Finance Director File SUPPLEMENTARY ADDENDUM TO CONTRACT 4.o -n This Supplementary Addendum to Contract ( "Supplement) is mad�th� 6ti&a� of November, 1998 by Waste Management, Inc. of Florida ( "Contractor ")mod: -M�y' o80 County ( "County "). r'' I - n n• r co n RECITALS nn' �0 C- WHEREAS, the parties have previously entered into that certain cor� dat edo September 18, 1998 (the "Contract "), pursuant to which Contractor has been �ovisRng � debris cleanup and removal services required as the result of Hurricane C-Zorges, bid the Contract has been amended by Addendum to Contract; and WHEREAS, before the work which is the subject of the Contract could be completed, on November 4 -5, 1998, the Florida Keys suffered additional damage resulting from cyclonic winds produced by the storm system known as Tropical Storm Mitch; and WHEREAS, County has declared a State of Local Emergency and is seeking federal disaster relief so as, inter alia, to provide for removal and disposal of the debris generated by Tropical Storm Mitch ( "Mitch debris "); and WHEREAS, County's Declaration of State of Local Emergency specifically waives procedures and formalities otherwise required by law pertaining to entering into contracts, incurring obligations and expending public funds; and WHEREAS, by Executive Order No. 98 -267, the Governor of the State of Florida declared a State of Emergency in Monroe County due to the effects of Tropical Storm Mitch, and suspended State laws and regulations applicable to securing services necessary for the immediate implementation of disaster /emergency assistance; and WHEREAS, Contractor is in the unique position, by reason of the presence of its crews, equipment and subcontractors in the areas of Monroe County damaged by Tropical Storm Mitch, to provide immediate removal of Mitch debris, time being of the essence, NOW, THEREFORE, the parties agree that the scope of the Contract is hereby SUPPLEMENTED by adding to the "General Scope of Services ", paragraph 1, line 3, the words "...and by Tropical Storm Mitch ", immediately following the words "generated by Hurricane Georges ". In all other respects, the terms of the Contract (as previously amended and modified by Addendum to Contract) shall remain in full force and effect. IN WITNESS WHEREOF, the Contractor has hereunto set its hand and seal (or) has caused these presents to be signed in its corporate name by its authorized representative and Monroe County has caused these presents to be signed in its corporate name by its Authorized Agent by authority of Monroe County Commission duly given, all as of the day and year first above written.
