10/17/1986 FLORIDA EMERGENCY BROADCAST SYSTEMS AGREEMENT BETWEEN FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS AND MONROE COUNTY THIS AGREEMENT is between the Florida Department of Community Affairs (hereinafter called "Department ") and Monroe County (hereinafter called "County "). WHEREAS, the Department desires to establish a Florida Emergency Broadcast System (FEBS) with county emergency management officials and the commercial broadcasting industry; WHEREAS, the placement and use of Department owned radio communication equipment in selected county facilities is essential to the effective operation of a FEBS; WHEREAS, FEBS shall benefit the population of the State of Florida by allowing the transmission of emergency information to commercial broadcast stations in a timely manner and reduce the likelihood of stations broadcasting inaccurate or incomplete emergency response information to the public; NOW, THEREFORE, in consideration of the terms and conditions set forth herein, the parties agree as follows: 1. This Agreement shall take effect upon signature by both parties and remain in effect until June 30, 1991 or until written notice by certified mail, is given by either party to end the Agreement at least thirty (30) days before termination. 2. The equipment (list attached) shall be installed and operated as prescribed by the Florida Emergency Broadcast System Plan by the Department at the following County facility: Monroe County Office of Civil Defense, 310 Fleming Street, Key West, Florida 33040. 3. All equipment is retained as the property of the Department and is to be used by the Department for the activities described herein for the terms of the Agreement. Upon termination of the Agreement, the equipment shall remain the property of the Department and shall be transferred to the physical control of the Department at the Department's expense. 4. The County shall not be liable for any damages to the Department's equipment located in the County's office area. However, the County will exercise reasonable care to ensure that the equipment is not damaged. 5. In the event that the Department and County are unable to resolve differences regarding the use, testing, maintenance or repair of the equipment, the Department or County may terminate this Agreement with 30 days written notice by certified mail. 6. Costs associated with the installation, use, testing, maintenance or repair shall be the responsibility of and paid for by the Department subject to availability of funds. 7. Department personnel shall install, test, maintain and repair the equipment and shall be permitted access to the equipment by the County during normal working hours, emergencies or upon such notice as is reasonable under the circumstances. 8. County personnel are not to move or adjust the equipment without approval from Department personnel since the equipment shall be precisely tuned and adjusted for its operations during testing. 9. Any modifications to the Agreement shall be in writing and signed by officials of both parties. By their signatures below, the following officials have agreed to these terms and conditions.
