This agreement is performance based and developed consistent with EPA's policy on Performance Based Grants and Region IV's policy for Management of Grants and Cooperative Agreements. The workplan constitutes the recipient's and EPA's commitment to accomplish the program goals and objectives. EPA's review and evaluation of performance under this agreement and EPA's response to the findings of oversight will be carried out in accordance with the stated policies. 2. The recipient agrees to negotiate a "Fair Share" percentage of not less than 8% with EPA before the recipient begins the process to award any contracts under this agreement. The recipient must ensure to the fullest extent possible that at least the negotiated "Fair Share" percentage of Federal funds for prime contracts or subcontracts for supplies, construction, equipment or services are made available to organizations owned or controlled by socially and economically disadvantaged individuals, women, and historically black colleges and universities. The recipient agrees to include in its bid documents a "Fair Share" percentage of not less than 8% and require all of its prime contractors to include in their bid documents for subcontracts the same provision. To evaluate compliance with the "Fair Share" policy, the recipient also agrees to comply with the six affirmative steps stated in 40 CFR 33.240, 31.36(e) or 35.6580 (a) as appropriate. The recipient agrees to submit a SF-334 "MBE/WBE Utilization under Federal Grants, Cooperative Agreements, and other Federal Financial Assistance", to the Equal Opportunity Officer beginning with the Federal Fiscal Year Quarter the recipient awards its first contract and continuing until all contracts and subcontracts have been reported. These reports must be submitted within 30 days of the end of the Federal Quarter (January 30, April 30, July 30 and October 30). Atlanta, Georgia 30365 In accordance with Section 129 of Public Law 100-590, the Small Business Administration Reauthorization and Amendment Act of 1988, the recipient agrees to utilize and to encourage any prime contractors under the assistance agreement to utilize small businesses located in rural areas to the maximum extent possible. The recipient agrees to follow the six affirmative steps stated in 40 CFR 33.240, 31.36 or 35.6580 as appropriate, in the award of any contracts under this assistance agreement. This award and resulting ratio of funding is based on estimated cost requested in the application. Final allowable cost for EPA participation shall not exceed the statutory limitation of total eligible program cost or total funds awarded. 4. When issuing statements, press releases, requests for proposals, bid solicitations, and other documents describing projects or programs funded in whole or in part with Federal money, all grantees receiving Federal funds including but not limited to State and local governments shall clearly state (1) the percentage of the total cost of the program or project which will be financed with Federal money, and (2) the dollar amount of Federal funds for the project or program, and (3) percentage and dollar amount of the total costs of the project or program that will be financed by nongovernmental sources. 5. Pursuant to EPA Order 1000.25, dated January 24, 1990, the recipient agrees to use recycled paper for all reports which are prepared as a part of this agreement and delivered to the Agency. This requirement does not apply to reports which are prepared on forms supplied by EPA. This requirement applies even when the cost of recycled paper is higher than that of virgin paper. 6. This agreement is a project type cooperative agreement subject to the terms and conditions of the approved work program. Costs incurred prior to the date of award as shown in block 3 are not allowable for reimbursement under this award. 7. Responsibility for oversight and coordination regarding schedules and progress of the work described in this coopeative agreement rests with EPA Region IV. The recipient, in cooperation with the EPA Project Officer, shall develop subject outlines and formats for final report. 8. Quarterly progress reports are required. The recipient shall provide reports of progress to the EPA Project Officer in Region IV. These reports consist of updates on progress toward work objectives, any problems encountered, actions taken to resolve problems, discussion of remaining tasks, and expenditures to date. 9. The recipient is required to submit copies of all subagreements and/or contracts entered into via this cooperative agreement to the EPA Project Officer within 30 days of signature. 10. All projects under this cooperative agreement which involve environmental sampling and analysis must have an EPA approved quality assurance (QA) plan in place prior to commencement of work. Work plans must also be approved by EPNs Office of Research and Development.
