Brown, County Administrator Monroe County Public Service Building Junior College Road Stock Island, Key West, FL 33040 Dear Mr. Brown: On March 15, 1990, in accordance with an ordinance adopted by the Board of County Commissioners and a written request from you, this office authorized the wire transfer of $2,340,000 to an account of the State Treasurer of the State of Florida for credit to the Department of General Services. That transfer represented the majority of the funding to be provided by the County in accordance with an Agreement for Services dated January 9, 1990 between the Board of County Commissioners and the Department of General Services of the State of Florida for ser- vices in connection with the construction of the Monroe County Government Center (Regional Service Center) in Marathon. It is my understanding, based upon a report by the County Attorney to the Board of County Commissioners, that a recent decision in the District Court of Appeals has invalidated the land use designation of the property upon which the facili- ties were to be built. The Board also took action, by motion, to direct the staff to proceed with a Land Use Plan amendment to rezone the Marathon Government Complex property to the appropriate zoning in order to reverse the effect of the litigation referred to above. It has been my experience that amendments to the Comprehensive Land Use Plan, including map amendments, can take an extensive period of time to accomplish - in some cases, one to two years. I am also aware that this project has been delayed by litigation brought by some property owners who feel they have been affected by certain aspects of the project. is Thomas W. Brown, County Administrator Monroe County Public Service Building Junior College Road July 27, 1990 Stock Island, Key West, FL 33040 Page Two I am writing this letter to request from you infor- mation concerning the status of the project and, by a copy of this letter, I am requesting the County Attorney to advise me of the status of the County's agreement with the Department of General Services relative to the County funds that have been com- mitted for construction and, specifically, the $2,340,000 which has been transferred to the State Department of General Services. I know that you are aware of the fact that our source of funding for this project comes from the proceeds of the 1988 Series B Bond Issue. As the Financial Officer of the Board of County Commissioners, I do not believe that it is appropriate or in the County's best interest for County funds to remain on deposit with the State of Florida for any extended length of time while these legal and administrative details are being resolved. Since my future actions in this matter will be guided by the information that I receive from you, I am respectfully requesting that you respond as quickly as possible. Sincerely yours, Danny L. In accordance with Monroe County's agreement with the Department of General Services, the County originally • deposited $2,340,000 with you for this project. You advised me that as of August 10, 1992, these deposited funds had earned $408,641.21 in interest. On August 27, 1992, the Monroe County Board of County Commissioners met and approved release of $326,000 of the • County's interest earnings to cover the reported funding deficiencies for the County's share of this project. Accordingly, you are authorized and requested to expedite initiating whatever actions may be necessary to effect including this $326,000 of interest earnings in the • Monroe County budget for this project.
