WHEREAS, the DEPARTMENT has determined that this program has
changed such that funds have become available for the DEPARTMENT to
provide directly to the COUNTY under Chapter 96-321, Laws of Florida,
a portion of the funds available to the COUNTY for 1996 will be
provided to the COUNTY through this Amendment.
In and for the mutual covenants between them, the DEPARTMENT
and the GRANTEE agree -that the following amendments shall apply to the
above referenced Agreement:
Paragraph 2 is amended by adding the following sentence:
The COUNTY also agrees to complete the projects known as: Channel
Marker Repair/Replacement; Derelict Vessel Removal Phase II, Smathers
Beach Buoys; Tavernier Creek Piling Relocation; -Barcelona Boat Ramp
Reconstruction; and Reef Mooring System Repairs. These projects are
identified in the attached documentation which is made a part of this
Agreement by reference.
Paragraph 3, Sentence Two is amended as follows: The COUNTY
agrees to complete these projects on or before two years from the
effective date of this Amendment. This amendment becomes effective
upon full execution by both parties.
Paragraph 4 is amended as follows: The DEPARTMENT agrees to
obligate and make available to the COUNTY the approved project amount
of $142,330.73 for the projects authorized by this amendment for a
total of $208,855.96 for this agreement. The DEPARTMENT and COUNTY
understand and agree that there shall be no reimbursement of funds by
the DEPARTMENT for any expenditure made prior to the execution of the
Agreement with the exception of $ 129,007.73 for the following
expenditures: Channel Marker Repair/Replacement; Derelict Vessel
Removal Phase II, Smathers Beach Buoys; Tavernier Creek Piling
Relocation; and Reef Mooring System Repairs.

This Amendment provides 75% of all funds available to the
COUNTY under Chapter 96-321, Laws of Florida through the Fiscal Year
1996-97 allocation. The COUNTY has $496,407.47 remaining pursuant to
said Chapter.
In all other respects the Agreement of which this is an
Amendment and attachments relative thereto shall remain in full force
and effect.
IN WITNESS WHEREOF, the parties hereto have duly executed
this Agreement on the day and year first above written.
