At a public meeting on March 3, 2011, the Bid Selection Committee ranked the three respondents as follovvs:
I" — Florida SPCA with 425 points
2"d — SHARK Nyith 411 points, and
3rd — Responsible Pethood NNith 315 points.
Bid Selection Committee voted 5-0 to recommend to the Board of Count- Commissioners that the BOCC award
a split bid to FKSPCA for the Big Pine service area and to SHARK for the Marathon service area.
PREVIOUS RELEVANT BOCC ACTION: On September 8, 2010, the BOCC approved staff recommendation
to re -bid Big Pine and Marathon animal control services
CONTRACT/AGREEMENT CHANGES: Nevv contract(s).
STAFF RECOMMENDATION: Approval to axyard bids as recommended by the Bid Selection Committee, to
the FKSPCA for the Big Pine Service area and to SHARK for the Marathon service area, subject to negotiating

The selection committee for BID-PWD-46-319-2011-PUR/CV met on
Thursday, March 3, 2011 at 2:00 p.m. at The Community Center at the Big
Pine Key Community Park, 31009 Atlantis Drive, Big Pine Key, Florida. The
following members were present Roman Gastesi, County Administrator, Dent
Pierce, Public Works Director, Beth Leto, Assistant Director of Public Works,
Sandy Tuttle, citizen of Big Pine Key, and Gina Hipson, citizen of Marathon.
Non -Committee member present, Christine Limbert, Assistant County

Welcome by Roman Gastesi and introduction of all members present. Mr.
Gastesi advised that public comment will be allowed and discussed the
tabulation and selection process. Since the committee had no questions and
needed no clarification on the bid responses, the scores of each individual
committee member were announced as follows:

required by the bid. Christine Limbert advised that the bid could be either/or.

Explanation by committee member that all selection committee members

Beth Leto explained that when members of the selection committee were given
the bid responses that they were advised that the bids were confidential and
that they should go through the bid criteria and score accordingly. They were
also advised not to discuss their scores.
Public question are to how the request for bids were put together
Explained that the request for bids were developed and created by staff
including county attorney, public works department, division directors and
county administration.
Public question as to how the two citizens on the selection committee were
appointed
Explained by Roman Gastesi that one was appointed by Roger Hernstad, the
City Manager of Marathon, and the other was appointed by Commissioner
George Neugent.
Comment from Mark Peterson of Key Deer Alliance that County should set
forth a response time of 3 or 4 hours for captured animals
Comment from Connie Christian that they require that the Animal Control
Officer on call live in the area
Anne Morrill stated that any animals they capture will be delivered to a person
Comment/question by Citizen regarding a shelter on BPK
Motion make by committee member, Roman Gastesi, to bifurcate the service
area and negotiate a contract with FKSPCA for BPK service area and with
SHARK for Marathon service area. Motion was seconded by Gina Hipson.

Roman Gastesi advised that the recommendation will be made to the BOCC on
March 16th, 2011 meeting at 11:00 time certain.

Agenda Item I-1: Approval to award bid(s) and enter into contract(s) for Big Pine Animal Control,
Shelter and Operations and/or Marathon Animal Control, Shelter and Operations.
From its inception in 1989, the Key Deer Protection Alliance has worked diligently to improve animal
control services to reduce the number of injuries to and deaths of Key deer due to free roaming dogs.
Over twenty-five years ago the County built the animal shelter on Big Pine Key. Over a decade ago the
County adopted its Year 2010 Comprehensive Land Use Plan, which mandates the animal shelter on Big
Pine Key be adequately staffed to enforce animal control laws.'
Over four years ago, with the issuance of Incidental Take Permit Number TE083411-0, the County entered
into a contract with the federal government to evaluate the need for additional regulatory measures to control
the spread of domestic predators and to provide an animal control education program.2
The decision as to whether or not you follow the existing policies and maintain a physical shelter on Big Pine
Key needs to be a separate decision that is decided by a vote of this Board. This issue needs to be discussed
in the public arena. If you decide not to maintain a shelter on Big Pine Key, the language in the Year 2010
Comprehensive Plan should be changed to reflect this change in policy.
The level of support for a long-term solution to animal control issues on Big Pine Key and the Lower Keys
has never been greater. We have the opportunity to finally get this right. We need your help and support.
We asked that you follow through with your 2006 plans to create a Domestic Animal Protection and Control
Advisory Board; and, that you direct staff to hold public meetings on the issue of a shelter on Big Pine Key.
Please help make adequate animal control on Big Pine Key and the Lower Keys a reality.

Dear Commissioners:
So as to not further "taint" this process, I will not identify, unless requested to do so by you, the name
of the entity for whom this correspondence is written.
On behalf of a client, we have previously advised both the County Administrator and the Director of
Public Works that our unidentified client takes objection to the bid procedure (which is presently in
process) as it relates to the provision of Animal Control services to the County, and they have failed
to respond to our otherwise address our concerns. Having received no response, we are left with little
choice but to bring this matter directly to you.
First, the process has been tainted from the beginning since a "draft" of the bid specifications was
provided to officials for the City of Marathon and such "draft" apparently made its way into the hands
of competing bidders. The dissemination of this "draft" resulted in this competitor actually having input
into the bid by way of the Marathon Official whose "feedback" was sought in connection with this
matter. Thus, the process has already been tainted with the appearance of collusion and favoritism,
and it will prevent the actual, honest and effective competition contemplated by the Monroe County
Code of Ordinances.
Also, County Staff had previously advised the RFP would not be released until audits of all three of
the present service providers had been complete. Notwithstanding such representation, the RFP was
released well before the audit of the Key West shelter was complete. Completion of all three audits is
absolutely necessary in order to give potential new entrants into the competition (i.e. entities not
presently providing services to the County) to submit a meaningful bid. The audit for the Key West
provider was received by my client on January 28th, 2011, barely two weeks before the bid period
closes.
Additionally, it has been stated that the bid has been designed to satisfy the desires of an existing
service provider. Specifically, the goal being to give the Key West based provider the southern
portion of the prior service area (i.e., the portion it wants) and awarding another entity the remainder
of the service area. A review of the bid package and requirements therein fully supports this claim
and reveals there is no realistic possibility a single entity will be able to successfully submit a bid to
handle what was once a single service area.
Please note, the issues identified above are just a few of the issues my client takes with the process.
We will not, by way of this correspondence, attempt to address the many specific issues we take with
the RFP.
It is critical, in light of the recent untoward activities of the prior service provider, the bidding process
be free from any reasonable suggestion of impropriety. Accepting a bid based upon the present RFP
will undermine the confidence of the public and prospective bidders that the process was a fair
process, free of collusion, favoritism or more sinister conduct.

SECTION ONE
INSTRUCTION TO BIDDERS
1.01 DESCRIPTION
The Board of County Commissioners of Monroe County, Florida, (hereinafter "County") is seeking
bids front private non -governmental humane organizations* (hereinafter "Contractor") to operate the
**Big Pine Key Animal Control Shelter located at 279 Industrial Drive, Big Pine Key, Florida, and
provide complete animal control enforcement services from Mile Marker 16.7 (the Harris Channel
Bridge) to Mile Marker 40 (south end of the 7 Mile Bridge) AND/OR to operate the Marathon Animal
Control Shelter located at 10550 Aviation Boulevard, Marathon, Florida, and provide complete animal
control and enforcement services from Mile Marker 40 to Mile Marker 70, including the Cities of
Marathon, Key Colony Beach and Layton (hereinafter "service area").
*In accordance with Sec. 4-37(b), Monroe County Code, and Sec. 828.03, Fla. Stat., the County
can only contract for the above services with a private non -governmental humane organization
such as a society or association organized under the laws of the State of Florida for the
prevention of cruelty to animals.
**The Big Pine Key Animal Shelter building and property is owned by Keys Energy Service
(KES) and leased to the County. The lease was recently renewed for a one-year period ending
August 31, 2011, and does not include a renewal option. Contractor is hereby made aware of the
current lease term and the possibility of lease termination. In this regard, Bidders completing
Bid Option 1 or Option 3 on the Bid Proposal Form must also complete Alternate Bid Option
1(A) [annual cost to provide animal control and enforcement services from MM 16.7 to MM 40,
without the Big Pine Shelter facility], or Alternate Bid Option 3(A) [annual cost to provide
animal control and enforcement services from MM 16.7 to MM 70 utilizing the Marathon
Animal Shelter only].
All bids must be received by the Monroe County Purchasing Office, Historic Gato Cigar Factory, 1100
Simonton Street, Room 1-213, Key West, Florida 33040, on or before 3:00 P.m. on February 15,
2011. Two (2) signed originals and four (4) complete copies of each bid shall be submitted in a sealed
envelope marked on the outside, "Sealed Bid for Animal Control Services and Operation of Animal
Shelter(s) on Big Pine Key AND/OR in Marathon." All bids must remain valid for a period of ninety
(90) days.
The Bidder shall submit a proposed budget as well as indicate the total annual cost to provide
the services contemplated hereunder (subject to Sections II and III of the contract), by utilizing
the attached Bid Form.
Following the receipt of bids, a committee will meet in a noticed public meeting to review the bids.
The committee will rank the submittals in order of preference and make a recommendation to the
County Commission to negotiate a contract with the preferred person/finm. Should the County
Commission so direct, and a mutually satisfactory agreement cannot be reached between staff and the
first recommended person/firm, then staff will negotiate with the next preferred person/firm and so
forth. When staff has agreed with the person/firm upon a mutually satisfactory contract, the contract
will be brought before the County Commission for final approval. No binding contract is created
between any person/firm and the County until a contract is approved by the County Commission.

Safe Harbor Animal Rescue of the Keys, with the full backing of all of the Middle
and Lower Keys veterinarians, is uniquely. qualified to run the Shelter and provide
animal control services. As a new 501(c)(3) organization, Safe Harbor requests that
during the first three months of operation, the County provide advance
reimbursements for services .per the agreed upon contractual price. This three-month
advance would allow Safe Harbor to fully implement all of its objectives. The advance
funding would be offset against actual reimbursed fees. There would be no need for
future advances after the initial three-month period, as Safe Harbor's Board and
volunteers would be engaged in numerous fund raising activities. The Board very
strongly believes that, after the initial three-month period, Safe Harbor would be self-
sufficient.
Katie Bentley has been the glue that has held the shelter together since the
departure of the previous manager. She will continue with the same quality service as
SHARK takes over the new contract.
