10/17/1986 AGREEMENT BETWEEN
FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS
AND
MONROE COUNTY
THIS AGREEMENT is between the Florida Department of
Community Affairs (hereinafter called "Department ") and
Monroe County (hereinafter called "County. ")
WHEREAS, The Department and County have certain
responsibilities with regard to mitigation of, preparedness for,
response to, and recovery from disasters; and
WHEREAS, the Department desires to improve its statewide
radio communications network with county emergency management
officials; and
WHEREAS, the placement and use of Department owned radio
equipment in selected county offices shall effectively create a
statewide communications network; and
WHEREAS, it shall be to the benefit of all the citizens
of Florida to establish such a network;
NOW, THEREFORE, in consideration of terms and conditions
set forth herein, the parties agree to as follows:
I. PURPOSE AND SCOPE
A. To assure continued operation of the Local Government
Radio system (LGR) licensed to the Department by the
Federal Communications Commission.
B. To assure the provision of a direct radio link between
the Department and County, using the Operation Secure
radio. The network will provide a direct radio
link between the County and surrounding local
governments using the Local Government Radio system.
This system will then enable the state to
communicate with all county governments possessing
compatible equipment.
C. To assure a reliable radio communications system for
emergency management officials during an emergency
in which telephones fail to operate.
• • .II. TITLE TO EQUIPMENT
All equipment loaned to the County for this purpose is
retained as the property of the Department and is to be
used for the activities described herein for the term of
this Agreement. The equipment is to be located at the
County EOC, 310 Fleming Street, Key West. Upon
termination of the Agreement, the equipment shall remain
the property of the Department and shall be transferred to
the physical control of the Department at the Department's
expense.
III. LIABILITY
The Department shall maintain insurance coverage for the
equipment; however, the county shall be liable for any
damage to the equipment which results from negligence or
misuse by the County.
IV. DISPUTE
In the event that the Department and County are unable to
resolve differences regarding the use, testing, maintenance
or repair of the equipment, either party may terminate this
Agreement without cause, by providing at least thirty (30)
days prior notice in writing, by certified mail, to the
other party.
V. TERMS OF AGREEMENT
A. This Agreement shall take effect upon signature by
both parties and remain in effect until June 30, 1991
or until written notice, by certified mail, is given by
either party thirty (30) days before termination.
B. The Department is responsible for the installation of
the required equipment at the County EOC with
assistance from County personnel.
C. The Department shall train County personnel when the
equipment is installed in the operation of equipment
and associated procedures.
D. The County is responsible for and shall perform at no
cost to the Department regularly scheduled maintenance
as required.

E. Maintenance or repair of the equipment required to
restore defective or inoperable components to a sound
operational state shall be the responsibility of the
Department. All costs associated with such maintenance
must be approved in advance by the Department and is
subject to availability of funds.
F. The County shall operate the equipment in compliance
with the Federal Communications Commission rules and
regulations, Volume V, C.F.R, Part 90.

G. The County shall operate as a 24 hour communications
point in emergency situations, shall conduct a
daily roll call over the Local Government Radio system
(LGR) with designated area counties and shall respond
to roll calls and tests conducted by the Department's
State Warning Point using Operation Secure.
H. The County shall utilize the Department's General
Message Form (Attachment A) to relay information
over the radio systems.
I. The Department shall be permitted unrestricted access
to the equipment by the County during normal working
hours, emergencies, or upon such notice as is reasonable
under the circumstances.
VI. MODIFICATIONS
Any modifications to the Agreement shall be in writing and
signed by officials of both parties. By their signatures
below, the following officials have agreed to these terms
and conditions.
