Board of County Commissioners
Tuesday, December 21, 1993
Key Colony Beach
The Board held an Attorney -Client Session pursuant to
Sec. 286.011(8), Florida Statutes (1993), with County Attorney
Randy Ludacer, Jim Hendrick, Esq., Alan Greer, Esq., and Paul
Bunge, Esq., in order to discuss the status of New Port Largo v.
Monroe County. The session convened at 1:00 P.M. and was closed
to the public.
The Regular Meeting of the Monroe County Board of
County Commissioners convened at 2:00 P.M. Present and answering
to roll call were Commissioners Earl Cheal, Wilhelmina Harvey,
1 Shirley Freeman, Mary Kay Reich and Mayor London. Also present
were Danny L. Kolhage, Clerk; Randy Ludacer, County Attorney;
James Roberts, County Administrator; County Staff; members of the
Press and Radio; and the general public.
All stood for the Invocation and Pledge of Allegiance.
Motion was made by Commissioner Cheal and seconded by
Commissioner Harvey to approve Additions, Deletions, and
Corrections to the Agenda. Motion carried unanimously.
BULK APPROVALS
Motion was made by Commissioner Cheal and seconded by
Commissioner Freeman to approve the following items by unanimous
consent:
Board adopted the following Resolution of the Monroe
County Board of County Commissioners granting the designation of
"Historic and Cultural Landmark" to Pigeon Key, described as a
5.31 acre island at mile marker 45, along the Old Seven Mile
Bridge, Lot 1, Section 13, Township 66 South, Range 31 East,
Tallahassee Meridian, Pigeon Key, Monroe County, Florida, as
recorded on OR 15, Page 374.

RESOLUTION NO. 524-1993
See Res. Book No. 119 which is incorporated herein by reference.
Board granted authorization for the Mayor to execute,
on behalf of Monroe County, an Amended Confidentiality Agreement
and Addendum III to the Conceptual Approval Agreement of the
Florida Communities Trust Preservation 2000 Grant Contract No.
91-041-P1A, for the purchase of Coco Plum Beach, Marathon,
Florida.
Motion carried unanimously.
GROWTH MANAGEMENT DIVISION
Growth Management Director, Bob Herman discussed
progress on the Transient Center for Cuban Refugees on Stock
Island.
Special Litigation Counsel, Jim Hendrick discussed the
Department of Community Affairs and the City of Key West
Comprehensive Plan Hearings, the progress of the County's
Comprehensive Plan/Land Development Regulations, and a settlement
offer in the Knowles litigation. After discussion, motion was
made by Commissioner Cheal and seconded by Commissioner Freeman
to reject the offer of a settlement in the Knowles litigation.
Motion carried unanimously.
Mr. Herman discussed the Pigeon Key appeal, and the
draft of the Hearing Officer Agreement between Monroe County and
the State of Florida, Division of Administrative Hearing. Motion
was made by Commissioner Cheal and seconded by Commissioner
Freeman granting authorization to execute the proposed Agreement.
Roll call vote was unanimous.
Mr. Herman discussed the Land Development Regulation
Meetings for January 4 and 18, 1994 and requested a Workshop be
called on January 4, 1994 to discuss the proposed Land
Development Regulation changes. Motion was made by Commissioner
Cheal and seconded by Commissioner Harvey to call a Workshop
Meeting on January 4, 1994 at 3:30 P.M. at Key Colony Beach City
Hall for the purpose of discussing the Land Development
Regulations. Motion carried unanimously.
Mr. Herman discussed a Boot Key Harbor mooring study
and indicated that there was no funding currently available.
Mr. Hendrick gave a status report of the proposed
revisions to the Principals for Guiding Development for Areas of
Critical State Concern. Motion was made by Mayor London and
seconded by Commissioner Freeman directing Mr. Hendrick to
prepare a letter to the legislative delegation requesting that

they hold any decisions in obeyance concerning the proposed
revisions to the Principals for Guiding Development until Monroe
County and their Staff can review and comment on those revisions.
Dagny Johnson, representing the Upper Keys Citizens Association,
addressed the Board. Roll call vote was unanimous.
Mr. Hendrick advised the Board that the current state
budget included funding for a Waste Water Treatment Study but no
other funding.
Mr. Herman, D.R. Gregory, H.T. Pontin, and Art Skelly
addressed the Board, concerning the update on progress of a
Channel Marking Program. Motion was made by Commissioner Cheal
and seconded by Commissioner Harvey approving Staff
recommendation, for approval of a request for a bidding process
to be instituted, subject to appropriate in-house review. Motion
carried unanimously.
COMMISSIONERS' ITEMS
Mayor London discussed a procedure for coordination of
responses to noise complaints. Special Litigation Counsel, Jim
Hendrick, discussed a meeting he chaired with the Sheriff, State
Attorney, Code Enforcement and the County Attorney. The group
discussed ways to strengthen enforcement of noise complaints. He
also advised the Board that a suit has been filed against Key
Largo Beach Club for continued noise violations. He expects a
Hearing before Judge Overby in the near future.
PUBLIC HEARINGS
The continuation of a Public hearing was held
concerning an Ordinance of the Board of County Commissioners of
Monroe County, Florida, amending Ordinance No. 031-1992 and
Section 6-40, Monroe County Code; Providing that a Building
Permit be required for each principal structure prior to
construction; Providing for compliance with the Dwelling Unit
Allocation Ordinance; Providing for expiration of Building
Permits older than five (5) years; Providing for completion of
structures which have received an approved framing inspection;
Providing for Declaration of Public Nuisance and requiring the
completion or removal of principal structure(s) which have not
received either a final exterior inspection or a Certificate of
Occupancy within two (2) years of an approved framing inspection;
Providing a Variance Procedure; Providing that the provisions of
this Ordinance shall control over any inconsistent provisions of
the Monroe County Code; Providing for severability; Providing for
the repeal of all Ordinances inconsistent herewith; Providing for
incorporation into the Monroe County Code; and Providing an
-' effective date. Motion was made by Mayor London and seconded by

Commissioner Cheal to read by Title only. County Attorney, Randy
Ludacer read by title only. Motion carried unanimously. Bill
Smith, representing the Florida Keys Contractors Association;
Bill Cullen, representing the Owners/Builders of Monroe County;
Walter Carson, representing the Florida Keys Contractors
Association; and Bill Devitt, General Contractor, addressed the
Board. Motion was made by Commissioner Reich and seconded by
Commissioner Harvey to adopt the following Ordinance, as amended.
Said amendment as follows:
Page 4, (e), Paragraph 2, insert the words "without
charge" between the words "the permit holder" and "for up to",
and replace the words "No more than one 60 day extension may be
granted under subsection (e)." with the words "In addition, the
permit may be extended within sixty (60) days after expiration
for a single, one time only, one hundred and twenty (120) day
period after the payment of a $100.00 renewal fee." at the end of
the paragraph.
Page 5, Paragraph 2, delete the word "etc." and insert
a period (.)" after the word "management", at the end of the
paragraph.

Roll call vote was unanimous.
County Attorney Randy Ludacer removed item E-2 from
today's Agenda concerning a Public Hearing to consider the
adoption of sixteen (16) affordable housing incentive
recommendations received from the Affordable Housing Advisory
Committee which are designed to encourage and facilitate
affordable housing and to schedule the implementation of an
expedited permit processing procedure for affordable housing
projects in Monroe County, Florida. Mr. Jeff Smith, of the
Affordable Housing Advisory Committee advised the Board that they
would be conducting their advertised meeting in the room adjacent
to the Key Colony Beach City Hall.
The Board discussed the method of the announcement in
reading proposed Ordinances. Motion was made by Commissioner
Cheal and seconded by Commissioner Freeman directing the County
Attorney to automatically read all proposed Ordinances at Public
Hearings without specific motion by the Board to do so unless
there is an objection to it'. Motion carried unanimously.
The continuation of a Public Hearing was held
concerning an Ordinance creating Chapter 2.4, Monroe County Code,
in order to provide for definition; Providing that a five percent
preference for local business enterprises may be given by the
County Commission in the award of contracts for the purchase of

goods, services, or construction of capital improvements, above
the bid of the lower nonlocal responsible bidder; Providing for
exceptions; Providing for severability; Providing for repeal of
all Ordinances inconsistent herewith; Providing for incorporation
into the Monroe County Code; and Providing an effective date.
County Attorney Randy Ludacer read by title only. George Kundtz,
representing the Florida Keys Citizens Coalition; and Walter
Carson, representing the Florida Keys Contractors Association,
addressed the Board. After discussion, the Ordinance was
withdrawn by the sponsor, Commissioner Harvey.
A Public Hearing was held concerning an Ordinance of
the Board of County Commissioners of Monroe County, Florida,
amending Section 6-64(c), Monroe County Code; Providing for
changes in insurance requirements for contractors to comply with
the State requirement; Providing for severability; Providing for
repeal of all Ordinances inconsistent herewith; Providing for
incorporation into the Monroe County Code, and providing an
effective date. County Attorney, Randy Ludacer, read by title
only. There was no public input. Motion was made by
Commissioner Freeman and seconded by Commissioner Cheal to adopt
the following Ordinance. Roll call vote was unanimous.

A Public Hearing was held concerning an Ordinance
amending Section 11-1(a), Monroe County Code, in order to provide
that the speed limit on Trinidad Road and West Indies Drive on
Ramrod Key shall be twenty-five miles per hour; Providing for
severability; Providing for the repeal of all Ordinances
inconsistent herewith; Providing for the incorporation into the
Monroe County Code; and providing an effective date. County
Attorney, Randy Ludacer, read by title only. There was no public
input. Motion was made by Commissioner Cheal and seconded by
Commissioner Harvey to adopt the following Ordinance, with the
deletion of the reference to Trinidad Road. Roll call vote was
unanimous.

SOUNDING BOARD
Henry Arnold addressed the Board concerning a trailer
located at Sombrero Beach. Public Works Director, Dent Pierce,
Bettye Chaplin, and Roy DeGive, addressed the Board. Motion was
made by Commissioner Cheal and seconded by Commissioner Freeman
directing Staff to get definite prices on trailers under the
$15,000.00 range and report back with a recommendation to the
Board. Roll call vote was taken with the following results:

Mr. and Mrs. H. D. Farmer addressed the Board
concerning a noise disturbance from Lorelei Bar. This matter was
referred to Special Litigation Counsel, Jim Hendrick.
Norman Moodie addressed the Board concerning a proposal
to place a visitor/tourist information booth on County property.
No official action was taken.
Richard Moretti addressed the Board concerning a
proposal for the Board of County Commissioners to request the
State of Florida to remove a dilapidated building located just
east of the entrance to the Marathon Government Center facing the
Overseas Highway. Motion was made by Commissioner Cheal and
seconded by Commissioner Harvey authorizing a letter from the
Mayor to the State explaining the urgent need to remove a
dilapidated building near the Marathon Government Center and
requesting that they remove with haste, to resolve the issue.
Motion carried unanimously.
John Donnelly addressed the Board concerning a noise
disturbance from the Key Largo Bay Beach Resort. No official
action was taken.
DIVISION OF GROWTH MANAGEMENT
Motion was made by Commissioner Cheal and seconded by
Commissioner Freeman to continue to the next Board Meeting on
January 19, 1994, the presentation of the Annual Report by the
Parks & Recreation Advisory Board Chairman, Duncan Matthewson.
Motion carried unanimously.
The Board returned to the discussion of Ordinance No.
036-1993, of the Board of County Commissioners of Monroe County,
Florida, amending Ordinance No. 031-1992 and Section 6-40, Monroe
County Code; Providing that a Building Permit be required for

Motion was made by Commissioner Cheal and seconded by
Commissioner.Freeman directing Staff to evaluate the situation
involving approximately fifty (50) expired building permits and
report back to the Board at the next Board Meeting on February
16, 1994, in Key Largo. Motion carried unanimously.
Special Litigation Counsel, Jim Hendrick discussed
proposed language to the Variance criteria. Bill Cullen,
addressed the Board. Motion was made by Commissioner Reich and
seconded by Commissioner Harvey to advertise an Amendment to
Ordinance No. 036-1993, concerning the Variance procedure.
Motion carried unanimously.
COMMISSIONERS' ITEMS
Commissioner Reich discussed a Code Enforcement
violation foreclosure procedure in the Upper Keys concerning
Monroe County, Florida, vs. Peter J. Antonoff and Ray Korbal.
Motion was made by Commissioner Harvey and seconded by
Commissioner Reich directing Attorney Alfred K. Frigola to seek
receivership in the case as he deems appropriate. Motion carried
unanimously.
Commissioner Harvey discussed the Christmas and New
Year Holidays. Motion was made by Commissioner Harvey and
seconded by Mayor London giving County employees a half day off
on December 23, 1993. Roll call vote was taken with the

Motion failed.
Mayor London discussed the need for a consolidated
application process for film companies. This matter was referred
to the County Administrator.
COUNTY CLERK
County Clerk, Danny L. Kolhage presented a Report on

the Defeasance of the Card Sound Road and Bridge Improvement
Revenue Bonds, Series 1993, prepared by Public Financial
Management, Inc. The Clerk and the County Administrator briefly
discussed this item. The Board discussed the issuance of a
demand letter to Post Buckley Schuh & Jernigan, and the need to
proceed with the defeasance of the bonds as recommended by Public
Financial Management, the Board's financial advisor. Further
consideration was postponed to the next day.

WHEREAS, due to the high real estate values, expensive
construction costs, and strict regulatory controls, the cost of
maintaining a business in Monroe County is higher than elsewhere
in the state;
WHEREAS, it is desired to encourage businesses to remain in,
and relocate to, Monroe County, to further enhance and stabilize
the local economy;
WHEREAS, Monroe County is a frequent market participant in
the purchase of goods and services; and
WHEREAS, a rational method to alleviate the disadvantages
described would be to allocate County funds used for the purchase
of goods and services in such a way that local business enter-
prises receive a five percent bidding preference; now, therefore,
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that:
Section 1. Chapter 2.4, Monroe County Code, is hereby
created to read as follows:
Sec. 2.4-1. Definition of local business enterprise.
A business shall be considered a local business
enterprise if it meets the following test:
A business with fixed offices or distribution
points located within the boundaries of Monroe County,
and listed with the Tax Collector with an occupational
license tax paid with a Monroe County business street
address, at least 24 hours before the publication of
the call for bids or request for proposals. Post
office box numbers or residential addresses may not be
used solely to establish status as a local business
enterprise.
In the case of a business which is a joint ven-
ture, it is sufficient for qualification as a local
business enterprise if one of the joint venturers meets
the test set forth above.
Sec. 2.4-2. Local business enterprise preference.
In the purchase of, or the contract for, goods,
services, or construction of capital improvements, the
County Commission may give a preference to a responsive
and responsible local business enterprise in an amount
not to exceed 57 of the bid of the lowest nonlocal
responsible and responsive bidder. The preference
shall not apply when it would conflict with a statute,
administrative rule, or the terms of any grant funding
the purchase or contract. The request for proposals or
bids for a contract subject to the 5% local preference
established in this ordinance shall contain a notice to
that effect.
Section 2. If any section, subsection, sentence, clause
or provision of this ordinance is held invalid, the remainder of
this ordinance shall not be affected by such invalidity.
Section 3. All ordinances or parts of ordinances in
conflict with this ordinance are hereby repealed to the extent of
said conflict.
Section 4. The provisions of this ordinance shall be
included and incorporated in the Code of Ordinances of the County
of Monroe, Florida, as an addition or amendment thereto, and
shall be appropriately renumbered to conform to the uniform
numbering system of the Code.
Section 5. This ordinance shall take effect immediately
upon receipt of official notice from the Office of the Secretary
of State of the State of Florida that this ordinance has been
filed with said Office.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the day of , A.D., 1993.

NOTICE IS HEREBY GIVEN that the Board of County Commis-
sioners of Monroe County, Florida, will hold a public hearing on
Tuesday, December 21, 1993, at 3:00 p.m., at Key Colony Beach
City Hall, Key Colony Beach, Monroe County, Florida, with the
Affordable Housing Advisory Committee (AHAC), created in
conjunction with the State Housing Initiative Partnership Act
(SHIP) made applicable in Monroe County by County Ordinance No.
012-1993. The County Commission will consider the adoption of
sixteen (16) affordable housing incentive recommendations
received from the AHAC which are designed to encourage and
facilitate affordable housing and to schedule the implementation
of an expedited permit processing procedure for affordable
housing projects in Monroe County, Florida.

Tuesday, December 21,1993, at 3:00p.m., at Key Colony Beach City Hall,
Key Colony Beach, Monroe County, Florida, with the Affordable Housing
Advisory Committee (AHAC), created in conjunction with the State
Housing Initiative Partnership Act (SHIP) made applicable in Monroe
County by County Ordinance No. 012-1993. The County Commission will
consider the adoption of sixteen (16) affordable house incentive recommen-
dations received from the AHAC which are designed to encourage and
facilitate affordable housing and to schedule the implementation of an
expedited permit processing procedure for affordable housing projects in
Monroe County, Florida.
A copy of the tentative AHAC recommendations may be
obtained from the Monroe County Housing Authority, 1400 Kennedy
Drive, Key West, Florida 33040. - (305) 292-1221.
Pursuant to Section 286.0105, Florida Statutes, notice is given that if
a person decided to appeal any decision made by the Board with respect to
any matter considered at such hearing or meeting, he will need a record of
the proceedings, and that, for such purpose, he may need to ensure that a
verbatim record of the proceedings is made, which record includes the
testimony and evidence upon which the appeal is to be based.
Copies of the above -referenced ordinance are available for review at
the various public libraries in Monroe County, Florida.
