HomeMy WebLinkAboutSupplement No. 5SUPPLEMENTAL AGREEMENT NO. 5 TO CONSULTANT AGREEMENT This Supplemental Agreement, made and entered into this 12th day of August 1980, by and between: THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA (hereinafter referred to as "County") and M. VINCENT PROTHEROE, P.E. Consulting Engineer 123 N. W. 23rd Street Gainesville, Florida 32607 (hereinafter referred to as "Consultant") WITNESSETH: In accordance with the Consultant Agreement dated the 3rd day of June, 1980, by and between the Board of County Commis- sioners of Monroe County, Florida, (County), and M. Vincent Protheroe, P.E. (Consultant), under Article 1. - Scope of Service, Consultant hereby presents a scope of engineering services for an Alignment Study to define the horizontal geometrics of the road which is proposed to follow the existing 30 foot easement South of 5th Avenue on Stock Island, known as Shrimp Road. A. SERVICES This study will require the consideration of a design vehicle and a design speed, with geometrics suitable to provide a safe roadway therefor. While the proposed alignment will follow the 30 foot easement insofar as possible, the study will identify and describe portions of private land ownership which must he acquired to accommodate the alignment selected. The descriptions so obtained will be used by the County Legal Staff in ascertaining ownership and determining the cost of right-of-way acquisitions. This cost information can then be combined with a construction cost estimate (the next step recommended in the development of this project ) when requested by the County Commission. The results of this alignment study will be summarized in a letter engineering report which will fully describe the alignment selected, relate the selected alignment to private property owner- ship, and provide descriptions of land which must be acquired. It Page 1 of 3 Pages will be illustrated by drawings detailing intersections and other significant features. While this study is an important first step in developing a construction cost estimate, it must be supplemented by soil investigations and borings to determine subsurface conditions before such an estimate can be prepared. B. SCHEDULE 1. This alignment study is to be completed within sixty (60) days from the date hereof. 2. Prepare fifteen (15) copies of the report and a personal presentation of the study findings to the County representative(s) designated. C. COMPENSATION Based on the use of Method II as described in our Consultant Agreement, i.e. Direct Personnel Expense times a Multiplier, the fee for the alignment shall not exceed Two Thousand Seven Hundred and No/100 Dollars ($2,700.00), without further specific authori- zation. Additionally, the County will reimburse the Consultant for sll out-of-pocket expenses as provided in Article 8 of the Basic Agreement. D. TERMINATION This Supplemental Agreement may be terminated by either party giving thirty (30) days notice in writing to the other party. In the event of notice of termination, the Consultant shall do no further work, and he shall be paid for all work then in progress up to the date of termination.
