05/13/1975 Agreement r r MEMORANDUM OF UNDERSTANDING WHEREAS, on the 13th day of May, 1975, the Board of County Commissioners of Monroe County, Florida, employed the under signed for the position of Assistant County Attorney and as legal adviser to the Monroe County Waste Collection and Disposal Dis- trict, and WHEREAS, it is deemed advisable that the undertaking be reduced to a mutual undertaking, NOW, THEREFORE BE IT KNOWN that the position of Assis- tant County Attorney shall encompass the following duties: 1. To assist the County Attorney in the performance of his duties as legal adviser to the Board of County Commissioners. 2. To serve as legal adviser to the Monroe County Waste Collection and Disposal District. 3. To assist in the legal representations of the Count in all matters in litigation or to be litigated wherein the County or the Waste District are parties litigant. 4. To prepare such legal opinions, documents, papers and memorandums as may be from time to time required by the County or said District. 5. To attend all meetings of the County Commission and Waste District as may be required. 6. To at all times engage in the diligent performance of his assigned duties. 7. To at all times adhere to the code of professional ethics promulgated by the Florida Bar for practicing attorneys at law, and thereunder to allow no conflict of interest arise between himself and said County and /or District. As compensation for said duties, the said attorney shall receive: 1. The annual salary of Six Thousand ($6,000) Dollars as and for his services as an Assistant County Attorney. 2. The annual salary of Four Thousand Eight Hundred ($4,800) Dollars as and for his services as attorney for the District. 3. The County shall furnish unto said attorney a sec- retary to be employed and paid in accordance with the hiring and employment policies of the County in effect for such clerical po- sitions, and she shall be entitled as a County employee to the salary and retirement benefits as are other County employees of similar statusbf SEC. -. 4. That the County agrees that it shall pay one -half (1/2) of the monthly office rental (one half being $84) paid for By said attorney; said rental payment representing the County's se of said attorney's leased premises. 5. Said attorney shall in addition be reimbursed for ravel and per diem in accordance with the provisions of law for .11 travel incurred while on authorized County business. -1- .. 6. Said attorney shall, in addition, be furnished with the following equipment for his use, the same to be inventoried and accounted for at all times: a. An electric typewriter suitable for legal work b. A legal size filing cabinet; c. A secretarial desk and chair; d. A Xerox copier or such other copying device capable of copying pages from books; e. A telephone for County business for which only County calls may be made and all non -local calls listed; f. Current volumes of Florida Statutes, all Codified County Ordinances, and such other rele- vant law books necessary to allow said attorney to fulfil his duties on behalf of the County; g. Office supplies, including but not limited to: District stationery, pencils and pens, legal tablets, short hand tablets, legal size white paper, typewriter ribbons, stamps, legal size file folders and labels, table top file holders, carbon paper, etc. 7. It is expressly understood that all inventory of furniture and equipment shall be strictly accounted for by said attorney and be returned at any time requested of said attorney. 8. It is understood that either the County or said attorney may at any time terminate said employment as called for herein after first giving the other party at least thirty (30) days prior notice of said termination, and within thirty (30) days if not sooner, all equipment, furniture and supplies fur- nished hereunder shall be returned to the County or otherwise accounted for.
