AMENDED
MEMORANDUM OF UNDERSTANDING
WHEREAS, on the 6th day of June, 1975, the undersigned entered
into a Memorandum of Understanding, and
WHEREAS, it is necessary to amend said understanding of June 6,
1975, now therefore,
W I T N E S S E T H:
Said Memorandum of Understanding of June 6, 1975 is amended as
follows:
The position of Assistant County Attorney shall encompass the
following duties:
1. To assist the County Attorney in the performance of his
duties as legal advisor to the Board of County Commissioners.

2. To advise the various County Departments.
3. To act as legal counsel for the Monroe County Zoning Board,
Zoning Board of Adjustment, The Board of Adjustment and Appeals of the
Building Department, the Monroe County Municipal Service District.
4. To assist in the legal representation of the County in all
matters of litigation.
5. To attend such functions and meetings as the Board of County
Commissioners may require.
6. To, at all times, adhere to the code of professionalethics
promulgated by the Florida Bar for practicing attorneys at law; and to
allow no conflict of interest to arise between himself and said Board,
Boards and County Departments.
7. That said attorney shall refrain from the practice of
criminal law.
8. That said attorney shall represent the Monroe County Waste
Collection and Disposal District at least 40% of his time.

A. That said attorney will be paid directly from the budget of
the Monroe County Waste Collection and Disposal District and in turn,
said District shall be entitled as reimbursement from the Board of County
Commissioners of Monroe County a sum representing 60% of the annual salary
paid by said District to said attorney; said reimbursement to be made on
a quarterly basis.
B. The County shall furnish unto said attorney a secretary to
be employed as a County employee and paid in accordance with the person-

nel policies of said County in effect for such clerical positions, and
she shall be entitled as a County employee to the salary and retirement
benefits as are other County employees of similar status.
C. Said attorney shall in addition be reimbursed for travel and
per diem in accordance with the provisions of law for all travel incurred
while on authorized County business.
D. That said attorney shall not be entitled to any reimbursement
for rent except that, if the need shall arise, said Board shall furnish
office space to said attorney.
E. That to the extent that the above provisions amend and modify
the Memorandum of Understanding of June 6, 1975, then the said Memorandum
shall be amended and modified, however, all other provisions shall stand
unmodified.
