3rd day of June, 1980, by and between the Board of County Commis- sioners of Monroe County, Florida, (County), M. Vincent Protheroe, P.E. (Consultant), under Article 1. - Scope of Service, Consultant hereby presents a scope of engineering services for a Solid Waste Cost -Of -Service Study, Project #106-8001-00. A. SERVICES The Consultant shall provide engineering services :=A AS-4!1 by performing a Solid Waste Cost -Of -Service Study and assisting in permit applications for land fill operations. These services shall include the following: 1. Assist in the preparation and drafting of permit applica- tions to Department of Environmental Regulation for three (3) land fill applications in Monroe County. 2. Consultant agrees to a solid waste cost -of -service study for the six (6) franchise operations in Monroe County, Florida. Consultant may utilitize, as a basis for population projections within franchise areas, the population projections presented by the County Comprehensive Plan Elements and the Monroe County 201 Plan. 2.1. Determine the cost of service (including collection and disposal) of each of the six (6) franchise operations based on an analysis of all pertinent economic and technical factors. Page 1 of 3 Pages The factors to be used shall include but not necessarily be limited to documentation of the number, type and location of customers served; equipment used; employees, operation and maintenance expenses; other necessary expenses; investment and debt service. Quantities of solid waste collection and its relationship to established routes, system problems and projected system growth within the franchise areas will be considered. 2.2. Recommend economies of operation to reduce cost of service of each franchise holder and for the disposal district. Wfr OW 2.3. The fin;; report shall contain rate recommendations for each customer class. The following items will be included in the cost of service study: B. SCHEDULE 1. Provide ten (10) copies of a draft report within seventy-five (75) days from date of authorization to proceed. 2. Provide twenty-five (25) copies of a final report within fifteen (15) days from the date the County provides it's response to the Consultant to draft the report. 3. Present findings of the study at a forum or forums of the County's choosing. C. COMPENSATION 1. Compensation for services shall be as follows: 1. For the work described in Paragraph A-1 SERVICES, the County agrees to compensate the Consultant pursuant to the Basic Agreement, Article 5, Method 1, the Lump Sum Amount of $3,000.00. 2. For the work described in Paragraph A-2 SERVICES, the County agrees to compensate the Consultant pursuant to the Basic Agreement, Article 5, Method 1, the Lump Sum Amount of $24,000.00. Additionally, the County will reimburse the Consultant for all out-of-pocket expenses as provided in Article 8 of the Basic Agreement. Page 2 of 3 Pages D. TERMINATION This Supplemental Agreement may be terminated by either party giving thirty (30) days notice in writing to the other party. In the event of notice of termination, the Consultant shall do no further work, and he shall be paid for all work then in progress up to the date of termination.
