AMENDMENT NO. 3
TO COOPERATIVE AGREEMENT
BETWEEN THE
SOUTH FLORIDA WATER MANAGEMENT DISTRICT
AND
MONROE COUNTY, FLORIDA
This AMENDMENT NO. 3, made this � day of M A I , 1993 to that
COOPERATIVE AGREEMENT (AGREEMENT) dated September 28, 1990 and
subsequently amended on December 19, 1990 (AMENDMENT NO. 1) and on August 4,
1992 (AMENDMENT NO. 2), between the South Florida Water Management District
(DISTRICT) and Monroe County, Florida (COUNTY).
WITNESSETH:
THAT WHEREAS, the AGREEMENT may be amended with the prior written
approval of the parties;
WHEREAS, by AMENDMENT NO. 1, the PARTIES amended then perm of

WHEREAS, by AMENDMENT NO. 2, the PARTIES further amended the period of
performance from June 30, 1992 to October 31, 1993; °O
WHEREAS, the COUNTY has requested an amendment to the Statement of Work
of the AGREEMENT in order to 1) extend the due date for Task E due to time lost during
the consultant selection process, 2) expand the role of the consultant's duties in Task E and
3) change the payment schedule for Task E;
WHEREAS, the DISTRICT is agreeable to this request; and
NOW THEREFORE, in consideration of the benefits flowing from each to the other,
the parties agree to amend the AGREEMENT as follows:
1. The period of performance of the AGREEMENT is hereby amended and shall
extend to January 31, 1994. This extension of time shall be at no additional cost to the
DISTRICT.
2. The Statement of Work, Exhibit "A" to the AGREEMENT, amended pursuant
to AMENDMENT NO. 1, dated December 19, 1990; and further amended pursuant to a

certain letter amendment, dated August 5, 1991, which is incorporated by reference and
attached as Exhibit "B" to AMENDMENT NO. 2, dated August 4, 1992; and further
amended pursuant to AMENDMENT NO. 2; is hereby amended in accordance with Exhibit
"AT', attached hereto and made a part of this AMENDMENT NO. 3.
3. All other terms and conditions of the AGREEMENT, as amended, remain
unchanged.
IN WITNESS WHEREOF, the parties hereto have set their hands on the day, month
and year written above.

STATEMENT OF WORK
AMENDMENT NO. 3
Background
On October 16, 1992 the County adopted its revised Stormwater Management Ordinance.
The ordinance is currently being reviewed by the Department of Community Affairs for
acceptance per the Cooperative Agreement. The County advertised for and received RFQs
from consultants to perform Task "E". The Board of County Commissioners selected a
consultant at their February 9, 1993 meeting and contracted with the consultant March 1,
1993.
The current amended cooperative agreement envisioned that a consultant would be hired
simultaneous to the adoption of the Ordinance and that funding for Task "E" would be for
the first year of the Ordinance's implementation. The RFQ process took
more time than originally envisioned so% the County has asked that the end date for Task "E"
be extended for 90 days. In addition, the County wants to expand the role of the consultant
and utilize monthly invoicing in lieu of lump sum payment. The expanded role of the
consultant is within the intent of the original cooperative agreement and monthly invoicing
will assist the District in monitoring/administering this task.
Work Breakdown Structure
Task E is hereby amended to read as follows:
The County will contract for the services of a professional engineer, in accordance with all
applicable Florida law and County Procurement Procedures, on an "as needed' basis to
administer the amended Stormwater Management Ordinance by reviewing proposed
projects, processing permit applications, developing issuance/denial recommendations,
conducting permit compliance inspections and initiating enforcement actions as appropriate,
assist in the interpretation and improvement of the stormwater management ordinance and
establish procedures, guidelines and timeframes for review of stormwater management
systems.
Time Schedule and Timeframes
Task E shall be completed by the following revised date.

Deliverables
Properly documented invoices for all professional engineering services performed by the
consultant.
Payment Schedule
Payment for Task E shall be on 3/ rJghtk %csse'l�tnmencing March 1993, following
completion of work required by this Task and submission of properly documented invoices.
Aggregate payment shall not exceed $40,000.
Contingencies
No situations which would adversely impact contract performance are foreseen at this time.
If unforseen situations arise which may affect the tasks, deliverables, or timetables as
defined in this Statement of Work,,Mgnroe County will be responsible for bringing those
to the District's attention for contingency planning.
