FY2008 2nd Amendment 08/17/2011AMENDMENT (SECOND AMENDMENT) TO MEMORANDUM OF UNDERSTANDING BETWEEN MONROE COUNTY AND MONROE COUNTY SHERIFF'S OFFICE REGARDING FY 2008 UASI GRANT THIS AMENDMENT (SECOND AMENDMENT) TO MEMORANDUM OF UN ERSTANDING ( "Amendment ") is made and entered into this 17t& day of 2011, by and between the Monroe County Board of County Corroissioners, a political subdivision of the State of Florida, whose address is 1100 Simonton Street, Key West, FL 33040, hereinafter referred to as "COUNTY," and The Monroe County Sheriff's Office, hereinafter referred to as "SHERIFF." WHEREAS, on May 19, 2010, the Board of County Commissioners approved a Memorandum of Understanding (MOU) between Monroe County, Florida ( "COUNTY ") and the Monroe County Sheriff's Office ( "SHERIFF "), in order for the COUNTY to disburse to the SHERIFF and in order for the SHERIFF to accept $201,720.00 from a grant in the total amount of $320,004 awarded to Monroe County from the Urban Area Security Initiative ( "UASI ") FY 2008 grant program from the U.S. Department of Homeland Security Office for Domestic Preparedness to the State of Florida Department of Community Affairs and a subgrant awarded by Florida DCA to the City of Miami; and WHEREAS, subsequent to the above - referenced MOU, the COUNTY applied for and was awarded $350,000 in additional funds from regional funds available via the same subgrant for the purchase of law enforcement equipment and law enforcement bomb squad equipment as well as other items, and therefore on August 18, 2010, the County and Sheriff entered into the First Amendment to the MOU in order to revise the total funds covered by the MOU; and WHEREAS, the original expiration date for this grant was May 31, 2011, however, the COUNTY and the SHERIFF were recently notified by the City of Miami, which is the overall coordinating recipient of the grant from the Florida Department of Emergency Management, that the expiration date of the grant has now been extended to August 31, 2011, with all requests for reimbursement to be submitted to Florida DEM no later than thirty (30) days following the new expiration date; and WHEREAS, the SHERIFF therefore wishes to amend the MOU approved by the BOCC on August 18, 2010 in order to extend the new "TERM" date to August 31, 2011; and WHEREAS, the SHERIFF and the COUNTY are informed that it is possible that the expiration date of the underlying agreement between the State and the City of Miami may be extended again in the future. NOW THEREFORE, in consideration of the mutual understandings and agreements set forth herein, the COUNTY and the SHERIFF agree to amend the MOU as follows: 1. Paragraph 1 of the MOU is revised to read as follows: TERM - The term of this Agreement is from November 20, 2009, through the expiration date set in UASI Contract 10DS- 48- 11 -23 -02 -195, as that date may be extended from time to time, unless earlier terminated as provided herein. WHEREAS, the Division and the Recipient have entered into the Agreement, pursuant to which the Division has provided a sub grant of $11,271,885 to Recipient; and WHEREAS, the Agreement expires on May 31, 2011; and WHEREAS, the Division and the Recipient desire to modify the Agreement by extending NOW, THEREFORE, in consideration of the mutual promises of the parties contained herein, the parties agree as follows: 1. Paragraph 3, Period of Agreement, is hereby amended to have an expiration date for the Agreement of August 31, 2011. Final requests for reimbursement should be submitted no later than thirty (30) days after the termination date of the contract. Any requests received after September 30, 2011 may, in the discretion of the Division, not be reimbursed from this Agreement. 2. All provisions not in conflict with this Modification remain in full force and effect, and are to be performed at the level specified in the Agreement. 3. All provisions of the Agreement being modified and any attachments thereto in conflict with this Modification shall be and are hereby changed to conform with this Modification, effective as of the date of the last execution of this Modification by both parties.
