The Key West Business Guild, for an amount not to exceed $8,000,00, Fiscal Year 1994, Two Penny, covering the Women in Paradise Festival, on July 11-18, 1994. The Key West Business Guild, for an amount not to exceed $18,000.00, Fiscal Year 1994, Two Penny, covering the Gay Arts Festival, on June 19-26, 1994. After -the -fact funding for a Funding Agreement with the Middle Keys Concert Association for their upcoming Fiscal Year 1994 series, in an amount not to exceed $1,000.00. The Keys Classic Anglers Tournaments, Inc., for an amount not to exceed $18,500.00, Fiscal Year 1994, Two Penny, covering the Texaco Hemingway Key West Classic Fishing Tournament, on April 27-30, 1994. An Addendum to the Agreement between Monroe County and USA 800, Inc., to provide continued services as backup to the telemarketing/mail fulfillment program. DeSanti Deputy Clerk cc: County Attorney , County Administrator, w/o documents Finance Director, c/o Karin Goddard Risk Management, w/o documents ,File U 0 FUNDING AGREEMENT THIS AGREEMENT is entered into this r day of _ ©1993, by and between the BOARD OF COUNTY COMMISSIONERS, Monroe County, Florida, hereinafter referred to as the BOCC and Holiday Isle Resort & Marina hereinafter referred to as "Event Sponsor"; WHEREAS, the BOCC, upon recommendation of the Monroe County Tourist Development Council, hereinafter referred to as the TDC, has budgeted a portion of tourist development revenues for promotion and support of certain fishing events; and WHEREAS, the umbrella organization under contract .to the BOCC has recommended that certain monies be allocated to Event Sponsor; now THEREFORE, in consideration of the mutual promises contained herein, the parties agree as follows: 1. BOCC shall pay to Event Sponsor a sum not to exceed five thousand dollars ($5,000.00) for promotion and related expenditures in producing the 11 th Annuajjioliday Isle Dolphin Tournament, June 3-5,1994, pursuant to the terms of the Funding Applicafion, attached o hereto and incorporated herein by reference (Exhibit A). Should a breach occur after the expenditure of funds by BOCC for an ent, -a nd nd the event does not occur as a result of said breach, Event Sponsor shall reimburse $OC64or the amount of funds expended by the BOCC in connection with said event. 2. Event Sponsor shall provide promotion and related services as described in detail in the Funding Application (Exhibit A). 3. Indemnification and Hold Harmless: Event Sponsor agrees to indemnify and hold Monroe County harmless for any and all claims, liability, losses and causes of action which may arise out of the fulfillment of the agreement. It agrees to pay all claims and losses and shall defend all suits filed due to the negligent acts, errors or omissions of the Event Sponsor's employees and/or agents, including related court costs. 4. Insurance Requirements: Event Sponsor shall carry during the term of this agreement public liability insurance, including bodily injury and property loss damage to cover all claims, demands or actions by any person or entity in anyway arising from the operation, of this event(s). Such liability insurance shall be in an amount not less than $500,000. Monroe County and the Monroe County Tourist Development Council shall be named as additional insured under the insurance policy and such insurance shall be primary and non contributing with any insurance carried by the County. Event Sponsor shall furnish the County with a certificate evidencing the insurance required by this paragraph not later than twenty (20) days prior to the event. 5. Event Sponsor shall maintain records to be kept pursuant to generally accepted accounting principles, for three years after the event, and shall permit BOCC and its agents and employees access to said records at reasonable times. 1 6. For any breach of the covenants contained herein or in Exhibit A, BOCC may terminate this agreement immediately upon service of notice of termination. BOCC may terminate this agreement without cause upon providing 120 days notice of termination. 7. Event sponsor is an independent contractor and shall disclose any and all potential conflicts of interest as defined by Florida Statute, Chapter 112 and Monroe County Code, Article XXI . 8. Force Majeure: Event Sponsor shall not be liable for delay in performance or failure to perform, in whole or in part, the services due to the occurrence of any contingency beyond its control or the control of any of its subcontractors or suppliers, including labor dispute, strike, labor shortage, war or act of war whether an actual declaration thereof if made or not insurrection, sabotage, riot or civil commotion, act of public enemy, epidemic, quarantine restriction, accident, fire, explosion, storm, flood, drought or other act of God, act of any governmental authority, jurisdictional action, or insufficient supply of fuel, electricity, or materials or supplies, or technical failure where Event Sponsor has exercised reasonable care in the prevention thereof, and any such delay or failure shall not constitute a breach of this Agreement. 9. Ethics Clause: Event Sponsor warrants that he/she/it has not employed retained or otherwise had act on his/its behalf any former COUNTY office or employee in violation of Section 2 or Ordinance No. 10-1990 or any COUNTY officer or employee in violation of Section 3 of Ordinance No. 10-1990. For breach or violation of the provision the COUNTY may, at its discretion terminate this contract without liability and may also, at its discretion, deduct from the contract or purchase price, or otherwise recover, the full amount of anyrfee, commission, percentage, gift, or consideration paid to the former or present COUNTY officer or employee. Typically, the event has run the first weekend in June, which is a slower weekend for our resort. It also falls within FKFT's designated non -peak period. AMOUNT OF FUNDING REQUESTED FROM FKFT $11,000 IMPACT ON TOURISM The Tournament carries a $60 entry fee, and participants are given a cocktail party, an awards barbeque and other. items of interest. Anglers bring both families and friends to the area for this tournament. Many of them rent charter boats, dine in area restaurants and shop in area stores. Families often enjoy local attractions while the anglers fish. - 1 - PAGE TWO HOLIDAY ISLE TENTH ANNUAL DOLPHIN TOURNAMENT COMMITMENT TO THE EXPANSION OF TOURISM Holiday Isle has a proven commitment to the expansion of tourism in Monroe County. AS a business which can only survive when tourism occurs, it is in the best interest of our staff to run events which will bring tourist to our area. We have placed emphasis on growth and expansion of our tournament. Holiday Isle will work with the FKFT, the TDC, the BOCC and the private sector to do its part to make this tournament a winner for all concerned. SOUNDNESS OF PROPOSED TOURNAMENT The ten year history of this tournament proves its viability as an event for the Islamorada area. The tournament has maintained a loyal base of anglers, captains and social members over the years, while gradually expanding to include new visitors to and anglers. Holiday Isle is committed to the protection of our environment. Therefore, all of our tournaments emphasis release, education, and tagging where applicable. Our tournaments rely heavily on the release format. In our Dolphin Tournament, we have asked that all non -entered fish be released. We have also decided that no fish under 20 pounds will be accepted for entry. Holiday Isle is actively searching for sponsors who will help make this event a success. Sponsors, provide prizes, raffle items and cover other tournament expenses which are not TDC fundable. Our organization has begun an aggressive search for outside sponsorship of all of our events -2- PAGE THREE HOLIDAY ISLE TENTH ANNUAL DOLPHIN TOURNAMENT Kay Carter, our dockmaster and tournament director, maintains order in our marina. She has worked on all of our tournaments since she started at Holiday Isle. She also assists hotel guests and locals with booking charters. Once the captains at Holiday Isle are full, Kay begins to refer guests to other charter captains in the area. Steve Crumley is responsible for coordinating funding for all TDC funded events. He works closely with sponsors, the TDC, FKFT, and the staff at Holiday Isle to be sure that event budgets are established and followed. He also coordinates public relations for the resort. He works with Stewart Newman and Associates on all TDC funded events, and coordinates efforts for local, regional and national publicity. Our in house advertising department, run by Adrienne Elder, designs and produces all ads for our events. This allows us to save agency commissions on all media placements. Our expert staff makes the best buys for our advertising dollars. Special Events Coordinator Eileen McGuire works with the tournament staff to provide input and suggestions for smooth implementation of the event. Eileen's experience allows us to keep staffing and problems to a minimum. Holiday Isle has an excellent staff of enthusiastic, professional, business people who work hard to make everything the resort does a great success. The center console model offers a wide deep leaning post/bench that really functions well as both; three adults can sit easily and comfortably, leaning back against the padded rest with five rocket launcher rod holders. (I wouldn't have minded a grab rail along the top of the bench backrest both for stability while seated and also while walking around the seat from bridge to cockpit.) Under the seat is a large cooler. Behind the seat is another cooler and storage area, padded for more seating. Here too are freshwater washdown and tackle drawers. Controls on the center console proved well -conceived and well - placed. The binnacles are at waist level while the steering wheel is considerably higher. The pilot could use a footrest, though; as it is he can't use the fishbox beneath the seat, available to passengers, since it doesn't extend far enough to star- board. Also, somewhere on a console Nothing about the 250 Center Console's design is stingy: Leaning post/bench seats three large adults easily. Behind it are a huge cooler and deep livewell with several tackle drawers built in. this size, I'd like to see a small drawer or shelves for catchalls. Underneath the hinged lids to these seats are huge, insulated storage areas (the portside a fishbox with overboard drain). On the standard half -tower soft top aft struts are four rocket launchers. That gives the Open a total of eight rod holders, including four flush - mounted cockpit holders. The center console offers four flush - mounts plus five rocket launchers plus six more verticals forward, for a total of 15. The cabins on both boats are appealing. The trunk cabin on the center console is particularly generous for a center console boat (though it does consume much of the foredeck), with long berths, lots of storage, a pressurized vanity sink and genuine marine head. It also isn't spartan, as are cabins on many center consoles of this size, with thick berth pads, carpeting and appointments in teak. They circle the posts slowly, sometimes with their dorsal spines sticking up out of the water. Spade - fish feed on jellyfish, and when the water is clear it is fascinating to watch them chew delicately on tentacles that are load- ed with stinging cells. The many -mouthed seajellies, which look like gigantic bluish mushrooms with trailing roots, and throb regularly like beating hearts, drift past the markers constantly. Under them are the spadefish, nibbling like rabbits in a lettuce field. One will suspend under its targeted jelly, feed as it drifts past, then move uptide again to find another cafeteria, never going far from the post that functions as its security blanket. You can catch these spadefish with the right bait. Tiny pieces of squid are best, but the synthetic preparation ProBait works well and is much tougher than squid. A quarter -ounce jighead with no dress- ing, poured on a No. 2 hook, is a more convenient rigging than the customary sinker -and -hook arrangement. With a long rod rigged, wait until a big spadefish swims into view, and lower the baited hook to the fish. For their size, they are some of the hardest -fighting fish out there. Sharing the marker space with spadefish are hulking cobia, some of them large enough to eat their neighbors. Dolphin, always an unusual catch for this area, occa- sionally flit past the markers and circle around repeatedly looking for tidbits. Inshore markers may hold tripletail, fish that look like gargantuan bluegills. These relatively uncommon fish are known to suspend on their sides, noses almost touching the markers, watching the pass- ing tide for unwary bite -sized fish or shrimp. Their huge scales protect delicate- ly flavored meat, bone white in color and firm of texture. The markers of the Waccasassa Bomb- ing Range have produced tripletail in re- cent years. Anglers get them with jigs, live shrimp and pinfish. They have a nasty habit of running around the post when hooked, so it is wise to fish from a drifting boat, so you can unwind the monofila- ment and get it recycled when the fish breaks off. Inshore fishing can be excellent or fair, depending on how the trout population survives the winter netting blitz. The Big Bend area has the state's last extensive areas of seagrass, which are essential to the production of spotted seatrout.
