k ADDENDUM TO FRANCHISE AGREEMENT
L BETWEEN MONROE COUNTY MUNICIPAL SERVICE DISTRICT
AND
WASTE MANAGEMENT OF FLORIDA INC. D /B /A FLORIDA DISPOSAL COMPANY
10. From January 1, 1988 through December 31, 1988 the collector shall pay a
tipping fee of $ 17,00 per ton for all solid waste delivered to a disposal
facility.
(a) In that the tipping fee implementation is predicated on the County's
revenue from each franchise fee, the Board of County Commissioners reserves the
right to increase or decrease the tipping fee of the franchise on a annual basis,
so that the county's franchise fee, whether by percentage of a gross commercial
revenue or by tipping fee, remains as established in the contract to which this
addendum is attached and amends.
To wit: 40%
(b) In that, under a tipping fee system, the County no longer is provided a
percentage of gross franchisee revenue, as franchise fee, for charges placed for
services above the residential special assessment, the following requirements shall
be met by the franchisee concerning residential service under a collector - provided
container pick -up basis.
I. The franchisee shall, at the customers request, provide containers
to accommodate the residential garbage and horticultural trash
generated on site or accept bagged garbage and bagged or bundled
horticultural trash, which can not be accommodated in the con-
tainers provided and which is placed beside the container. Provided
however, that no collector shall be required to furnish more containers
larger containers, or more frequent pick -up service, than that pro-
vided to any particular consumer during 1987, unless additional
residential units are constructed or by Agreement between the Collector
and Consumer. Nor shall containers be removed the volume of which
exceeds or equals the volume at anytime in 1987.
2. If the collector's return on a commercial basis as stated above for the
number, size and frequency of pick -up, for the containers furnished by
him for the collection of household garbage and horticultural trash is
greater than that paid to him by the County, on a monthly basis,he
shall be entitled to charge the difference between his return, per
consumer account, on a commercial basis and his return on a residential
basis, to be billed monthly to residential account.
3. However, if the collector's return is greater, on a residential basis,
than his return would be on a commercial basis, per consumer account,
for the numbers, sizes and frequency of pickup of the containers which
he provides, he shall be entitled to receive the greater amount and
shall place no additional charges on the residential account.
(c) This Addendum shall remain in effect from April 1, 1988 through June 30,
1988, at which time it shall expire and become null and void and of no further effect,
unless extended by the Monroe County Board of County Commissioners prior to June 30,
1988.
