This listing is what prompted the Property Appraisers office to deny my Homestead Exemption. At the same time I put my house in Big Pine Key for rent I put my townhouse in Pembroke Pines for sale. Attached is a portion of the listing agreement. In fact I did get a contract but the contract fell through due to a low appraisal. This reinforces my statements that Big Pine Key is my home and it's my right to claim Homestead Exemption. SPECIAL MAGISTRATE'S (EXEMPTIONS/CLASSIFICATIONS) RECOMMENDED ORDER TO THE VALUE ADJUSTMENT BOARD THIS PETITION was before the Special Magistrate (Exemptions/ Classifications) on Tuesday, November 30, 2010, on Petitioner's challenge to the Property Appraiser's denial of a homestead exemption for real property located at 30924 Bayshore Drive, Big Pine Key, Florida ("Subject Property"). After conducting a hearing, reviewing the evidence submitted, hearing testimony and legal argument, and being otherwise more fully advised, the undersigned Special Magistrate submits this recommended decision. L FINDINGS OF FACT A. On or about March 8, 1996, Petitioner and Petitioner's former wife purchased the Subject Property. IZ 2005. B. Petitioner and his former wife were divorced on or about May 6, C. On or about December 29, 2006, Petitioner filed a Declaration of Domicile declaring that, beginning in calendar year 2007, the Subject Property would constitute Petitioner's predominate and principal home. D. The Property Appraiser recognized the homestead exemption for the Subject Property in tax years 2007, 2008, and 2009. E. After seeing that Petitioner had advertised the Subject Property for rent on Craig's List in December 2009, the Property Appraiser conducted an investigation to determine whether to renew the homestead exemption for the Subject Property for the 2010 tax year. F. As part of the Property Appraiser's investigation, the Property Appraiser determined that Petitioner was registered to vote, and in fact voted, in Broward County, Florida; Petitioner's registered address with the Broward County Supervisor of Elections is in Pembroke Pines, Florida (10940 Birchwood Place). G. Additionally, as part of the Property Appraiser's investigation, the Property Appraiser determined that Petitioner's Florida's Driver's License was registered at the Pembroke Pines address. H. Additionally, the Property Appraiser determined that Petitioner's motor vehicle was registered at Petitioner's Pembroke Pines address. N 13 I. Additionally, the Property Appraiser determined that the address listed on Petitioner's U.S. Income Tax filings was the Pembroke Pines address. J. At the hearing, the Property Appraiser established, through unrebutted evidence, all of the above. K. At the hearing, Petitioner testified that Petitioner owned three properties: 1. The Subject Property; 2. The Pembroke Pines property; and 3. Property in Levy County, Florida. L. Petitioner testified that Petitioner's job, involving medical waste, requires Petitioner to travel to all three properties. M. Petitioner testified that Petitioner traditionally would spend Thursday nights, Friday nights, Saturday nights and most holidays at the Subject Property. This testimony was unrebutted. N. Petitioner produced unrebutted evidence that the listing of the Subject Property on Craig's List (presumably the event that "triggered" the Property Appraiser's investigation) occurred as a result of financial hardship, but the evidence established that the listing was quickly removed and that the Subject Property was never rented. K �y O. The evidence established that Petitioner had not filed for homestead exemption on the Pembroke Pines property, nor the Levy County property, and that Petitioner had filed for homestead exemption only on the Subject Property. P. The evidence established that, prior to Petitioner's 2005 divorce, Petitioner and his former wife had homesteaded the Pembroke Pines property, and that upon Petitioner homesteading the Subject Property, the homestead protection on the Broward County was removed. Q. Petitioner testified that the Pembroke Pines property was the "centralized location" for Petitioner's business operations, but that Petitioner considered his permanent residence to be the Subject Property. R. The evidence established that Petitioner paid utilities at the Subject Property. S. Petitioner testified that Petitioner was unaware of the statutory factors outlined in § 196.015, Fla. Stat., which the Property Appraiser uses to make its initial factual determination regarding entitlement to homestead exemption. 0 10 IL CONCLUSIONS OF LAW Floridians having legal title to real property are entitled to a homestead exemption on real property which consists of his or her "permanent residence" on January 1 S` of any year. Section 196.031(1), Fla. Stat. A "permanent residence" is that place where a person has his or her true, fixed, and permanent home and principal establishment to which, whenever absent, he or she has the intention of returning. Section 196.012(18), Fla. Stat. Section 196.015, Fla. Stat., sets out a ten -factor statutory test for initial consideration by the Property Appraiser in determining whether a taxpayer has established a "permanent residence" for the purposes of entitlement to Florida's homestead exemption. In this case, the Property Appraiser evaluated several of the statutory factors and determined, based on the unrebutted evidence, that the Subject Property was not Petitioner's "permanent residence" for the purpose of the homestead exemption. For example, one of the statutory factors is the location of the taxpayer's voter registration.' Another statutory factor is where a taxpayer's driver's license and vehicle are registered.2 ' See, § 196.015(5), Fla. Stat. 2 See, § 196.015(6), (7), Fla. Stat. 5 /b One of the statutory factors is the address listed on the taxpayer's Federal Income Tax Returns.3 However, it is important to note that the prefatory language to § 196.015 is clear that the statutory criteria in that section are to be used by the property appraiser "in the first instance" to determine permanent residency. The prefatory language of the statute goes on to read as follows: "Although any one factor is not conclusive of the establishment or nonestablishment of permanent residence, the following are relevant factors that may be considered by the property appraiser in making his or her determination as to the intent of a person claiming a homestead exemption ...." Hence, without the benefit of the testimony and explanation of the Petitioner, the Property Appraiser clearly made the correct initial determination denying Petitioner's Application for Homestead Exemption for 2010. Indeed, as outlined above, many of the statutory factors support the Property Appraiser's initial determination. However, it is critically important to note that other statutory factors support Petitioner's application for homestead exemption. In particular, the Petitioner filed a formal Declaration of Domicile, recorded in the Public Records of Monroe County, which unequivocally stated Petitioner's intent that the Subject Property 3 See, § 196.015(8), Fla. Stat. Z 17 constituted Petitioner's "permanent residence."4 Additionally, the record is clear that Petitioner paid for the utilities of the Subject Property.5 These two statutory factors, combined with the unrebutted evidence that a significant amount of Petitioner's time was spent at the Subject Property, combined with the fact that none of Petitioner's other properties were homesteaded, constitutes sufficient evidence supporting Petitioner's claim that Petitioner's "permanent residence" is the Subject Property. In sum, balancing all of the evidence presented, the Special Magistrate recommends that the Value Adjustment Board overturn the decision of the Property Appraiser and reinstate Petitioner's homestead exemption on the Subject Property.6 4 See, § 196.015(l ), Fla. Stat. 5 See, § 196.015(10), Fla. Stat. ° Petitioner is cautioned of the axiom that "ignorance of the law is no excuse." In order to preserve Petitioner's homestead exemption on the Subject Property for subsequent years, Petitioner would be well-advised to carefully review the ten statutory factors found in § 196.015, Fla. Stat. VA I III. REASONS FOR RECOMMENDING OVERTURNING THE DETERMINATION OF THE PROPERTY APPRAISER For the reasons stated, the undersigned recommends that the Value Adjustment Board overturn the determination of the Property Appraiser to deny Petitioner the homestead exemption for the Subject Property.
