On April 14, 1993, the Board of County Commissioners authorized
execution of Grant of Easement between Monroe County and Florida
Keys Aqueduct Authority for the Marathon Airport.
Attached is a duplicate original of the subject Easement, now
fully executed and sealed by all parties.

GRANT OF EASEMENT
It is hereby agreed that Monroe County, Florida, (hereinafter
referred to as "Grantor") for and in consideration of the sum of
ONE DOLLAR ($1.00) and other good and valuable considerations, the
receipt of which is hereby acknowledged by Grantor, paid by the
Florida Keys Aqueduct Authority (hereinafter referred to as
"Authority "), does grant, sell and convey, unto Authority an
easement under the following terms and conditions:
1) Grantor hereby grants to the Authority an easement under,
over, across and upon the following described property:
A strip of land being 20 feet in width, situate in Section 1,
Township 66 South, Range 32 East and in Section 6�, Towns,'llip 615
South, Range 33 East, Monroe County, Florida, laid st't'ip q�
land being the Southerly 20 feet of the Northerly 40 Beet of
Old State Road 4-A as Quit Claimed Deed recorded -in OfWicial
Record Book 963, at page 2194 of the public records off. said
Monroe County, said strip of land being more_part ic�6larl.y
described as follows: -o
COMMENCING at the Southwest corner of Section 1, Townsip 66
South, Range 32 East; Thence bear North 00°02130" East along
the West line of said Section 1, a distance of 82.68 Feet to
an intersection with the South line of the North 40 feet of
Old State Road 4-A as now laid out and in use; Thence North
67*51100" East along said South line of the North 40 feet, a
distance of 54.00 feet to an intersection with the Easterly
right-of-way line of the 25 foot right-of-way for Aviation
Boulevard and the POINT -OF -BEGINNING of the strip of land
hereinafter intended to be described;
From the POINT -OF -BEGINNING, Thence continue Northeasterly
along the said South line of the North 40 feet of Old State
Road 4-A for the following three courses, first bearing North
67*5110011 East, a distance of 7075.00 feet to the beginning of
a curve, being concave to the Southeast, having a radius of
2940.93 feet and from which a radial line bears South
22*09100" West along said Easterly line, a distance of 20.31
feet to a point on a line lying 20 feet Northerly of and State
Road 4-A; Thence Southwesterly along said parallel line for
the following three courses, first bearing South 77°51100"
West a distance of 809.96 feet to the beginning of a curve,
being concave radial line bears South 12*09100" East; Thence
Southwesterly along the arc of said curve, subtended by a
central angle of 10*0010011, a distance of 516.78 feet to the
end of said curve; Thence South aforesaid Easterly right-of-
way line of Aviation Boulevard; Thence South 00*01130" West
along said right-of-way line, a distance of 21.60 feet back to
the POINT -OF -BEGINNING
The above described parcel of land contains 167,953.44 square
feet or 3..85566 acres more or less.
For the purpose of this description all bearings are based on
an assumed meridian with the Northerly right-of-way line of
Old State Road 4-A through section 1, Township 66 South, Range
32 East bearing North 67°51100" East and said bearings are
given for the purpose of delineating angles only.
2) Authority, its successors and assigns, shall have the
right to construct, reconstruct, lay, install, operate,
maintain, relocate, repair, replace, improve, remove, and

inspect water distribution facilities and all
appurtenances thereto and shall have full right of
ingress and egress thereto and therefrom over and across
the easement area.
3) Grantor shall furnish and maintain the easement area free
of and clear frog .any obstruction and shall not
construct, place, or allow the placing_ or construction of
any obstruction which would interfere with: (i)
Authority's safe or proper installation, operation,
maintenance, inspection, or removal of the water
transmission and distribution facilities and all the
appurtenances thereto located in the easement area or
(ii) any other right granted to Authority. Grantor
shall have the right to make any other use of the
easement area which does not interfere with the
Authority's rights including but not limited to the
construction of paved access roads, landscaping or other
appurtenances Grantor deems necessary in support of
Airport operations. The granting of this easement is to
in no way impact or conflict with the proposed
construction activities of the new Marathon Airport
Terminal and related site improvements.
4) Grantor shall bear the cost of any relocation or
modification of said facilities when the change is
necessitated by Grantor's requirements or those of any
utility other than the Authority.
5) All covenants, stipulations, terms, conditions, and
provisions of this agreement shall extend to and be made
binding upon respective successors and assigns of
Authority and Grantor. It is intended that this
agreement shall be recorded and be binding upon future
owners of the above described property.

6) This document conveys only the interest possessed by the
County and shall not be deemed to warrant title or to
represent any state of facts concerning same, pursuant
to Chapter 125.411, F1a.Stat.
