08/03/1976A G R E E M E N T THIS AGREEMENT, Made this 3 day of August , 197 6 , by and between the BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, hereinafter called "Board"; and FLORIDA KEYS ENVIRONMENTAL LABORATORY, INC., a Florida corporation, hereinafter called "Corporation"; W I T N E S S E T H: That in consideration of the premises hereinafter contained, the parties hereto agree as follows: A. The Corporation agrees as follows: 1. To have a certified operator or supervised trainee make one visit to the sewage treatment plant each day Monday through Saturday for no less than 60 minutes each day. Holi- days and Sundays will be exempt from visitation unless an emergency condition exists which would require the service of an operator. Should such emergency service be required, there will be an addi- tional charge. 2. To perform the following during the daily visit: (a) Physical and visual inspection of all parimeters of the sewage treatment plant. (b) On -site daily required testing as estab- lished by the Department of Environmental Regulation. and testing. (c) Daily log of all and any operational data (d) Balancing of plant, utilizing operational data and testing to assure proper and adequate performance. Relieving of such stoppage should it occur. (i) Daily scrubbing and scraping of all tanks. (j) Daily logging of any and all maintenance procedures performed. 3. To perform all testing required by the Department of Environmental Regulation. Copies of the results of the tests will be sent to designated person for signature and forwarding to the Department of Environmental Regulation. A copy of the monthly log will be furnished the Board for inspection and file. 4. To operate and maintain sewage treatment plant at Monroe County Public Service Building so as to meet all require- ments of the Department of Environmental Regulation. 5. To notify the Board of any breakdown or non- functional parimeter of the plant. Such notification to be by phone, followed by an explanatory letter. No repair or order for equipment or supplies needed for proper performance will be accom- plished without a direct written authorization from the Board. Upon receipt of such approved authorization, this Corporation will proceed with the repair or replacement as quickly as possible, keep- ing the "down -time" of the plant to a minimum. 6. To notify the Board of needed supplies or equip- ment with purchase/repair/replacement price. 7. To notify the Department of Environmental Regu- lation in the event of breakdown, as required by this regulating authority, and also steps being taken to remedy any trouble. B. To pay for any kind of additional work, not hereinabove covered, needed for proper performance of plant such as commercial pump -out and removal of sludge from plant. 4. To be responsible for sewage lines up to the lift station which is considered to be part of said sewage treatment plant. 5. To furnish chlorine in sufficient quantities as to insure proper residual in effluent. 6. To allow no one except the Board's employees and the Corporation's employees to have access to the sewage treatment plant. For visitation other than these, a notification will be made to the Corporation prior to any such visit. 7. To pay to the Corporation in consideration of said Corporation's performing the duties and services in compliance with this Agreement the sum of Three Hundred Dollars ($300.00) per month and in addition thereto to pay an additional Twenty-five Dollars ($25.00) per hour (portal to portal) to said Corporation for any emergency call service on holidays and Sundays. C. The Corporation further agrees not to hold the Board responsible for any injuries to personnel while on duty at the sewage treatment plant, unless same has been caused by the negligence of the Board or its employees and/or agents. D.
