Key Colony Beach
A Workshop of the Monroe County Board of County
Commissioners concerning proposed amendments to the Land
Development Regulations convened at 3 :30 P.M. , with a Public
Hearing immediately following at 5: 01 P.M. on the above date, at
Key Colony Beach City Hall. Present and answering to roll call
were Commissioners Earl Cheal, Shirley Freeman, Mary Kay Reich
and Mayor London. Absent was Commissioner Harvey. Also present
were Danny L. Kolhage, Clerk; Isabel C. DeSantis, Deputy Clerk;
Randy Ludacer, County Attorney; James Roberts, County
Administrator; County Staff; members of the Press and Radio; and
the general public.
All stood for the Invocation and Pledge of Allegiance.
There were no Additions, Corrections, or Deletions to
the Agenda.
BULK APPROVALS
Motion was made by Commissioner Cheal and seconded by
Commissioner Freeman to adopt the following Resolution concerning
the Transfer of Funds for Fiscal Year 1994. Roll call vote was
taken with the following results:

Commissioner Freeman Yes
Commissioner Reich No
Mayor London Yes

GROWTH MANAGEMENT REPORT
Growth Management Director, Bob Herman gave an update
on the Comprehensive Plan Year 2010. Motion was made by
Commissioner Cheal and seconded by Commissioner Freeman to call a
Workshop on January 18, 1994 at 3 :30 P.M. at Key Colony Beach
City Hall for the purpose of discussing the proposed Land
Development Regulation changes, with a Public Hearing. Motion
carried unanimously.
Mr. Herman discussed the Curry Cove Lawsuit and gave an
explanation of the Workshop Process.
WORKSHOP
A Workshop was held to discuss proposed Amendments to
the Land Development Regulations (Chapter 9. 5 of the Monroe
County Code) .
FEMA Coordinator, Dianne Bair discussed an Amendment to
the Land Development Regulations, Division 6, Section 9.5-315,
9.5-316, and 9.5-317 of the Floodplain Management Ordinance.
Land Use Attorney, Garth Coller discussed an Amendment
to the Land Development Regulations, (Development Agreements) .
Director of Environmental Resources, Pat McNeese
discussed an Amendment to the Land Development Regulations,
Chapter 9.5, Article VII, Division 13 , Section 9.5-345 (m) ,
Mangroves and Submerged Lands.
LDR Coordinator, Ty Symroski discussed an Amendment to
the Land Development Regulations, Chapter 9.5, Article VII,
Division 13, Sections 401 to 415, regarding Signs.
PUBLIC HEARING
Growth Management Director, Bob Herman gave an Overview
of the Land Development Regulation Process and the Public Hearing
to consider proposed amendments to the Land Development
Regulations (Chapter 9.5 of the Monroe County Code, Amended)
including without limitation: revisions to the floodplain
standards and procedures, revision to sign standards and
procedures, addition of a provision allowing the County to enter
into development agreements, and addition of a provision to allow
trimming of mangroves.
A Public Hearing was held concerning an Ordinance
amending the Language of Monroe County Code Chapter 9.5, Sections
401-415, the Sign Ordinance; Providing for repeal of all

Ordinances inconsistent herewith; Providing for transmittal to
the Secretary of State of the State of Florida; and providing an
effective date. County Attorney, Randy Ludacer read by title
only. Randall Mearns, Mary Schindler, representing the Marathon
Chamber, Richie Moretti, representing the Marathon Old Town
Merchants Association, and Bettye Chaplin addressed the Board.
A Public Hearing was held concerning an Ordinance
amending the Land Development Regulations (Chapter 9 .5, Monroe
County Code) by creating code chapters 9.5-101 and 9.5-102,
authorizing Development Agreements and providing for
implementation procedures; Providing for repeal of all Ordinances
inconsistent herewith; Providing for transmittal to the Secretary
of the State of the State of Florida; and providing an effective
date. County Attorney, Randy Ludacer read by title only. George
A. Berry, III, representing Terra Cotta Realty Company, Robert R.
Ambridge, representing the Ocean Reef Club, Inc. , and Special
Litigation Counsel, Jim Hendrick addressed the Board.
A Public Hearing was held concerning an Ordinance
amending the language of Monroe County Code Chapter 9.5-315, 9.5-
316, and 9.5-317, the Floodplain Management Ordinance; Providing
for the repeal of all Ordinances inconsistent herewith; Providing
for transmittal to the Secretary of State of the State of
( Florida; and providing an effective date. County Attorney, Randy
Ludacer, read by title only. George Kundtz, representing the
Florida Keys Citizens Coalition and Karen Roberts, representing
the Dolphin Research Center addressed the Board.
A Public Hearing was held concerning an Ordinance
amending the language of Monroe County Code Chapter 9.5-345 (m) ,
"Mangroves and Submerged Lands"; Providing for the repeal of all
Ordinances inconsistent herewith; Providing for Transmittal to
the Secretary of State of the State of Florida; and providing an
effective date. County Attorney, Randy Ludacer read by title
only. Karen Roberts, representing the Dolphin Research Center
and George Knudtz, representing the Florida Keys Citizens
Coalition addressed the Board.
Motion was made by Commissioner Cheal and seconded by
Commissioner Reich to continue the above Public Hearings to
January 18, 1994 at 5:01 P.M. Motion carried unanimously.
