Approval of a resolution to transmit to the Florida Department of Community Affairs an amendment to Policy
101.2.6 of the Monroe County 2010 Comprehensive Plan Future Land Use Element to extend the moratorium of
new transient residential units to be consistent with the deadline to transmit and adopt comprehensive plan
evaluation and appraisal based amendments.
ITEM BACKGROUND:
The current Comprehensive Plan Policy 10 1.2.6 implements a transient use moratorium that expired on July 31,
2010 in the Comprehensive Plan; but, the Land Development Code moratorium was extended until December
31, 2011. On June 10, 2010, the Planning Commission held a public hearing and voted to recommend that the
Board of County Co (BOCC) transmit a proposed amendment to Policy 101.2.1 to extend the
transient use moratorium until the average occupancy rate exceeded 90 %, as recommended by staff. On July 21,
2010, the BOCC voted to transmit an amendment to Policy 101.2.6 to DCA to extend the transient use
moratorium to December 31, 2011.
On September 30, 2010, the Florida Department of Community Affairs submitted its Objections,
Recommendations and Comments (ORC) Report which recommended that the County consider extending the
moratorium to coordinate with the EAR -based amendments. Staff determined that this change to the original
amendment recommended by the DCA required a re- review by the Planning Commission. The Planning
Commission held a public hearing in Marathon on March 9, 2011 and, based on the facts presented at the
meeting, recommended approval of the proposed amendment to Policy 101.2.6 to extend the transient use
moratorium as recommended by staff. The proposed amendment is consistent with DCA's ORC report
recommendation.

I.BACKGROUND
Pursuant to DCA Rule 9J- 14.022, F.A.C., January 4, 1996; Rule 28- 20.100 F.A.C. Part
I, January 2, 1996 and Part II, July 17, 1997, Policy 101.2.6 was adopted which stated:
By January 4, 1996, Monroe County shall adopt Land Development
Regulations which prohibit new transient residential units including
hotel or motel rooms, campground spaces, or spaces for parking a
recreational vehicle or travel trailer until December 31, 2001. Monroe
County shall either extend this prohibition until December 2006 or revise
the Permit Allocation System to allocate a percentage of residential
growth to transient units.
This policy was adopted because hotel units are considered units that impact hurricane
evacuation and the Florida Keys carrying capacity. In addition, Transient Residential
Units (TRUs) require Rate of Growth Ordinance (ROGO) allocations, which are limited
in supply and compete with residential housing unit permitting.
Policy 101.2.6 of the Monroe County Comprehensive Plan currently states:
Monroe County shall prohibit new transient residential units
including hotel or motel rooms, campground spaces, or spaces for
parking a recreational vehicle or travel trailer until July 31, 2010.

2 adopted Ordinance No. 035 -2009, which amended Policy 101.2.6 of the Monroe County
3 2010 Comprehensive Plan to extend the existing transient unit moratorium until July 31,

12 For pluposes of this staff report, hotel or motel rooms, campground spaces, and spaces
13 for parking a recreational vehicle or travel trailer will be referred to as Transient
14 Residential Units (TRUs).

16 Occupancy data provided by the Tourist Development Council is included in Exhibit A.
17 Further study is required to assess the need for additional TRUs to accommodate peak
18 season demand. Staff therefore recommends that Policy 101.2.6 be amended to allow
19 staff to conduct a study of transient unit needs and trends as part of the Evaluation and
20 Appraisal Report (EAR).

36 As a result of 2011 Legislation (HB 7207), the requirements for the evaluation and
37 appraisal of the comprehensive plan (Section 163.3191, F.S.) have been substantially
38 amended. The Department of Community Affairs is in the process of developing the
39 evaluation and appraisal of comprehensive plans notification schedule in accordance with
40 HB 7207. The anticipated deadline for the the Monroe County Evaluation and Appraisal
41 Report (EAR) letter is May 1, 2014. EAR -based amendments are to be adopted one year
42 after the submittal of the EAR letter, which would be May 1, 2015. The following
43 proposed amendment is consistent with the recommendation of the Florida Department of
44 Community Affairs ORC Report of September 30, 2010:

II. PROCESS
Amendments to the Goals, Objectives, and Policies of the Comprehensive Plan may be
proposed by the Board of County Commissioners (BOCC), the Planning Commission or
the Director of Planning. The Director of Planning shall review and process amendments
and pass them on to the Development Review Committee and the Planning Commission
for recommendation and final approval by the BOCC.
The Planning Commission and the BOCC shall each hold at least one public hearing on a
proposed amendment. The Planning Commission shall review the amendment, the
reports and recommendations of the Department of Planning & Environmental Resources
and the Development Review Committee, and the testimony given at the public hearing,
and shall submit its recommendations and findings to the BOCC. The BOCC shall
consider the staff report, recommendation, and testimony given at the public hearings and
may either deny the application or adopt or not adopt a resolution transmitting the
proposed amendment to the DCA. Amendments are then reviewed by the Florida
Department of Community Affairs and returned to the County with objections, rejections
and comments to be considered prior to adoption of the ordinance. Then, a hearing is
scheduled for the BOCC to adopt, adopt with changes or to not adopt the proposed
amendment.
III. ISSUES
The development of new TRUs will have an impact on a number of health, safety and
quality of life issues such as: hurricane evacuation, workforce/employee housing,
wastewater treatment (water quality), traffic volumes and increased demand on the
natural environment through increased use of the reefs, and the waters off the Florida
Keys. The main objective of this amendment is to extend the date of the transient use
moratorium to provide additional time for staff to review and evaluate transient unit
needs, trends, and possible mitigation strategies. Through the EAR -based amendments,
Monroe County will evaluate and address the creation of policy strategies to promote the
redevelopment and development of new TRUs and evaluation the impacts of new TRUs.
A. Issues to be Evaluated and Addressed Through the EAR and EAR-Based
Amendments

The Monroe County Tourist Development Council (TDC) gets their lodging counts from
the Florida Department of Business & Professional Regulation license database.
According to the TDC, in 2009 there were 11,358 actively licensed hotels, motels, B &Bs
and condo hotels. In addition there were 1,913 vacation rentals, resulting in a total of
13,271 transient rental units. In addition, there are about 2,700 Campground/RV park
units for a grand total of just under 16,000 transient accommodations in Monroe County
(See Exhibit B).
2. Hotel Occupancy Rates
Occupancy rates are a travel industry standard for assessing the ability of available beds
to meet existing and anticipated demands. The Monroe County Tourist Development
Council (TDC) maintains a database for occupancy rates which is prepared by Smith
Travel Research, Between 1999 and 2009, the average annual county-wide occupancy
rate for Monroe County has varied from 66.4% (2001) to 72.2% (2003) (See Exhibit A).
B. Comprehensive Plan Update Process
Monroe County has contracted with the firm Keith & Schnars to prepare an update of the
Monroe County Comprehensive Plan and Evaluation and Appraisal Report (EAR). As
part of this process, Keith & Schnars will be preparing an economic base analysis, with
updated economic and population projections, that will more precisely determine the
need for expanding Monroe County's tourist based economy. The Comprehensive Plan
Update, Technical Document, and other analysis will provide additional data that can be
utilized to serve as the data and analysis to justify any lifting of the transient use
moratorium that could result in the creation of a transient unit pool as part of the
County's annual ROGO allocation.
C. Hurricane Evacuation
Policy 216.1.8 of the Monroe County 2010 Comprehensive Plan states:

The evacuation plan shall be monitored and updated on an annual basis to reflect
increases, decreases and or shi, fIs in population; pa todarly the resident and non -

For the purpose of implementing Policy 216.1.8, this Policy shall not increase the
number of allocations to more than 197 residential routs a year, except for
workforce housing. Any increase in the number of allocations shall be for
wnrl¢orce housing only.
The occupants of TRUs are required to evacuate in advance of the permanent resident
population, who require evacuation 24 hours prior to landfall of a major hurricane.
IV. Consistency with the Principles for Guiding Development in the Florida Keys
Area of Critical State Concern pursuant to Section 3$0.0552(7), F.S. For the
purposes of reviewing consistency of the adopted plan or any amendments to that plan
with the principles for guiding development and any amendments to the principles, the
principles shall be construed as a whole and no specific provision shall be construed or
applied in isolation from the other provisions.
(a) Strengthening local government capabilities for managing land use and
development so that local government is able to achieve these objectives without
continuing the area of critical state concern designation.
(b) Protecting shoreline and marine resources, including mangroves, coral reef
formations, seagrass beds, wetlands, fish and wildlife, and their habitat.
(c) Protecting upland resources, tropical biological communities, freshwater wetlands,
native tropical vegetation (for example, hardwood hammocks and pinelands), dune ridges
and beaches, wildlife, and their habitat.

character of the Florida Keys.

(h) Protecting the value, efficiency, cost - effectiveness, and amortized life of existing
and proposed major public investments, including:
1. The Florida Keys Aqueduct and water supply facilities;
2. Sewage collection, treatment, and disposal facilities;
3. Solid waste treatment, collection, and disposal facilities;
4. Key West Naval Air Station and other military facilities;
5. Transportation facilities;
6. Federal parks, wildlife refuges, and marine sanctuaries;
7. State parks, recreation facilities, aquatic preserves, and other publicly owned
properties;
8. City electric service and the Florida Keys Electric Co-op; and
9. Other utilities, as appropriate.
(i) Protecting and improving water quality by providing for the construction, operation,
maintenance, and replacement of stormwater management facilities; central sewage
collection; treatment and disposal facilities; and the installation and proper operation and
maintenance of onsite sewage treatment and disposal systems.
0) Ensuring the improvement of nearshore water quality by requiring the construction
and operation of wastewater management facilities that meet the requirements of ss.
381.0065(4)(1) and 403.086(l 0), as applicable, and by directing growth to areas served by
central wastewater treatment facilities through permit allocation systems.
(k) Limiting the adverse impacts of public investments on the environmental resources
of the Florida Keys.
0) Making available adequate affordable housing for all sectors of the population of the
Florida Keys.
(m) Providing adequate alternatives for the protection of public safety and welfare in
the event of a natural or manmade disaster and for a postdisaster reconstruction plan.
(n) Protecting the public health, safety, and welfare of the citizens of the Florida Keys
and maintaining the Florida Keys as a unique Florida resource.
Staff finds the proposed amendment consistent with the Principles for Guiding
Development as a whole and is not inconsistent with any one principle.

Colnpre:hcnsive Plant Amendrrtent (I)CA No. 10 -2), which was received on July 29 2010.
Copies of the proposed amendment have been distributed to appropriate state, regional, and local
agencies for their review and their comments arc enclosed,
The Department has reviewed the comprehensive plan amendment for consistency with
Rule 9J -5, Florida Administrative Code, Chapter 380, Florida Statutes, and Chapter 163, Part 11,
Florida Statutes, and the Monroe County Comprehensive Plan. The Department does not identify
any objections, and this letter serves (is the Objections. Recommendations and Comments report,
Monroe County proposes amending Policy 101.2.6 to extend the existing; transient unit
moratorium until July 31, ' The County indicated in the analysis and staff report that Keith
& Schnars had heen hired to prepare an economic base analysis with updated economic turd
population projections as part of the County's Evaluation and Appraisal Report. The analysis
will more precisely determine the need for expanding Monroe County's tourist based economy.
Staffhas no objection to the proposed amendment. The Department recommends the County
consider extending the moratorium date to he consistent with the due date for the County's
hased amendments which would provide the County adequate time to research the iss•y =.

Comments on Proposed Comprehensive Plan Amendment
The South Florida Water Management District (District) has completed its review of the
proposed amendment from Monroe County (County). The amendment consists of a
date change to the text of Policy 101.2.6 of the County's Comprehensive Plan. The
change extends the moratorium on new transient residential units from July 31, 2010 to
December 31, 2011. There appear to be no significant water resource related impacts.
Therefore, we forward no comments on the proposed amendment.
The District offers its technical assistance to the County, their water supplier, the Florida
Keys Aqueduct Authority, and the Department of Community Affairs in developing
sound, sustainable solutions to meet the County's future water supply needs and

COMPREHENSIVE PLAN TO CLARIFY THE DEFINITION AND
APPLICATION OF SUB AREA POLICY FOR PROPERTY
LOCATED WITHIN UNINCORPORATED MONROE COUNTY.
WHEREAS, the Monroe County Board of County Commissioners conducted a public
hearing for the purpose of considering the transmittal to the Florida Department of Community
Affairs for review and comment a proposed amendment to the Monroe County Year 2010
Comprehensive Plan as described above; and
WHEREAS, the Monroe County Planning Commission and the Monroe County Board
of County Commissioners support the requested text amendment;
NOW THERFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA:
Section 1: The Board of County Commissioners does hereby adopt the recommendation of
the Planning Commission to transmit the draft ordinance for adoption of the
proposed text amendment.
38 Section 2 _ The Board of County Commissioners does hereby transmit the proposed
39 amendment to the Florida Department of Community Affairs for review and
40 comment in accordance with the provisions of Chapter 163.3184, Florida Statutes.

COUNTY COMMISSIONERS AMENDING POLICY 101.2.6 OF
THE MONROE COUNTY 2010 COMPREHENSIVE PLAN
REGARDING THE MORATORIUM FOR TRANSIENT UNITS;
PROVIDING FOR SEVERABILITY; PROVIDING FOR THE
REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH;
DIRECTING THE PLANNING DIRECTOR TO FORWARD A
COPY TO THE STATE OF FLORIDA LAND PLANNING
AGENCY; PROVIDING FOR FILING WITH THE SECRETARY
OF STATE; PROVIDING FOR THE INCORPORATION INTO
THE COMPREHENSIVE PLAN; PROVIDING FOR AN
EFFECTIVE DATE
WHEREAS, the Monroe County Board of County Commissioners makes the
following Findings of Fact:
1. Pursuant to DCA Rule 9J- 14.022, F.A.C., January 4, 1996; Rule 28-
20.100 F.A.C. Part I, January 2, 1996 and Part II, July 17, 1997, Policy
101.2.6 was adopted which stated: By January 4, 1996, Monroe County
shall adopt Land Development Regulations which prohibit new transient
residential units including hotel or motel rooms, campground spaces, or
spaces for parking a recreational vehicle or travel trailer until December
31, 2001. Monroe County shall either extend this prohibition until
December 2006 or revise the Permit Allocation System to allocate a
percentage of residential growth to transient units.
2. The Board of County Commissioners adopted Ordinance No. 47 -1999 on
November 10, 1999, creating Sec. 9.5 -120.5 (138 -23) of the Monroe
County Code, which stated: New transient residential units, such as hotel
or motel rooms, or campground, recreational vehicle or travel trailer
spaces, shall not be eligible for residential ROGO allocations until
January 1, 2002.

3. The Board of County Commissioners adopted Ordinance No. 001 -2002, to
extend the Monroe County Code moratorium on new transient unit
allocations from January 1, 2002 to December 31, 2006.
4. The Board of County Commissioners adopted Ordinance No. 001 -2007, to
extend the Monroe County Code moratorium on new transient unit
allocations from January 1, 2006 to December 31, 2008.
5. Any strategy to permit new transient units must address the impacts of
transient units on hurricane evacuation and workforcelemployee housing
through the adopted Permit Allocation System.
6. The Board of County Commissioners at a special public hearing on July
13, 2009, adopted Ordinance No. 035 -2009 to amend Policy 101.2.6 of the
Monroe County 2010 Comprehensive Plan, to extend the existing transient
unit moratorium until July 31, 2010.
7. The Board of County Commissioners, at a regularly scheduled public
hearing on July 21, 2010, voted to transmit to the Florida Department of
Community Affairs, an amendment to Policy 101.2.6 of the Monroe
County 2010 Comprehensive Plan to extend the existing transient unit
moratorium until December 31, 2011.
8. On September 30, 2010, the Florida Department of Community Affairs
issued its Objections, Recommendations and Comments Report,
recommended that the County consider extending the moratorium date to
be consistent with the due date for the County's EAR -based amendments
which would provide the County adequate time to research the issue.
9. The Monroe County Evaluation and Appraisal Report (EAR) letter is to be
submitted to the State by August 1, 2011. EAR -based amendments are to
be adopted within one year after the submittal of the EAR letter. Which
would be August 1, 2012, to be consistent with the deadline to transmit
Comprehensive Plan EAR -based Amendment
10. On March 9, 2011, the Monroe County Planning Commission voted to
recommend that the Board of County Commissioners transmit the
proposed amendment to Policy 101.2.6 to extend the transient use
moratorium as recommended by staff.
11. As a result of 2011 Legislation (HB 7207), the requirements for the
evaluation and appraisal of the comprehensive plan (Section 163.3191,
F.S.) have been substantially amended. The Department of Community
Affairs is in the process of developing the evaluation and appraisal of
comprehensive plans notification schedule in accordance with HB 7207.
The anticipated deadline for the the Monroe County Evaluation and
Appraisal Report (EAR) letter is May 1, 2014. EAR -based amendments
are to be adopted one year after the submittal of the EAR letter, which
would be May 1, 2015. The following proposed amendment is consistent

with the recommendation of the Florida Department of Community
Affairs ORC Report of September 30, 2010.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, THAT:
Section 1, Policy 101.2.6 shall be amended as follows:
Monroe County shall prohibit new transient residential units including hotel or motel
rooms, campground spaces, or spaces for parking a recreational vehicle or travel trailer
until july 3 4, 2010 May 1. 2014
Section 2. If any section, subsection, sentence, clause, item, change, or
provision of this ordinance is held invalid, the remainder of this ordinance shall not be
affected by such validity.
Section 3. All ordinances or parts of ordinances in conflict with this
ordinance are hereby repealed to the extent of said conflict.
Section 4. This ordinance shall be transmitted by the Planning Department to
the State Land Planning Agency to determine the consistency of this ordinance with the
Florida Statutes.
Section 5. This ordinance shall be filed in the Office of the Secretary of State of
Florida, but shall not become effective until a notice is issued by the State Land Planning
Agency or Administrative Commission approving the ordinance.
