03/03/1993 RegularMINUTES OF THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS Regular Meeting Board of County Wednesday, March Key West 93/92 Commissioners 3, 1993 A Regular Meeting of the Monroe County Board of County Commissioners convened at 1:00 p.m. Present and answering to roll call were Commissioner Earl Cheal, Commissioner Shirley Freeman, Commissioner Mary Kay Reich, and Mayor Jack London; Commissioner Wilhelmina Harvey was absent. Also present were Danny Kolhage, Clerk; Randy Ludacer, County Attorney; Tom Brown, County Administrator; County Staff; members of the Press and Radio; and the general public. ADDITIONS, CORRECTIONS, DELETIONS Motion was made by Commissioner Cheal and seconded by Commissioner Freeman to approve Additions, Corrections and Deletions to the Agenda. Motion carried unanimously. Commissioner Freeman introduced her Aide, Cheri Lee. COUNTY ADMINISTRATOR County Administrator, Tom Brown, Roger Braun of the Monroe County Housing Authority, and Wight Childress of Langton & Associates, addressed the Board concerning the consideration of the Monroe County Housing Authority request to continue to complete the successful inauguration of the County S.H.I.P. Program and approval to execute Contract with Langton Associates for Affordable Housing Services. Motion was made by Commissioner Freeman and seconded by Commissioner Reich to rescind the Board's previous action of the February 9, 1993 Commissioner's Meeting granting approval to Langton Associates to provide Affordable Housing Consultant Services for the S.H.I.P. Program, waiving Purchasing Policies and Procedures. Roll call vote was unanimous. Motion was made -by Commissioner Reich and seconded by Mayor London to direct the Monroe County Housing Authority to �i administer the S.H.I.P. Program for Monroe County. Roll call vote was unanimous. 93/93 Motion was made by Commissioner Reich and seconded by Commissioner Freeman to approve the advertisement of an Ordinance, provided by the Monroe County Housing Authority, for Public Hearing on March 24, 1993, providing for Monroe County to participate in the S.H.I.P. Program for affordable housing. Roll call vote was unanimous. DIVISION OF GROWTH MANAGEMENT Special Litigation Counsel, Jim Hendrick, addressed the Board concerning the Board's previous action in extending a permit on the Carter property. He advised that,,in his opinion, the County was not authorized to take that action. Motion was made by Commissioner Cheal and seconded by Commissioner Reich to reconsider the Board's previous action authorizing a permit extension on the Carter property and placing the item on the next County Commission Agenda. Motion carried unanimously. Mr. Hendrick also addressed the proposed Hearing Officer Ordinance. No official action was taken. SOUNDING BOARD Gary Young of Rafferty & Associates addressed the Board concerning outpatient substance abuse treatment program for drug offender probation referrals. This matter was referred to the Substance Abuse Policy Board. Vincent M. Drost addressed the Board concerning the merits of outside swinging exterior doors and building the Big Pine School to be hurricane proof. John Bower addressed the Board concerning a request to toll a building permit for one year. Following Board discussion, motion was made by Mayor London and seconded by Commissioner Cheal directing Mr. Herman to confer with Jim Hendrick and to present the Board with alternatives. During discussion, the motion was withdrawn. Motion was made by Mayor London and seconded by Commissioner Cheal directing Growth Management to issue a permit to Mr. Bower one year from today at no charge. Motion carried unanimously. Art Kara addressed the Board concerning the Key West International Airport remodeling project. No official action was taken. Commissioner Reich discussed the difficulty that Habitat for Humanity was having in pulling building permits in the Upper Keys. Coman Munroe, President of Habitat for Humanity, addressed the Board. Growth Management Director Bob Herman 93/94 addressed the Board. The problem was referred to Staff for recommendation. Mr. Munroe and the Commissioner also discussed fines for clearing the lots without a permit. Motion was made by Commissioner Reich and seconded by Commissioner Cheal to refund Habitat for Humanity $360.00 of the fines for clearing lots without a permit. Roll call vote was taken with the following results: Motion carried. Motion was made by Commissioner Cheal and seconded by Commissioner Reich to continue with the project and direct Staff to develop an RFP for proposals to continue the project. Roll call vote was unanimous. PUBLIC HEARING A Public Hearing was held concerning a proposed abandonment of a portion of Cross Way, Bay Point Park, Saddlebunch Key, Monroe County, Florida. Proof of Publication was noted for the record. There was no public input. Motion was made by Commissioner Cheal and seconded by Mayor London to approve the abandonment of a portion of Cross Way, Bay Point Park, Saddlebunch Key, Monroe County, Florida. Motion carried unanimously. RESOLUTION NO. 088-1993 See Res. Book No. 114 which is incorporated herein by reference. A Public Hearing was held concerning a proposed Ordinance amending Sections 6-83, 6-84, and 6-85, Providing for the appointment of an alternate examining board member to serve at any regularly scheduled meeting of the Contractor's Examining Board when a quorum cannot be reached by the attendance of three or more regular members; Providing for the method of appointment; And providing for inclusion in the limitations on terms of office, removal and vacancies; Providing for severability; Providing for repeal of all Ordinances inconsistent herewith; Providing for incorporation into the Monroe County Code; and Providing an effective date. County Attorney read by title only. Gary Centonze addressed the Board. Motion was made by Commissioner Freeman and seconded by Commissioner Reich to adopt the following Ordinance. Motion carried unanimously. ORDINANCE NO. 010-1993 See Ord. Book No. 30 which is incorporated herewith by reference. A Public hearing was held concerning a proposed Ordinance creating Section 2-534, Monroe County Code, in order to prohibit the appointment or employment of former Monroe County Commissioners as a Monroe County Officer or employee for a period od two years after leaving the County Commission; Exempting current and former Commissioners until after their next reelection; Providing for the immediate discharge of any former County Commissioner appointed or employed in violation of this Ordinance; Providing for additional penalties; Providing for severability; Providing for repeal of all Ordinances inconsistent herewith; Providing for incorporation into the Monroe County Code; and providing an effective date. Motion was made by Commissioner Cheal and seconded.by Mayor London to read by title only. Motion carried unanimously. County Attorney read by title only. Al Griffin addressed the Board. After discussion, the Ordinance was withdrawn by the sponsor, Commissioner Cheal. A Public Hearing was held concerning a proposed Ordinance creating Sec. 2-1(C); Providing authority for County Administrator to execute contracts for purchase of services and goods not to exceed $1,000.00 and contracts for services to be rendered at Bayshore Manor; Providing for severability; Providing for repeal of all Ordinances inconsistent herewith; Providing for incorporation into the Monroe County Code; and providing an effective date. Motion was made by Commissioner Cheal and seconded by Commissioner Freeman to read by title only. Motion carried unanimously. County Attorney read by title only. There was no public input. Motion was made by Commissioner Reich and seconded by Commissioner Freeman to adopt the following Ordinance. Motion carried unanimously. ORDINANCE NO. 011-1993 See Ord. Book No. 30 which is incorporated herewith by reference. COUNTY ADMINISTRATOR Motion was made by Commissioner Cheal and seconded by Mayor London to approve an Agreement with Martin Firestone for provision of consulting services concerning proposed FCC rules regarding cable television, to include filing of comments on same on behalf of Monroe County. Roll call vote was unanimous. 93/96 Mr. Martin Firestone addressed the Board concerning the Federal Communications Commission Cable Television Rule Making Proceedings. Motion was made by Commissioner Cheal and seconded by Commissioner Freeman authorizing Mr. Firestone to proceed with the certification process for the County to serve as a Rate Regulatory Authority concerning local cable franchisees. Roll call vote was unanimous. MISCELLANEOUS Mary Dee, of the Care Center for Mental Health, and Gwynn Rodriguez, of Monroe County Social Services, addressed the Board concerning their request for additional funding for Baker Act Transportation in the amount of $29,683.00 for fiscal year 1993. No official action was taken. DIVISION OF GROWTH MANAGEMENT Growth Management Director Bob Herman addressed the Board regarding his communication with the School Board concerning School Impact Fees. Motion was made by Mayor London and seconded by Commissioner Cheal to approve the disposal of the 1990 Buick Century assigned to Bob Herman, Division Director of Growth Management, by assigning it to the Building Department, and granted approval of a monthly automobile allowance of $400 per month for Bob Herman. Roll call vote was unanimous. Motion was made by Commissioner Cheal and seconded by Commissioner Reich to approve the following items: Approval of a Planning Commission recommendation regarding excess allocation of one (1) award for the 2nd quarter, October 14, 1992 through January 13, 1993, under the Dwelling Unit Allocation Ordinance (ROGO). Approval of a Restrictive Covenant, submitted by Michael Allen for building permit application number.92-1-5426; the document restricts the property owner to having only one dwelling unit on two contiguous -lots. The Restrictive Covenant for combining contiguous lots has been filed by the applicant for the second quarter allocation ended on January 13, 1993, under the requirements of the Dwelling Unit Allocation Text Amendment (Ordinance No. 016-1992). Approval of a Restrictive Covenant, submitted by Gordon Larsen for building permit application number 92-3-7155; the document restricts the property owner to having only one dwelling unit on two contiguous lots. The Restrictive Covenant for ` 93/97 combining contiguous lots has been filed by the applicant for the second quarter allocation ended on January 13, 1993, under the requirements of the Dwelling Unit Allocation Text Amendment (Ordinance No. 016-1992). Approval of an Affordable Housing Deed Restriction, submitted by Edward Albart. The Deed Restriction for Affordable Housing has been completed and filed by the applicant under the requirements of the Dwelling Unit Allocation Text Amendment (Ordinance No. 016-1992), and the-County's Land Development Regulations. Motion carried unanimously. Motion was made by Commissioner Cheal and seconded by Commissioner Freeman to approve a Grant Application for a joint HRS/County project to identify and eliminate illegal on -site sewage disposal systems (OSDS), with an emphasis on eliminating cesspools. Roll call vote was taken with the following results: Commissioner Cheal Yes Commissioner Freeman Yes Commissioner Reich Yes Mayor London No Motion carried. Motion was made by Commissioner Cheal and seconded by Commissioner Reich to postpone a request to reorganize and redistribute currently budgeted funds within the Growth Management Department to fill the currently frozen position in the Environmental Resources Department. Roll call vote was unanimous. Motion was made by Commissioner Cheal and seconded by Commissioner Freeman adopting the following Resolution allowing the County to combine the three separate Sheriff impact fee accounts into a single account and rescinding the previous Resolution on this subject.
