Item C 13 Fourth Amendment to Contract with William P. Horn Architect, P.A. for design
and construction documents for the beachside playground in Phase 1 of Higgs Beach redesign.
Enclosed is a duplicate original.

FIRST AMENDMENT TO CONTRACT
BETWEEN OWNER AND ARCHITECT/ENGINEER FOR
REPLACEMENT OF PERIMETER FENCING AT
WEST MARTELLO TOWERS, KEY WEST FLORIDA
THIS FIRST AMENDMENT (herein after "AMENDMENT") to the CONTRACT
BETWEEN OWNER AND ARCHITECT/ENGINEER ("CONTRACT" or "AGREEMENT")
for the Replacement of Perimeter Fencing at the West Martello Towers, entered into by
MONROE COUNTY ("Owner" or "County"), and BENDER & ASSOCIATES ARCHITECTS,
P.A. ("Architect)) is made and entered into this 15`l' day of June, 2011 in order to amend the
CONTRACT as follows:
WITNESSETH
WHEREAS, on January 20, 2010 the parties entered into a Continuing Contract where
professional services are to be rendered for projects in which the estimated construction costs of
each individual project under contract does not exceed Two Million Dollars ($2,000,000.00), or
for study activity if the fee for professional services for each individual study under the contract
does not exceed Two Hundred Thousand Dollars ($200,000.00); and
WHEREAS, on May 19'', 2010 the parties entered into a Contract for Professional Services for
the replacement of the perimeter fencing at the West Martello Towers in Key West Florida for a
lump sum cost of $11,300.00; and
WHEREAS, on January 19, 2011 a Construction Contract was approved by the Owner in the
amount of $24,460.00 for a portion of the fencing replacement, utilizing most of the budgeted
funds; and
WHEREAS, additional funding was granted by the Tourist Development Council on May 10,
2011 in the amount of $45,000.00 to continue with the fence replacement; and
WHEREAS, a small section of the fencing needs re -designing because of the width of the wall in
that area; NOW THEREFORE
IN CONSIDERATION of the mutual promises contained herein, the parties hereby agree as
follows:
1. The re -design work shall include drawings and specifications for the redesigned portion
of the fencing, a second pre -bid conference on site, addenda, site visits, and the revision
of bid documents, which shall be at an additional service. Upon completion of the
redesign the Architect shall provide sealed drawings and any other documents for the
Owner's approval and, as requested for informational purposes, by the Monroe County

Project Management Department. The design and specifications shall be done in a
manner which will enable the County to have the project permitted, and redesigned if
necessary until a permittable design is attained. Architect shall provide all copies of the
sealed drawings without additional cost, to and as required by, the Monroe County
Project Management Department.
2. The Owner and the Architect/Engineer agree that cost of this specific scope of
work, and related items shall not exceed the total lump sum amount of Four
Thousand and Eight Hundred Dollars ($4,800.00), and no further additional
services shall be awarded for this fencing project, see Exhibit "A".
3. The remaining terms of the CONTRACTS, dated January 20, 2010 and May 19`h, 2010,
not inconsistent herewith, shall remain in full force and effect.
WHEREOF, the parties hereto have executed this Amendment on the date stated
